一、案件

P市自1994年开始对本市出租车实行总量控制。2004年,P市居民A 向P市运管局申请出租车经营许可。运管局不予批准。理由是:依据“P市出租汽车管理条例”编制的“P市'十五'时期交通发展规划”(下称“交通规划”)规定,本市出租汽车实行总量控制。现出租汽车总量已达到控制目标,不再投放新的运力。因此,对从事出租汽车经营的申请不予批准。

A遂向P市××区人民法院提起行政诉讼,请求撤销运管局的上述决定。区法院认为:依据“中华人民共和国行政许可法”和“国务院对确需保留的行政审批项目设定行政许可的决定”(国务院令第412号)的规定,出租汽车经营资格属于应当获得行政许可的项目,该项目的审批属市运管局法定职责之一;P市出租汽车管理条例规定,市交通行政主管部门应当根据城市总体规划要求编制出租汽车发展规划和年度计划,据此编制的“交通规划”规定,“2005年出租汽车运营车辆控制在×万辆左右”;因此,市运管局认定本市出租汽车总量已达控制目标,作出不予批准的决定,具有法律和事实基础。据此,区法院判决驳回A的诉讼请求。A不服,上诉至P市中级人民法院。二审维持原判。

A案之后,P市居民B又向运管局申请出租车经营许可,运管局再次作出不予批准的决定。B随即也向P市××区法院提起行政诉讼。诉由是,P市对出租车行业的行政许可包括经营许

可、车辆许可和司机准驾许可三种,“交通规划”只规定了营运车辆的总量,没有限制经营许可的数量。因此,运管局以“交通规划”的车辆总量控制为由驳回B的申请是错误的。但是,××区法院并未实质性审理B的诉讼请求,而是指出,B所诉的具体行政行为已在A案的终审判决中有所评判,其诉讼标的受A案的生效判决羁束,不必再次审理,为保障法律的统一性、稳定性和权威性,裁定驳回起诉。B上诉,二审维持原裁定。

第十二条下列事项可以设定行政许可:

(二)有限自然资源开发利用、公共资源配置以及直接关系公共利益的特定行业的市场准入等,需要赋予特定权利的事项;

(三)提供公众服务并且直接关系公共利益的职业、行业,需要确定具备特殊信誉、特殊条件或者特殊技能等资格、资质的事项;

(四)直接关系公共安全、人身健康、生命财产安全的重要设备、设施、产品、物品,需要按照技术标准、技术规范,通过检验、检测、检疫等方式进行审定的事项;

(五)企业或者其他组织的设立等,需要确定主体资格的事项;

(六)法律、行政法规规定可以设定行政许可的其他事项。

第十三条本法第十二条所列事项,通过下列方式能够予以规范的,可以不设行政许可:

(一)公民、法人或者其他组织能够自主决定的;

(二)市场竞争机制能够有效调节的;

(三)行业组织或者中介机构能够自律管理的;

(四)行政机关采用事后监督等其他行政管理方式能够解决的。

P市出租汽车管理条例

第四条本市出租汽车行业的发展和管理应当遵循统一管理、协调发展、公平竞争、方便群众的原则。

第五条市交通行政主管部门应当根据本市总体规划的要求,编制本市出租汽车发展规划和年度发展计划,并报市人民政府批准后实施。

第二章经营资质管理

第八条出租汽车经营者应当具备下列条件:

(一)有经检验合格的并符合规定数量的车辆;

(二)有固定的经营场所和相应的车辆停放场地;

(三)有合格的驾驶员,经营旅游客运汽车的还应当有合格的乘务员;

(四)有相应的管理人员和管理制度。

第九条出租汽车驾驶员应当具备下列条件:

(一)有本市常住户口,男60岁、女50岁以下,身体健康,取得驾驶证3年以上。旅游客运汽车驾驶员还必须连续从事3年以上大、中型客车驾驶工作;

(二)遵守法律、法规;

(三)被吊销营运资格证件的,须期满5年以上;

(四)经市交通行政主管部门考核并取得合格证书。

第十条申请经营出租汽车的单位和个人应当按照下列规定办理申报审批手续:

