问:中欧光伏产品贸易争端达成协议后,将对中国光伏产品对欧盟出口产生什么具体影响?中国光伏产品按价格承诺方式进入欧盟市场将怎样管理?此外,欧委会透露中国对欧葡萄酒、多晶硅的调查将在明年春季得出结论并留给欧洲企业谈判空间的情况是否属实?中方计划如何解决欧盟葡萄酒可能存在倾销与补贴的问题?
答:8月2日欧委会批准中欧光伏价格承诺协议,8月3日正式公告,8月6日正式实施。欧委会决定接受由中国机电进出口商会和94家中国出口企业提出的价格承诺。自8月6日起,参加价格承诺的企业将免征反倾销税,其他未参加企业将按照公告中具体税率支付反倾销税。
商务部对欧委会批准通过并公告实施中欧光伏价格承诺协议表示欢迎。我们认为,光伏案的妥善解决,有助于中国光伏企业继续对欧出口并保持合理的市场份额,也可以满足欧盟用户的需要,符合中欧双方共同利益。
对欧盟光伏产品出口价格承诺和数量分配如何执行,其实是企业如何完善行为自律的问题。据了解,遵循的将是 “由商会协调、以企业为主体自主协商确定”,以及“谁应诉、谁受益”的原则。目前中国机电进出口商会正在组织有关企业研究制定相关实施办法和数量分配方案,并将在反复征求企业意见、充分体现企业自主商定原则的基础上,尽快付诸实施。
中国对欧盟多晶硅和葡萄酒的双反调查,目前仍在调查程序中。商务部将依法调查并做出决定。同时,我们愿意看到双方业界通过对话协商与合作,寻求更好的解决途径。
问:有报道称,新西兰贸易部长近日在接受采访时说中国在新西兰乳制品企业发现可能含有肉毒杆菌后,已经全面停止进口所有产自新西兰奶粉。请问该说法是否属实?商务部对此有何评论?
答:经中新双方核查,初步确定有4家中国境内进口商进口了可能受到肉毒杆菌污染的新西兰恒天然集团生产的乳制品。商务部、国家质检总局等国家有关部门对新西兰乳制品受污染事件高度重视。已要求新方及时向中方通报情况,采取切实措施防止问题产品影响中国消费者健康,进一步加强其对出口到中国的乳制品的检验检疫监管;同时,要求进口商召回可能受污染的产品。有关进展情况请关注国家质检总局的通报。
问:据报道,按照原计划,上海自贸区相关规则应该在7月下旬公布,但中国政府推迟了规则的公布。请问具体原因是什么?
答:7月3日,国务院常务会议讨论并原则通过了《中国(上海)自由贸易试验区总体方案》。这是顺应全球经贸发展新趋势,更加积极主动对外开放的,目的是要进一步深化改革,加快政府职能转变,积极探索政府经贸和投资管理模式创新,扩大服务业开放,使之成为推进改革和提高开放型经济水平的“试验田”,形成可复制、可推广的经验,发挥示范带动、服务全国的积极作用。此次国务院常务会议同时要求国务院有关部门根据会议精神对《总体方案》作进一步修改完善后,按程序报国务院审定。目前,《总体方案》正在进一步完善并按程序办理中,离正式审定批准公布的时间应该不会很长了。
问:中日韩自贸协定(FTA)第二轮谈判已于上周五在上海结束,此轮谈判取得哪些进展?存在哪些难点?下一步将如何推动?
