甲乙双方本着平等，自愿的原则，签订本合同，双方同意并承诺共同遵守以下合同条款：

一，工作内容和合同期限job duties and contract period
1.甲方根据工作需要安排船员乙方轮 担任职务，合同期限为 个月，自上船之日起计算。合同期满，双方未办理合同终止或者续订手续的，视为本合同自动延续，任何一方都有权利通知对方终止合同。但合同届满时或延续期间，如船舶在国外或者航行中或者不方便离船的港口，则合同自动延续至船舶到达可离船的港口之日为止。A appoint BasonMV:The contract period is or renewal the contract when the contract expired, regard as the contract continue automatically, each side have the right to notice the other side to end the contract.but ,if when the contract expired, the ship or the crew or the port is inconvenient ,the contract can be continued until the convenient port.2乙方因伤，病并经医生证明，或者由于不可抗力原因，造成乙方不能继续在船工作的，合同自行终止。合同期内，如发生卖船，更换船东等，甲方可以提前终止合同，乙方的遣返费由甲方负担。Bcan not work on board due to injury or illness(should be proofed by doctor)or majeure force, the contract end automatically.A end the contract and offer B repatriation fee when exchange ship owner or sell the ship during the crew contract period.3.乙方在合同期内如遇配偶或者亲属举丧之事，在征得甲方同意后可以安排下船。乙方因为个人原因，无正当理由下船的，其下船的船差费，代理费等由乙方自负。由此造成甲方损失及更换船员费用增加的，乙方负责赔偿。B can get off when meet his relatives death and A agree to exchange crew during the contract period.but B get off the ship without reasonable excuse by himself ,B have to pay the agent fee and other payment.If this cause A economic loss, B should pay for the loss.二．工资福利待遇 salary and benefits
1.乙方在船工作期间，月工资标准是美元（包括基薪，固定加班费，养老保险，医疗保险，工伤保险，生育保险）。乙方按照甲方的规定领取外派工资和相关津贴，甲方按照国家规定的缴费基数即平均工资的三倍缴纳养老保险，医疗保险。失业保险，工伤保险，生育保险。如不满一个月，按照实际天数/当月天数*月工资计算，上下船工资结算时间为上船当日起至下船前一日止（以交接单日期为准）。B works onboard，the salary is

2.甲方根据乙方提供的详细汇款账号，每月以银行汇款方式于15日—20日之间结清上月工资，下船工资的结算时间为收到正常下船差费，交接清单后一并结清。A pay off last month salary during the 15th---20thof the month according to the detailed bank account number which B send to the company.when crew get off the ship ,the salary of departure should be pay off when receive the normal ship sent fee invoice and pass-on sheet
3.甲方提供乙方在船生活费为每日4.0美金。提供在船期间相应劳动保护补助及医疗补助。A offer B living cost 4.0USD one day on board，offer labor protection and medical subsidy
4.乙方正常上下船的费用由甲方承担，但乙方必须按照甲方的规定的标准执行，超出部分非特殊情况下甲方不予承担，未完成合同提前下船的差费乙方承担。A offer the normal ship sent fee for B according to the company regulation，if B don’t have reasonable excuse ,the beyond part should be paied by B himself.get off the ship before the ending of the contract ,Bpay all the bill.5.合同期内，甲方负责为乙方提供风险保障：如死亡，受伤，生病等情况，甲方根据P&I协会条款或者保险公司条款为乙方提供保障，但以下情况除外：A offer risk guarantee for death，injury，illness etc according to P&I association，but except：
（1）并非在船上是发生的受伤，死亡 injury or death not on board
（2）受伤或者患病是由于乙方的故意行为，违章，酗酒或者不正当举止所致 injury or illness caused by intentional action，peccancy intemperance or other incorrect action
（3）签订合同时故意隐瞒疾病等 hide the truth when sign the contract
6.乙方在工作期间享受甲方的各项奖励，自修费，劳务费等地分配。
B have the right to share the reward，self-maintenance fee，labor fee ect
三，双方的权利和义务both sides’ right and duty
1.乙方应保证身体健康，保证持有有效的主管机关签发的有效的船员服务薄，基本安全培训合格证，海员证，职务证书以及公约要求的其他技术证书。根据需要乙方应接受甲方的ISM 培训，遵守甲方的SMS 体系文件的规定。B should be ensure not only healthy and have valid crew service book，the basic safety training certificate，seamen’s certificate，post certificate and other technical certificate required by international conventions.B should receive the ISM training and obey the SMSregulations made by the company.2.甲方负责为乙方办理外籍证书及出境手续，正常情况下所发生的费用由乙方自负，在船工作满个月之后所发生的费用，酌情报销。Aarrange the foreign certificate and exit formalities for B，B pay all the bill，can apply for some refund
3.根据配员要求，乙方需要值班的，船长要求必须会操作使用船上的通导设备。
If discharge required，B should can operate the communication equipments on board
4.乙方在合同期内，应忠于职守，遵纪守法，尽职尽责，如有下列行为者，甲方有权终止合同，乙方除自行承担后果外，对甲方造成的损失应负赔偿责任，甲方亦有权根据乙方行为后果的严重程度给予相应的经济处罚：B should be on duty and responsible for his act onboard，if B do the following action，A have rights to end the contract at once and ask for compensation，and have rights to punish B with economic methods
（1）乙方工作失职，给船舶安全性或者正常航行造成危险或者损失的 B neglect his duty cause danger or loss
（2）乙方不遵守甲方的管理制度或者不服从公司管理的B break company rules or management regulations
（3）乙方漏船或者擅自离船的 Bget off the ship without permission
（4）乙方参与盗窃，走私，偷渡，贩毒，色情等活动的 B join the following act ：steal Smuggle，stowaway，drug trade，eroticism ect
（5）乙方不遵守所在港国家法令等被追究地方责任给甲方造成损失的B break port station rules，is punished by the state，caused problems or loss
（6）乙方私自与ITF 及其他国际公会组织接触的B contact with ITF or other international associations privately
（7）其他严重违法违纪情形other seriousillegal acts
四，违约责任 defaultresponsibilities

