【案情简介】

柯小姐的丈夫单先生系某设计公司董事长，常年在外出差。2014 年末柯小姐偶然机会翻看单先生的手机短信和通话记录，竟发现单先生在贵阳与其他女性同居，遂将单先生和“小三”互发的短信转发到自己的手机上，并拍摄下他们的通讯记录。柯小姐持短信消息、通话记录质问单先生，单先生承认存在外遇事实，并告知柯小姐其已与小三同居三年，且育有一女“程程”。单先生当场向柯小姐提出协议离婚，上述内容均被柯小姐以录音的方式留存下来。万念俱灰的柯小姐于2015年1月向法院提起离婚诉讼，并以其持有的手机短信、通讯记录及电话录音作为证据要求法院认定单先生有外遇过错，离婚时应对柯小姐进行损害赔偿。单先生则认为，此短信、通讯记录和电话录音的内容虽真实，但系柯小姐在自己不知情的情况下获取，侵犯了自己的隐私权，因而不能作为证据使用。

【意见分歧】

就本案手机短信、通讯记录和电话录音能否证明单先生有外遇，存在以下两种法律意见：

第一种意见认为，该手机短信、通讯记录和电话录音能作为单先生有外遇的证据，因为单先生对该手机短信、通讯记录和电话录音的真实性并无异议。

第二种意见认为，该手机短信、通讯记录和电话录音不能作为单先生有外遇的证据。因为该手机短信和电话录音系柯小姐私自转发和录音所得，不具有证据的合法性。【律师点评】

随着现代社会不断发展，信息网络及通信技术取得了显著成果，电话及短信作为社会的一种信息交流方式，已变得不可或缺，手机录音录像功能的完备更是为当时人收集证据提供了很大方便。本案中的手机短信、通讯记录及电话录音是否能证明单先生存在外遇行为，知名深圳婚姻律师团马成律师同意第一种意见。理由如下：

第一、根据我国《民事诉讼法》第六十三条规定：“ 证据包括：

（一）当事人的陈述；

（二）书证；

（三）物证；

（四）视听资料；

（五）电子数据；

（六）证人证言；

（七）鉴定意见；

（八）勘验笔录。证据必须查证属实，才能作为认定事实的根据。”及最高人民法院关于适用《中华人民共和国民事诉讼法》解释第一百一十六条第二款、第三款的规定“电子数据是指通过电子邮件、电子数据交换、网上聊天记录、博客、微博客、手机短信、电子签名、域名等形成或者存储在电子介质中的信息。存储在电子介质中的录音资料和影像资料，适用电子数据的规定。”可知手机短信和通话记录属于电子数据的范畴，电话录音在证据分类上属于视听资料，因而上述证据均可以作为诉讼证据来证明案件事实，关键在于上述证据的证明力及证明力大小的问题。

第二，《最高人民法院关于民事诉讼证据的若干规定》第七十二条第一款规定“一方当事人提出的证据，另一方当事人认可或者提出的相反证据不足以反驳的，人民法院可以确认其证明力。”如果柯小姐的丈夫单先生对该手机短信内容和通话记录的真实性无异议，也没有相反证据反驳的，法院就会确认其证明力；关于电话录音，只要该录音没有侵犯对方重大隐私，在不违背公序良俗的情况下可以作为证据，但需注意录音必须完整，保留录音的原始载体，不能剪辑。第六十六条规定：“审判人员对案件的全部证据，应当从各证据与案件事实的关联程度、各证据之间的联系等方面进行综合审查判断。”手机短信内容、通话记录和电话录音，如果作为独立的证据使用，其证明力较小，但从该案件的整个证据链来看，两者可以互相印证，可以作为认定单先生有外遇事实的依据。

第三，《婚姻法》第四十六条规定：“有下列情形之一，导致离婚的，无过错方有权请求损害赔偿：

（一）重婚的；

（二）有配偶者与他人同居的；

（三）实施家庭暴力的；

（四）虐待、遗弃家庭成员的。”本案单先生的外遇行为属于有配偶者与他人同居，因此，柯小姐可以请求损害赔偿。需要注意的是，并非任何一个离婚案件中存在外遇的一方均应赔偿，无过错方必须有证据证明另一方与他人同居生活，才能最终认定构成婚姻法规定的过错行为，此时过错方应对无过错方进行赔偿。若只是偶尔的一两次出轨，也可以算外遇行为，但并不会因此而构成婚姻法规定的过错。

一、能证明夫妻分居的证据

1、双方签订的夫妻分居书面协议;

2、一方在外居住的房屋租赁合同;

3、一方向另一方发出的书面分居协议，最好是用快件性质邮寄，在备注栏里注明“分居”，并且保留邮寄凭证，从邮寄之日起到提起离婚期间属于夫妻分居时间;推荐阅读：婚姻法全文

4、双方来往的书信、电子邮件等能证明双方感情不和分居的事实;

5、人证，如朋友、亲戚或邻居，除了证人证言外最好再辅佐以其他的证据，这样被法院采信的几率高。相关法律可参考：

《婚姻法》第三十二条 男女一方要求离婚的，可由有关部门进行调解或直接向人民法院提出离婚诉讼。

人民法院审理离婚案件，应当进行调解;如感情确已破裂，调解无效，应准予离婚。

有下列情形之一，调解无效的，应准予离婚：(一)重婚或有配偶者与他人同居的;(二)实施家庭暴力或虐待、遗弃家庭成员的;(三)有赌博、吸毒等恶习屡教不改的;(四)因感情不和分居满二年的;(五)其他导致夫妻感情破裂的情形。《民事诉讼法》第六十三条证据有下列几种：

(一)书证;(二)物证;(三)视听资料;(四)证人证言;(五)当事人的陈述;(六)鉴定结论;(七)勘验笔录。

以上证据必须查证属实，才能作为认定事实的根据。第六十四条当事人对自己提出的主张，有责任提供证据。

二、离婚时通话记录能作为证据吗

在我国司法实践中将计算机记录和存储的数据证据归入“视听资料”类证据

。该类证据一般为间接性证据，需要与其他证据相互印证进而组成一个证据链，才能达到证明目的。

(二)、网络聊天、手机短息可否作为证据使用。

通过办理离婚案件，我们可知仅有聊天记录、手机短信不能证明夫妻感情破裂，法院也是不予认可的，但有网络聊天记录、手机短信及其他相关证据能够相互印证那么证明目的是可以达到的。

(三)、网络聊天证据的取得不应侵犯对方当事人或者第三者的隐私权。