答:中方于2013年7月30日-8月2日在上海主办了中日韩自贸区第二轮谈判。商务部国际贸易谈判副代表俞建华率团与会,外交部、发展改革委、工信部、财政部、农业部、海关总署、工商总局、质检总局等部门派员参会。日本外务省审议官长岭安政和韩国通商产业资源部部长助理禹泰熙也分别率团与会。期间,三方就谈判的基本模式和框架范围进行了讨论,并举行了货物、服务、原产地规则、贸易救济、海关程序和贸易便利化、技术贸易壁垒(TBT)、卫生和植物卫生措施(SPS)、竞争政策、知识产权、电子商务等10个工作组和专家组会议。
由于中日韩三国处于不同的发展阶段,三方在谈判中所关注的领域和敏感议题各不相同。从目前情况看,日、韩关注的领域十分广泛,其中诸如环境、劳工、粮食安全、信息技术、电子商务、商业环境等,均属自贸区谈判的新兴领域。三方已商定于今年年底在日本举行第三轮谈判。我们认为,三方应在坦诚相待和相互理解的前提下,最大限度地显示灵活性,以取得互利互惠、平等共赢的结果。
问:有报道称,中国在斯里兰卡投资5亿美元援建的大型集装箱码头已于8月5日正式启用。请问这项工程的建设对中国以及斯里兰卡具有何重要意义? 答:据了解,斯里兰卡科伦坡南集装箱码头项目由招商局国际公司以BOT模式与斯方共同投资合作建设,总投资5亿美元。经过不到两年的施工建设,日前码头首个泊位已投入运行。在项目经营期内,中国公司将负责码头的设计、建造和运营管理。
中国政府积极引导有实力、有信誉的大型承包工程企业参与国际交通与基础设施建设领域的投资合作,同时鼓励企业不断积累经验和实力,从传统单一的项目采购施工方式向设计咨询和运营管理等模式转变,从而更好地为外国业主提供质量一流和价格合理的产品和服务,并为当地经济社会和民生发展做出积极贡献。
问:商务部负责经营者集中反垄断审查工作,能否介绍一下今年以来商务部收到的申报案件数量和总体办理的结果?另外,商务部在反垄断审查的信息披露方面依据什么原则?
答:今年上半年,商务部共收到经营者集中反垄断申报案件112件,其中立案105件,审结103件。在已审结的案件中,附条件批准2件,分别为嘉能可国际公司收购斯特拉塔公司案、丸红公司收购高鸿公司案,其余案件均无条件批准。
商务部反垄断局自成立并依法受理经营者集中反垄断审查案件以来,一直在认真履行职责,严格依法开展经营者集中反垄断审查工作,维护公平的市场竞争环境。按照《反垄断法》等相关法律规定,以及政务公开的要求,我们每季度会在商务部网站上公布案件基本信息,并向社会公布附条件批准和禁止的审查决定;对于无条件批准的决定信息一般不主动对外披露。
问:有报道称,继葛兰素史克丑闻爆发以来,赛诺菲、礼来这两家大型外资药企日前也遭到中国工商部门的调查。请问这些调查是否重点针对外资企业?会不会影响跨国公司对华投资的信心?
答:商务部对媒体近期关于葛兰素史克、赛诺菲、礼来等外商投资制药企业的报道非常关注。遵纪守法是每个企业应尽的责任,无论外资企业还是内资企业,一旦触犯中国法律,都将受到法律制裁,承担相应的法律责任。
众所周知的是,绝大多数在华投资的外商投资企业守法意识高,能够依法经营,已经成为中国经济的重要组成部分。所谓调查重点针对外资企业的说法毫无依据。
在此我愿再次重申,中国政府坚持对外开放的方针是坚定不移的,中国积极利用外资的政策没有也不会改变。依法查处此类案件,进一步表明中国政府将继续致力于完善、优化投资环境,努力为各国投资者创造公平、平等竞争机会的决心。创造公平竞争环境是改善中国投资环境的重要内容,希望大家能够从客观、积极的角度看待这类事情。我们相信,依法查处违法企业将有利于增强跨国公司对华投资信心,而不是相反。

Q: China and EU have reached agreement on trade dispute of China’s PV products, so what kinds of influences it will bring on China’s export of PV products to EU market? How to manage it when China’s PV products enter EU market in the light of the price commitment ? Besides, European Commission disclosed that China would come to the final ruling on investigation of European wine and polysilicon next spring and leave elbow room for negotiations for European enterprises, is it true or not? How does China plan to deal with the issue relating to the possible dumping and subsidy of European wine?