(一)到工商行政管理机关办理名称预先核准登记。

(二)持有关证明向市交通行政主管部门提出书面申请,市交通行政主管部门自接到申请书之日起30天内作出审批决定。合格的,发给经营许可证件。

(三)持经营许可证件向工商行政管理机关申领营业执照,向税务机关办理税务登记,向公安机关办理治安登记。

(四)取得营业执照、办理税务和治安登记后,按规定对营运车辆进行车身装饰,安装安全防护装置、计价器,依法办理保险手续;营运车辆按规定检验合格后,到公安交通管理机关申领车辆牌证。从事旅游客运汽车经营的申请者还须向公安交通管理机关申请发车地点、行车路线等事项,经审查同意后,取得公安交通管理机关发给的旅游通行证。

(五)取得车辆牌证后,向市交通行政主管部门领取车辆营运证及驾驶员准驾证、乘务员服务证等营运资格证件和服务监督卡。从事旅游客运汽车经营的申请者向交通行政主管部门申领旅游准运证。

第十一条出租汽车经营者增加、减少或者更新车辆的,应当报市交通行政主管部门核准;变更办公地点和联系电话以及变更登记事项的,应当向市交通行政主管部门备案;停运或者歇业的,应当向市交通行政主管部门备案,并到工商行政管理机关办理有关手续。

经批准歇业或者减少营运车辆的,应当向交通行政主管部门缴销营运资格证件,并涂掉原营运车辆的车身装饰、拆除车内的营运设施。

第十二条出租汽车营运车辆应当符合下列要求:

(一)经公安、公安交通管理机关检验合格;

(二)符合本市规定的车型、车身颜色、车身装饰和使用年限;

(三)按照规定安装出租汽车标志灯、安全防护装置和计价器;

(四)按照规定在车辆前风挡玻璃右侧上方张贴营运证,在车内规定位置张贴车辆收费标准,并具有空车待租标志和停运标志;

(五)旅游客运汽车在车内规定位置放置旅游准运证、旅游通行证等营运证件;在车内明显位置张贴旅游客运说明;

(六)车辆整洁。

一、招生专业及招生规模

本院各专业均接收推荐免试生,接收名额原则上不超过招生计划的35%,详见下表:

1.培养目标

本院中国“法学硕士”、“法律硕士”旨在培养立足中国,放眼世界,胜任多种法律职业之法学通才。(1)透过中国政经体制和法律互动的大背景,学生能理解法律原理,通晓法律规则,驾驭法律解释,看到现有法律的合理性和局限性,进而预见法律变化。(2)出色的中、英文语言能力,包括:准确、优雅的写作风格,说理透彻的书面和口头表达。(3)能围绕某一法律问题而检索中、英文法律文献,包括:制定法、司法判决、学术著述;掌握文献征引和标示文献来源的规则。

本院课程具有以下特色:

(1)鉴于绝大部分学生为法律本科毕业生,相对于本科法学教育而言,全部课程都是高级法学课程,旨在“温故知新”,超越本科法学教育。

(2)本院必修课学分总数不超过选修课。开设选修课,至少要有10名学生申选,申选最高人数由学院斟情决定。

(3)在教学分工方面,中国教授讲授中国法;外国教授用英文讲授国际法、比较法、外国法、欧盟法。

(4)鉴于英语授课在本院占有实质比重,本院不再开设外语课程。

4.法学硕士/法律硕士学分要求总学分(最低学分): 课时学分46学分,学位论文4分,总计50学分。课时学分的构成为:必修课20学分,选修课24学分, 参与学术活动2学分。每一学分的教学工作量为18课时加3小时助教辅导、3小时接待学生的办公时间。

五、入学考试

1.入学考试分全国硕士研究生入学考试(“初试”)和复试。申请人须参加初试之英语考试。

2.初试日期及具体安排见中国研究生招生信息网相关公告,考试大纲见《中国政法大学2013年硕士研究生招生简章》

3.复试重点考察考生法律分析能力,由英语听力、法律分析和面试组成:

(1)英语听力:1小时。在英语国家或地区完成本科学习、托福100分以上(含100分)或雅思7分以上(含7分),可申请英文听力免试;申请免试须在报到时提交托福或雅思成绩单原件。

(2)法律分析(中文答卷):2小时,考试范围是围绕一个案例的相关法律问题;考生对案例进行分析,逐一回答问题。主要考察学生以下几方面的能力:①从个案中寻找法律争点;②运用法律原理解释具体法律现象;③从具体的法律现象中归纳法律原理;④论辩、质疑、答疑和构建论据的能力。