Party A shall pay salary to Party B before the 8th day of every month in the form of cash or bank-transfer.If the8th day of the month falls in the weekend or holiday, the payment shall be brought forward to the nearest weekday.Party A shall inform Party B and explain the detailed reason within 5 work days in case Party A fails to pay thesalary due to special reasons.3.3 甲方可根据生产经营的状况或乙方任务量和工作表现，适时调整乙方的报酬。
Party A can adjust Party B’s salary according to its operating conditions, Party B’s workload and performance.3.4 当乙方的工作任务发生变化时，甲方可按规定调整其相应的报酬。乙方接受新的工作任务后，即视作接受甲方按照该工作任务重新确定的报酬。
Party B’s labor remuneration will be adjusted in case Party A adjusts Party B’s job responsibilities.Accepting thenew position is regarded as accepting the adjusted salary.3.5 乙方应遵守国家及地方的税法制度，自行缴纳其个人收入的个人所得税，甲方无义务为其代缴。
Party B shall pay personal income tax voluntarily according to the state’s tax law.Party A doesn’t shoulder theresponsibility to withhold and remit taxes for Party B.3.6 乙方在合同期内享受中国法律规定的节日，公休假日，另外公司每年为其提供5 天的带薪休假。
Party B is entitled with all legal holidays in accordance with the state’s regulations, In addition, Party B enjoys apaid leave of 5 days each year.四、雇佣合同的解除和终止
ⅣContract Cancellation and Termination 4.1 合同期满双方不再续签或者双方约定的合同终止条件出现时，雇佣合同即终止。This contract shall be terminated once it expires and both parties do not extend the contract.4.2 经合同双方当事人协商一致，本合同可以解除。
The contract may be canceled based on both parties’ mutual negotiation.4.3 乙方应遵守中国政府的法律、法规及有关规定，乙方如违反上述规定，甲方有权即时解除合同；乙方因健康原因，经医生证明连续病休15 工作日后仍不能继续工作，甲方有权提前终止合同。
Party B should abide by China laws, decrees and related regulations and Party A’s working systems.During theduration, Party A is entitled to cancel the contract in case Party B violates China laws and decrees, and terminatethe contract before expiration in case Party B cannot resume his or her work for health reasons after the medicalcertification of continuous sick rest for 15 working days.4.4 乙方因归国或其他私人原因未正常出勤且超过十天且未向甲方做出书面说明的，本合同自动终止。
The contract will automatically terminate in case Party B is absent for over 10 days without written explanation due to homecoming or other private reasons.4.5 乙方被证明无法完成本合同项下的工作任务，甲方有权随时解除本合同。
In case Party B is proved to be not competent for the work under the contract, Party A is entitled to cancel thecontract at any time.4.6 乙方应严格遵守甲方的工作规定以及规章制度，尽职尽责，否则，甲方有权随时解除合同并追究因此而造成的经济损失，并有权对所造成的经济损失在乙方的报酬中作相应扣除。Party B should abide by Party A’s working systems, rules and regulations.Otherwise, Party A is entitled to cancelthe contract and claim a corresponding compensation of any economic loss from Party B’s payment.4.7 乙方有权提前30 日以书面形式通知甲方解除本合同，在试用期内提前3 日通知甲方即可解除。
Party B should inform Party A in written form 30 days in advance for canceling the contract, and 3 days inadvance during the probation period.五、其他事项 ⅤOthers 5.1 其他未尽事宜，双方可参照甲方公司内部的相关规章制度执行。
Other items not stipulated by the two parties can be implemented according to the internal rules and regulations ofParty A.5.2 甲乙双方均应遵守本合同之约定，任何一方违约，非违约方均有权要求违约方承担相应的损失。