A: European Commission approved China’s price commitment on PV products on August 2.On August 3, the official announcement was issued and it entered into force on August 6.European Commission decided to adopt the price commitment proposed by the China Chamber of Commerce for Import and Export of Machinery and Electronics Products(CCCME)and 94 exporting companies in China.Starting from August 6, companies involved in the price commitment will exempt from anti-dumping tax, while others will pay the anti-dumping taxes in the light of the tax rate provided in the announcement.Ministry of Commerce welcomes European Commission’s approval and adoption of the price commitment on China’s PV products.We believe that to solve the PV case in a proper way is conducive to the continuous export of China’s PV products to EU market and a reasonable market share of China’s PV products.Besides, it can also satisfy the needs of European users and are in the common interest of both sides’.How to apply the price undertaking and quantity distribution of exports of solar panels is a question of self-discipline for the company.As far as we know, it will follow the principle of “chamber coordinates, companies decide”and “who defends, who benefits”.CCCME is organizing relevant companies to do the researches, work out an implementation measures and a quantity distribution plan in the principle of soliciting companies’ opinions and advocating companies’ independence in decision-making so as to put them into practice as soon as possible.China’s anti-dumping and anti-subsidy investigations on imports of the wine and polysilicon originated from Europe are still under way.Ministry of Commerce will make a ruling on the basis of the ivestigation.Meanwhile, we also expect that both sides can seek better ways to solve the problems by dialogues and cooperation.Q: It is reported that New Zealand Trade Minister mentioned in an interview recently that China have stopped all the import of dairy products from New Zealand when they found the potential bacillus botulinus in milk powder from New Zealand.Is it true or not? How do you comment on it?
A: Both sides have carried on investigations and come to preliminary confirmation that 4 domestic importers had imported the milk powder with bacillus botulinus originated from New Zealand Fonterra Co-operative Group.Ministry of Commerce and General Administration of Quality Supervision, Inspection and Quarantine the People’s Republic of China(AQSIQ)attach much importance to New Zealand contaminated milk powder case.We have required the New Zealand part to inform us the latest update, take pragmatic measures to avoid further influences on Chinese consumers and strengthen the quality supervision and inspection of the exports of milk powder to China.Meanwhile, the importers are also required to recall of the possible contaminated products and you may pay close attention to the notice of AQSIQ for the latest update.Q: The regulations of Shanghai Free Trade Area should be released in late July as planned, but it was postponed by Chinese government according to the report.So what’s the reason? A: Executive meetings of the State Council discussed and passed An Overall Planning for Shanghai Free Trade Area.This significant intiative is to follow the new trend of global development and more positively involved in China’s opening up to the outside world, aiming to deepen the reformation, fasten the transformation of government functions, explore innovations on models of government’s trade and investment management and expand the opening of trade in service.All of these are conducive to the success of “pilot program ,or experiment ”in pushing the reformation and improving the level of opening economy, with those repeatable and propagable experience, can further play an exemplary and leading role in the country’s economy.Executive meetings of the State Council also required that relevant departments of the State Council to perfect the overall planning and follow the procedures to submit to State Council for its approval.At present, it is under way and should be not far away from the final release.Q: The second round negotiations for China-Japan-South Korea FTA has come to an end last Friday.What achievements are made in this round of negotiations? What difficulties? How to push it for next step?