(3)面试(中、英文),重点考察考生的法律分析能力和语言表达能力,考生现场抽题。

学院根据考生的初试和复试总成绩决定录取名单。考生总成绩总分为100分,各科权重为:初试成绩50%;复试英语听力10%,法律分析25%,面试15%。

本院统一划定法学硕士各专业(参见本简章第一部分)录取线,不区分专业。如果某专业上线考生人数超过计划招生人数,在考生本人同意的前提下,报考该专业而总分排名靠后的考生可调剂到法学硕士的其他专业。

本院根据考生的初试和复试总成绩排名划定法律硕士(非法学)专业的录取线。

七、学费和奖学金

学费:人民币17,000元/学年。

本院根据学业成绩颁发奖学金。第一学年,本院按照入学考试总分排名颁发“入学奖学金”。2012-2013学年,本院用于110名2012级新生“入学奖学金”总额为892,000元,覆盖率为81%。第二学年初,本院按照学生第一学年成绩排名颁发“学业优秀奖学金”,学院另设有“公共服务奖”,表彰热心公共服务的学生。往年奖学金分配情况,请查看:

黄进校长、各位老师、各位同学,晚上好。

首先,我在此祝贺这些获得科研创新奖的同学,我想科研创新在一个大学里是非常崇高的一种荣誉,你们在这么小的年龄,在大学本科就获得这样崇高的荣誉,这确实是一件令人自豪的事,我在此对你们表示衷心的祝贺。

在这里,我想和大家来分享一点心得:就是什么是科研创新?在我们获得这个奖的时候,我们确实应该用一点时间来体悟科研创新的含义。科研创新实际上就是通过试验而不断发现真理和提升真理的过程。如果我们做一个简略但又不是过分简单化的概括,科研创新的整个过程就是试验、出错、纠错,永无穷尽,这就是哲学家卡尔波普所说的科学发现的过程。而科学创新和其他活动它们的区别在哪里,最大的区别是什么?科学创新是一种可以被证伪的活动,任何科学命题它都有不断发展的空间,都会面临质疑,都可能被限定,甚至有可能被颠覆。这就是科学可被证伪的含义。那么这也就是科学区别于本体论、形而上学、神学、占心术和弗洛伊德的精神分析这样一类活动的一个最大的差别。

我们谈到这个科学创新的话,科学创新它需要具备一些什么样的气质对我们同学来讲,我想第一,科学创新需要有丰富的想象力,这就是爱因斯坦所说的“想象有时比知识本身更为重要”。我们许多的成就都是由想象所启动的,如果我们没有丰富的想象力,我们不会有今天的互联网,不会有人类登上月球,不会有人类对火星的探测。想象它同时也就包含着一种批判的思维,这种批判的思维就是像马克思所说的“怀疑一切”,陈寅恪所说的“自由的思想,独立的精神”,这两者相通的地方都是一种超越前人的传承,是为了超越而传承,为了创新而守成,这就是批判。当然科学创新它更重要的一种气质就是实事求是,这样一种实事求是,它要我们不断地开发一种实践的智慧,在开发实践智慧的过程中,我们要不断地体悟到自身的局限性,体悟到我们能力的局限性,从而我们能够在意识到有限性的同时找到自己无限发展的空间,这就是一个实事求是。

最后我想我在这里还是要再次衷心地祝贺这些同学在政法大学取得这么崇高的一个荣誉,就是科学创新。我希望科学创新这样一种理念能够伴随你们走过整个人生,谢谢。

The ability of the courts to interpret the Constitution was decided early in the history of the United States,in the 1803 case of Marbury v.Madison.It is the power of the court to examine legislation and other acts of congress and to decide their constitutionality.Without judicial review the Constitution would be nothing but a piece of paper.The Constitution states that it is the supreme law of the land.There has to be an authority to decide whether a particular law is constitutional or unconstitutional.If not, then the legislative branch would be free to pass any law without regard to its constitutionality.Judicial authority has always included the power to interpret laws.The Constitution gives the Judicial branch power over all cases arising under the Constitution.The courts must be able to interpret both the Constitution and laws and to determine whether one prohibits the other.checks and balances 权力制衡

