房 屋 买 卖 居 间 协 议
售方:(简称甲方)身份证号;
卖方:(简称乙方)身份证号;
居间房:南京利众房屋销售有限公司(简称丙方)
第一条:依据国家有关法律、法规和本市有关规定,三方在自愿、平等和协商一致的基础上,就居间方接受委托人甲、乙的委托,促成委托人甲、乙订立房屋买卖合同,并完成其他委托的服务事项达成一致,甲、乙、丙在合法、平等、自愿、相互信任的基础上签订本协议。
第二条:房屋基本情况
1、甲方自愿将坐落在区街(巷)号栋层的房屋(以下简称“该房屋”)出售给乙方。乙方对该房屋已做充分了解并实地看房,对该房屋现状无异,愿意购买该房屋。

第四条:中介费支付
由方支付丙方服务费元,方支付中介服务费元,于签定本合同时一次性付清。
第五条:房款付款约定(本条各款项均不计利息)
乙方向甲方的付款约定:

第六条:相关事宜
1、甲方承诺年月日前腾空该房屋,并将该房屋钥匙交给乙方。甲乙双方自行办理该房屋所发生的水、电、煤气、有线电视、物业管理及户口迁移等过户手续及相关费用的交接事宜。
2、甲方保证该房屋权属无争议。如有共有权人,甲方保证出售该房已取得其他共有人的同意并附相关证明材料。
3、乙方需要贷款,乙方需承担办理贷款的相关费用。
4、丙方协助甲乙双方办理房屋产权过户手续。
5、丙方应认真履行甲、乙方委托的事项,并完成甲、乙方委托代办的各项服务。
6、根据专业知识及工作经验,丙方将所了解的标的情况如实告知甲乙双方,及将委托事项办理的进展情况向甲乙双方通报。
7、丙方对甲乙双方个人资料予以保密,未经甲乙双方同意,不得向他人泄露。
第七条:违约责任
1、甲方须保证该房屋权属无争议,若发生与甲方有关的权属纠纷或债务纠纷,由甲方负责解决并承担一切后果及违约责任。
2、甲、乙双方须保证该房屋结构无拆改或拆改得到相关部门的同意及持有合法、有效证件,若因此影响办理过户手续,产生的一切后果及违约责任由责任方负责。
3、甲方认可乙方贷款方式付款时:
(1)贷款过程中,乙方提出终止贷款行为,则乙方须补齐所差房款,继续履行该合同,并承担由此而引起的经济损失。
(2)乙方须保证所提供的各种材料与证明的真实、可靠。如因证明不属实或其资信度不够等个人原因造成的贷款未果,乙方承担相应责任及经济损失。
(3)乙方须按照约定及时办理贷款手续,否则贷款延期责任由乙方承担。
4、如甲、乙任何一方拒绝履行合同或解除合同,或发生本条第1、2、3款违约责任,均由违约方向守约方支付相当于合同第二条确定的房屋实际成交价的%数额的违约金,用于支付守约方所发生的律师费、交通费等等。同时,违约方应向丙方支付总房价%的中介服务费。
5、如甲、乙双方任何一方未按照合同约定时间履行义务,每逾期一日,按总房价的万分之五承担责任。
6、如甲方逾期迁出户口,每日赔偿乙方元。
7、因居间方过错或违约,致买卖双方未能签订 《房屋买卖合同》,居间方应向买卖双方双倍返还已经收取的相关费用。造成买卖双方损失的,应承担赔偿责任。
第八条:不可抗力:甲、乙、丙方的任何一方由于不可抗力的原因不能履行合同时,应及时向对方通报不能履行或不能完全履行的理由,以减轻可能给对方造成的损失,在取得有关机构证明以后,允许延期履行、部分履行或者不履行合同,并根据情况可部分或全部免予承担违约责任。但当事人迟延履行后发生不可抗力的,不能免除责任。