A: China hosted the second round negotiations for China-Japan-South Korea FTA in Shanghai from July 30, 2013 to August 2.Deputy China International Trade Representative Yu Jianhua, as well as officials from Ministry of Foreign Affairs, National Development and Reform Commission(NDRC), Ministry of Industry and Information Technology, Ministry of Finance, Ministry of Agriculture, General Customs Administration, State Administration for Industry and Commerce and General Administration of Quality Supervision, Inspection and Quarantine, attended the meeting.Officials from Ministry of Foreign Affairs of Japan and Minister assistant from Ministry of Trade, Industry, Energy, South Korea also led the delegation to attend the meeting.The three parties had a discussion on the basic negotiation model and framework in the meeting and set up ten working groups: Trade in Goods, Trade in Service, Rules of Origin, Trade Remedies, Customs Procedures and Trade Facilitation, Technical Barriers to Trade, Sanitary and Phytosanitary Measures, Competition Policy, Intellectual Property and Electronic Commerce as well as the specialist group meeting.China, Japan and South Korea are at different levels of development at the moment, so the areas and issues they are concerned vary from one to another.Japan and South Korea had a wide coverage of areas like the environment, labor force, food security, information technology, electronic commerce, business environment, all of which are new emerging areas for FTA negotiations.The three parts have decided to hold the third round of negotiations in Japan at the end of this year.We believe that each party should maximize its flexibility on the basis of honesty and understanding, so as to achieve the reciprocal and equal win-win benefits.Q: It is reported that the USD$500 milion container terminal China invested in Sri Lanka officially opened on August 5.What kinds of significance it has on China as well as Sri Lanka? A: As far as I know, the COLOMBO south container terminal is co-invested by China Merchants Holdings(International)Company Limited and Sri Lanka part in BOT model with a total investment of USD$500 million.In less than two years, the first berth has gone into service.China will be responsible for the design, construction and operation management of the terminal.Chinese government will positively guide large contracting enterprises with ability and credit to join the investment cooperation in the international transportation and infrastructure construction area, encourage them to accumulate rich experience and enhance the strength, transfer from procurement,construction to design,consultation and management, so as to provide clients with the high-quality products and service at reasonable prices and make positive contributions to the local economic, social and livelihood development.Q: The Ministry of Commerce is responsible for the review of concentration of undertakings, could you brief on the number of notification in 2013 and the results? And what is the principle on information disclosure regarding the review of concentration of undertakings? A: MOFCOM received a total of 112 notifications for concentration review in the first half of 2013, of which 105 reviews were initiated, and 103 reviews were concluded.Among the concluded cases, Glencore International Plc’s purchase of Xstrata Plc and Marubeni Corporation’s purchase of Glencore International Plc were conditional approvals, the rest were unconditional approvals.The Anti-Monopoly Bureau of MOFCOM has diligently performed its functions since it has been established, accepting the applications for the review of concentration of undertakings, and maintaining a market environment for fair competition.According to the regulations of the Anti-dumping Law and relevant laws and the requirements of making government affairs public, we release basic information every quarter on the website of MOFCOM, making public those conditional approvals and disapproved;while information on those unconditional approvals usually will not be released.Q: It is reported that two large foreign pharmaceutical companies, Sanofi and Eli Lilly were also investigated by China's administrative department after the outbreak of the scandal of GlaxoSmithKline.Does the investigation focus on foreign-invested enterprises? Will it affect the confidence of multinational companies to invest in China? A: MOFCOM has paid attention to news on foreign-invested pharmaceutical companies including GlaxoSmithKline, Sanofi and Eli Lilly.It is the obligation of every foreign-invested and domestic enterprise to abide the law, and those violating China’s laws will be subjected to legal sanctions, and should undertake legal liabilities.Most foreign-invested enterprises in China, which have become an important part of Chinese economy, have a high sense of law-abiding, and comply with the law.And it is groundless to make such assertions that the investigation focuses on foreign-invested companies.I would like to reiterate that the Chinese government will adhere to the policy of opening up, and China's policy of proactive utilization of foreign capital will not change.To investigate and prosecute illegal enterprises makes it clear further to the world that the determination of the Chinese government to continue to make efforts to improve investment environment, so as to create a fair and equal opportunity for investors from all countries.Creating a fair competitive environment is an important part in optimizing China’s investment environment, and we hope it could be viewed from an objective and positive perspective.We believe that to investigate and prosecute illegal enterprises will be conductive to enhancing the confidence of multinational companies to invest in China, rather than the opposite.
