环保部通报环境监测数据弄虚作假案例：多名责任人被拘

人民网北京6月12日电 据环境保护部网站消息，为贯彻落实新环保法，打击篡改、伪造监测数据弄虚作假的行为，环境保护部近期组织各地污染源自动监控管理部门加大对污染源自动监控设施运行管理情况的监督检查，对发现的数据弄虚作假等违法行为进行了严肃查处，通报了一批典型案例。

环境保护部环境监察局局长邹首民具体通报了这些案例的造假事实：

1、建滔（河北）焦化有限公司主营捣固焦、粗苯、焦油等产品，是邢台市重要化工企业之一。4月22日，邢台市环保局与市公安局环保支队混合编队，对该公司污染物排放情况进行了全面检查。检查发现，该公司部分高浓度焦化生产废水未经任何处理，直接用于熄焦，属典型的恶意偷排偷放。此外，该公司一期工程150t/h燃煤锅炉自动监控设备段二氧化硫值为35-90mg/m3之间，烟尘为45mg/m3，环保局现场手工监测二氧化硫值为166-172 mg/m3之间，烟尘为194 mg/m3；二期工程75t/h燃煤锅炉自动监控设备烟尘值为66 mg/m3，环保局现场手工监测二氧化硫值为烟尘为163 mg/m3，存在焦炉超标排放、燃煤锅炉在线监测数据造假、烟尘超标排放等问题。邢台市环保局依法作出处罚决定，对该公司处以145万元罚款并没收违法保证金100万元；因该公司肆意修改在线监控数据，其主管环保的经理张某某、仪表部经理胡某被依法行政拘留7日。

2、河南省环境监控中心通过调阅历史监控数据，发现信阳豫信轧钢实业有限公司焦炉烟囱二氧化硫自动监控数据长期稳定在20mg/m3。4月17日组织赴现场人工监测发现数据为100mg/m3-200mg/m3，检查前后自动监控数据差距较大。经调查证实，该企业擅自拔出部分二氧化硫测量探头，使采样孔漏气，稀释排放污染物，人为干扰采样装置、降低测量数据，造成监控数据失真。针对信阳豫信轧钢实业有限公司的违法行为，信阳市环保局依法对企业下达了处罚决定书，对企业存在的超标排放、干扰自动监控数据行为，分别给予6万元、3万元处罚，追缴2015年第一季度焦炉烟囱二氧化硫排污费，启动按日计罚程序。信阳市公安局对涉嫌违法的主管人员李某某和其他直接责任人王某某作出了行政拘留十日的行政处罚。

3、群众投诉中国水泥厂有限公司涉嫌排放废气超标、污染环境，但环保局监控平台上企业各项污染物排放指标全部达标。南京市环境监察支队到企业现场调查取证发现，该企业二号窑二氧化硫分析仪显示数据是210毫克/立方米，超标5%，但传至环保局的数据只有23.27毫克/立方米；氮氧化物分析仪数据是881毫克/立方，但上传环保局的是300毫克/立方米。检查人员打开监控设备发现，负责数据采样的分析仪和数据传输的工控机之间接入了几根导线，并连接该公司办公室，可随意篡改监测数据。近日，南京市环境监察支队对这家企业处以20万元行政罚款，并要求其补交排污费近260万元。同时，企业相关环保责任人杨某，因篡改、伪造监测数据，被处以行政拘留5天。

4、山东省环境监控中心近期多次通过数据审核发现，龙口矿业集团热电有限公司夜间烟气温度为87℃（湿法脱硫），白天为58℃，怀疑该企业夜间停运脱硫设施。3月18日，山东省环境监控中心对该公司开展独立调查。调查发现，该企业排放口SO2浓度数据为1915mg/m3,超标8.6倍，NOx浓度为301mg/m3,超标0.5倍。然而，该公司自动监测设备显示SO2浓度为100mg/m3，NOx为67mg/m3,与现场监测数据不一致，初步判断存在数据造假问题。检查人员对采样管路、工控机参数等进行排查，发现监测站房隔壁的房间内有矿泉水桶和氮气钢瓶，分别用于吸收和稀释采样烟气中的SO2和NOX，干扰了自动监测设备正常运行。据悉，这是新《环保法》实施以来首例利用两种方式进行数据造假的行为。3月19日，龙口市环保局对其就污染物超标排放和自动监测设备弄虚作假分别予以5万元和10万元的顶格罚款，并限产三个月。同时，龙口市公安局对涉案企业环保部主任王某行政拘留10天。5、3月5日，山东省环保厅执法人员在对安丘市盛源热电进行独立调查时，发现安装在2号烟囱的自动监测设备含氧量急剧下降，S02浓度也大幅降低，检查人员初步判断存在干扰采样问题，于是对采样管路进行排查，发现企业在两台自动监测设备采样管路上均接有氮气稀释装置，干扰了自动监测设备正常运行，导致监测数据降低。排除干扰后的监测显示，2号烟囱外排烟气S02浓度为1236mg/m3，超标5.2倍。潍坊市环保局对该企业实施了顶格处罚，责令限期达标排放。同时，公安部门对涉案企业环保部主任孙某拘留10天，对具体实施者郑某拘留5天。安丘市纪委给予企业法人和分管副总党内严重警告处分。

6、山东省监控中心通过数据审核，发现莱芜市汶源热电有限公司S02数据夜间明显低于白天，并且较长时间数据保持不变，怀疑存在弄虚作假行为。2月5日，省监控中心对该企业进行独立调查，发现在调查人员进厂后S02数据大幅升高，排放浓度为550mg/m3，超标1.75倍。调阅工控机参数记录，发现在调查人员进站房前一分钟，S02量程刚由300 mg/m3修改为正常值（1000 mg/m3），致使S02数据突变。进一步检查发现，在此之前有多次修改量程记录，企业通过设定量程上限，干扰了自动监测设备的正常运行。调查组现场责令企业立即改正监测参数，并要求限期清除自动监测设备造假功能；省环保厅按照对企业罚款5万，并要求在确保居民供暖的前提下最大限度降低生产负荷，确保达标排放。按环保厅、公安厅联勤联动工作机制，调查组现场向莱芜公安局移交了相关证据，公安机关对企业环保主任实施了行政拘留10天的处罚。

7、山东省环境监控中心在东营华泰化工集团有限公司现场检查时发现，该企业存在大气污染源自动监控设施数据造假问题，现场SO2自动监测分析仪排放浓度数据为66mg/m3，但人工监测数据为1180mg/m3，超标4.9倍，两者相差约18倍。检查组经调查取证后，现场向公安机关移交了相关调查证据。后经公安机关进一步调查，依法对该企业两名责任人实施治安行政拘留。