First party could carry out rescission of compact in any of the following circumstances, however, should notice second party by written form 10 days early.⑴ 患病或者非因工负伤，医疗期满后，不能从事原工作也不能从事由甲方另行安排的工作的;In the case of fall ill or wound in line of duty, when the medical treatment expires, if not be able to participate former work or other appointed work from first party;
⑵ 不能胜任工作，经过培训或调岗，仍不能胜任工作的;

⑹ 结党营私、破坏员工关系，生活作风不端正的;Form cliques, wreck relationships Between employees, bad lifestyle(immoral love).⑺ 违法行为或不良社会行为而给甲方形象造成巨大伤害的;unlawful act or bad behavior which diminish the reputation of Talent.⑻ 有赌博、吸毒等不良行为的;gamble、drug taking or other bad behavior
⑼ 被依法追究刑事责任或违法被处罚的;Being undertaken for criminal responsibility or punished for breaking the law.⑽ 严重违反公司的劳动纪律、规章制度的;法律规定或双方约定的其它情形。

Party A can adjust Party B’s salary according to its operating conditions, Party B’s workload and performance.3.4 当乙方的工作任务发生变化时，甲方可按规定调整其相应的报酬。乙方接受新的工作任务后，即视作接受甲方按照该工作任务重新确定的报酬。

3.5 乙方应遵守国家及地方的税法制度，自行缴纳其个人收入的个人所得税，甲方无义务为其代缴。
Party B shall pay personal income tax voluntarily according to the state’s tax law.Party A doesn’t shoulder the responsibility to withhold and remit taxes for Party B.3.6 乙方在合同期内享受中国法律规定的节日，公休假日，另外公司每年为其提供5天的带薪休假。
Party B is entitled with all legal holidays in accordance with the state’s regulations, In addition, Party B enjoys a paid leave of 5 days each year.四、雇佣合同的解除和终止
Ⅳ Contract Cancellation and Termination
4.1 合同期满双方不再续签或者双方约定的合同终止条件出现时，雇佣合同即终止。
This contract shall be terminated once it expires and both parties do not extend the contract.4.2 经合同双方当事人协商一致，本合同可以解除。
The contract may be canceled based on both parties’ mutual negotiation.4.3 乙方应遵守中国政府的法律、法规及有关规定，乙方如违反上述规定，甲方有权即时解除合同；乙方因健康原因，经医生证明连续病休15工作日后仍不能继续工作，甲方有权提前终止合同。
Party B should abide by China laws, decrees and related regulations and Party A’s working systems.During the duration, Party A is entitled to cancel the contract in case Party B violates China laws and decrees, and terminate the contract before expiration in case Party B cannot resume his or her work for health reasons after the medical certification of continuous sick rest for 15 working days.4.4 乙方因归国或其他私人原因未正常出勤且超过十天且未向甲方做出书面说明的，本合同自动终止。The contract will automatically terminate in case Party B is absent for over 10 days without written explanation due to homecoming or other private reasons.4.5 乙方被证明无法完成本合同项下的工作任务，甲方有权随时解除本合同。
In case Party B is proved to be not competent for the work under the contract, Party A is entitled to cancel the contract at any time.4.6 乙方应严格遵守甲方的工作规定以及规章制度，尽职尽责，否则，甲方有权随时解除合同并追究因此而造成的经济损失，并有权对所造成的经济损失在乙方的报酬中作相应扣除。
Party B should abide by Party A’s working systems, rules and regulations.Otherwise, Party A is entitled to cancel the contract and claim a corresponding compensation of any economic loss from Party B’s payment.4.7 乙方有权提前30 日以书面形式通知甲方解除本合同，在试用期内提前3日通知甲方即可解除。

Ⅴ Others
5.1 其他未尽事宜，双方可参照甲方公司内部的相关规章制度执行。

四、雇佣合同的解除和终止

Ⅴspecial compact
5.1由于乙方为兼职人员，故甲方不需为乙方缴纳社会保险。
PartyB is part-time Job, no need to pay social insurance for.5.2乙方因病或非因工负伤医疗费用自行解决，医疗期内甲方不支付报酬。
PartyB get sick or get wounded not in the line of duty, second party should pay himself.5.3双方解除、终止本协议，甲方无需支付乙方任何经济补偿。
If compact was determined by two parties, partyA does not have to pay second party compensation.六、其他事项
Ⅵ Others
6.1 其他未尽事宜，双方可参照甲方公司内部的相关规章制度执行。