Motive and intent have completely different legal meanings.Ⅰ Motive is defined as the cause or reason that moves the will and induces action.It represents the stimulus for behavior.Intent relates to the state of mind at the time of the commission of the unlawful act.The motive may be regarded as the reason why a person commit a crime but does not necessarily represent an individual‘s mental design or resolve to actually commit the act.Ⅱ the state is not required to prove the defendant‘s motive for behavior and the failure on the part of the state to establish the why dose not necessarily mean the jury will vote for acquittal.And with the exception of strict liability offenses, failure to establish an unlawful intent must result in acquittal.Ⅲ the motive may help to establish a justifiable reason for the otherwise illegal behavior.For example, if one establishes that the motive for the killing was self-defense or an attempt to prevent the killer from killing another, an acquittal will result.And a good motive does not necessarily absolve the actor of criminal.动机和犯罪目的是完全不同的法律概念。

The tort of false imprisonment involves cases in which the plaintiff has allegedly been unlawfully confined by the defendant.For false imprisonment to be proven these elements must be present: 1.intent to confine a person within a certain area;2.actual confinement;3.awareness of plaintiff of the confinement or injury to plaintiff due to confinement;4.prevention of exit or no sale exit possible by plaintiff.Of course the elements as in all legal descriptions must be clarified.What, for example, is a legal exit or what constitutes confinement.所谓非法监禁侵权行为,是指在案件中,原告宣称曾被被告以非法手段监禁。要证明非法拘禁的侵权行为确实发生过,原告需证明一些要件:

Trespass, the most familiar of the property torts,prohibits the unauthorized entry of a person or thing onto the property of another.(1).Property interests are such that failure to remove something from the land can be considered a trespass;(2).Threspass can even be remaining on another‘s land after a privilege expires;(3).Causing another to enter plaintiff‘s land may also be held a trespass.非法侵入是最为人熟知的侵犯财产权的方式,指禁止人或物未经授权侵犯他人土地。(1).没有从别人的财产上除去妨害也是一种非法侵入。(2).非法侵入还可以发生在当限期届满时仍停留在他人领地上。(3).教唆他人进入原告的土地同样是非法侵入。

What is the basis for such tort? The right to exclusive possession of the land is the basis for this tort.对土地的排他财产权是这种侵权法的基础

How to prove it? A prima facie case of trespass must include an act, coupled with the intent to cause entry by the defendant, and an invasion of the plaintiff‘s land.In other words, the person must have intended to enter another‘s land.Damages are not required to be proven for intentional trespass.Only when the entry onto another‘s land is negligent is there any requirement for showing actual damages.一个被初步证明的非法入侵案件必须包括行为、被告人侵入的故意、以及对原告土地的侵入。换句话说,一个人必须有侵入他人土地的故意。

A contract is a promise between two or more persons involving the exchange of some goods or service.Some of the basic elements of a contract include: an offer and an acceptance;‘capacity,‘ or being of legal age and sound competence;‘ mutual assent,‘ or agreement on the terms of a contract;and ‗consideration‘ or compensation for goods or services rendered.The element that distinguishes a contract from an informal agreement is that it is legally binding: the law provides a remedy in the event that the promise is no fulfilled.By law, certain types of contracts must be writing, but oral contracts are valid in many situations.An oral contract may be held to exist even in the absence of agreement as to all its terms.The sources conclude: The Statute of Frauds,The Uniform Commercial Code(UCC),The Restatement of Contracts。

合同是两个或两个以上的人之间的涉及某些商品或服务的交易达成的协议。合同的基本要素包括:要约和承诺;“行为能力“,即达到法定年龄,或具有完全行为能力;“合意”,即对合同的条款达成一致意见;“对价”即对提供货品或服务支付对应的价款或利益。

Consideration is a party receives some kind of benefit in return for his promise, it may consist of money, goods, or a promise to do or not to do something.Consideration is one of statutory requirements to make a contract to be enforceable, or to be valid and legally binding.other requirements are: capacity, mutual assent.When the mutual assent of legally capable parties –which includes an offer and an acceptance, accompanied by consideration—to a specific exchange or set of promise occur, a valid contract has been formed.对价是指当事人一方在获得某种利益时,必须给付对方相应的代价。这种代价可能是支付金钱、商品,或者是承诺为或者不为某件事。在美国合同法中,合同是否具有对价要素影响合同的效力,对价是是合同具有法律约束力的法定要件之一,其他要件还包括:行为能力、合意。当具有法律行为能力的当事人双方达成合意:包括要约和承诺,伴随着对特定交易或者承诺形成的对价,一个有效的合同就形成了。
