3、甲乙双方均不能以任何名义向参加海选的选手收取

任何费用，不能假借培训、保证海选通过、保证晋级等条件谋求选手财物；

4、乙方负责安排在山东广播电视台综艺频道相关段位播放本次活动预告片，预告内容明确写明赞助单位、海选地点、海选时间、报名电话。预告片播出时间为提前一周。

5、乙方需在活动开始前壹日到达甲方活动场地，明确告知甲方，乙方活动所需场景基础设施（海选场地布置平面图）及当天活动详细时间安排（海选及录制详细流程、软硬件基本物料需求）；在活动开始前叁日乙方需明确告知甲方本次活动评委姓名履历，乙方承诺参加活动的评委具有较高的知名度和社会影响力；乙方提供报名要求、活动宣传标识等方便甲方进行宣传。如因乙方原因造成活动无法如期举行，乙方需承担相应经济责任，对甲方做出赔偿；

6、乙方负责本次活动组织、选拔及节目录制工作；

7、海选活动现场背景板上需明确标明甲方单位的名称和LOGO；

8、活动期间，如因乙方原因导致的临时性调整，乙方需提前向甲方作出说明，并根据双方协商后的方案进行调整。

9、如遇不可抗力因素影响，乙方不能如期举行活动，乙方需在活动开始前15天告知甲方，并退还甲方首次付款，如因乙方未及时告知造成甲方的一切损失，均由乙方承担；

四、违约责任

1、在甲方按协议约定及时付款并配合好其它约定分配的工作前提下，乙方应按时按照要求完成活动，否则视为违约，应承担相应的违约责任；

2、若一方不能按合同约定按时完成各项工作的，应承担违约责任。自一方出现违约情形之日起，另一方有权每日按协议总价款的 5 ‰向乙方收取违约金，若违约方为甲

方，乙方有权直接在应付未付款中扣除，违约金不足以弥补乙方损失的，乙方可继续向甲方追偿。在一方违约的前提下，另一方有权解除本协议。

五、免责条款

由于不能预见、不能避免和不能克服的自然原因或社会原因，致使本协议不能履行或者不能完全履行时，遇到上述不可抗力事件的一方，应立即书面通知协议其他方，并应在不可抗力事件发生后十五天内，向协议其他方提供经不可抗力事件发生地区县级以上政府部门出具的证明合同不能履行或需要延期履行、部分履行的有效证明文件。由协议各方按事件对履行合同影响的程度协商决定是否解除协议、或者部分、全部免除履行协议的责任、或者延期履行协议。

六、法律适用

本协议的订立、效力、解释、履行和争议的解决均适用中华人民共和国法律法规。

七、争议的解决

凡因执行本协议所发生的或与本协议有关的一切争议，协议各方应通过友好协商解决；如果协商不能解决，任何一方均可向甲方所在地的人民法院起诉。

八、其他

1、本协议如有未尽事宜，经双方友好协商，可另行签订补充协议。补充协议与本协议具有同等法律效力。

2、本协议附件是本协议的组成部分，与本协议具有同等法律效力。