1、本协议在执行中若发生争议,甲、乙、丙三方应协商解决。协商不成,任何一方可向该房屋所在地人民法院提起诉讼。
2、本协议经甲、乙、丙三方签字盖章后生效,一式三份,一份三页,甲、乙、丙三方各执一份。该项交易各种手续交接清楚、完毕,本协议自动终止。

第二篇:房屋买卖居间协议
房屋买卖居间合同
卖方(以下简称甲方):___________________________ 买房(以下简称乙方):___________________________ 居间方(以下简称丙方):___________________________

Charges or expenses related to the fixtures and ancillary equipments & facilities of this real estate, as well as the prices of home appliances and furniture agreed by the Parties, have been included in the transfer price and Party A guarantee that all such ancillary equipments & facilities may work properly, all interior decorations thereof satisfy the conditions provided herein and the sewage is free-flowing.6)
户口迁移:若在该房屋地址上有户口登记的,且无论该户口是否与甲方关联,甲方应于 □ 办理该房地产过户手续之日前;

Trade Tax.Party A and Party B expressly agree that any and all trade taxes arising out of or in connection with this transaction shall be declared and paid by each other respectively in accordance with the applicable state rules and values of this real estate evaluated by tax authority, neither Party may refuse to perform any of its obligations under this contract or sales contract by virtue of any adjustment of trade tax by state government or tax authority.双方同意,交易中所涉及的上述买卖双方的税费由

买卖合同示范合同订立:
甲乙双方确认签署本协议已确立买卖法律关系。为办理该房屋过户之需,双方约定,于______年_____月_____日前按协议约定的【买卖交易细则】至上海市_______区_______路______弄_____号______室(上海XX房地产经纪有限公司所属签约场所)处签署《上海市房地产买卖合同》的示范合同,该示范合同的的订立只是以格式合同的形式对甲乙双方买卖关系的进一步的确认。

四、法律责任的选择适用.APPLICATION OF LEGAL LIABILITIES

买卖交易细则中各条款未能如约全面履行的法律责任 Legal Liabilities for Non-Performance of Any Clause of [Sales Rules]
□将款项定性为定金的法律责任:本协议项下定金作为甲乙双方履行本协议的担保,若甲乙双方中若有任何一方未按照本协议中的约定及时全面履行自己的义务,守约方有权根据定金罚则要求违约方承担违约责任。同时,乙方可以丧失定金为代价而解除本协议,甲方可以以双倍返还定金为代价而解除本协议。
Deposit Clause.As deposit provided herein is the guarantee for the performance of obligations hereunder by Party A and Party B, if either Party A or Party B fails to perform its obligations hereunder fully or timely, the other Party may require indemnification form such breaching party in accordance with Deposit Rules.Party B may terminate this Contract at the cost of forfeiture of deposit provided by it, where Party A may terminate this Contract at the cost of payment as two times of deposit provided by Party B.□将款项定性为房款的法律责任:甲乙双方中若有任何一方未按照本协议中的约定及时全面履行自己的义务,则每逾期一日,违约方应按本协议约定总房款的万分之三向守约方支付违约金,直至违约方实际履行之日止;逾期超过15日的,守约方有权选择单方面解除本协议,若守约方选择单方面解除本协议,则违约方应按本协议约定的总房款的20%向守约方支付违约金。
*该条款是基于本协议条款二【转让总价及款项的选择适用】中对于定金和房款的选择而对应产生的约束力,甲乙双方确认在进行条款二的区分选择时,居间方已经给予明确的提示,并且已经按照甲乙双方的要求进行了翔实的解释和说明。甲乙双方确认并愿意接受本条法律责任的约束。

[第七条] 甲方责任:
一、甲方须保证该房屋权属为其所有且无任何权属争议,该房屋的权属证书应当齐全。甲方应在签订《买卖合同》当天将该房屋有关资料交给丙方作为办理交易过户手续之用。
二、甲方保证乙方所购上述房屋产权清晰、不存在任何产权纠纷,确保乙方所购上述房屋在交易过程中该房屋共有权人或共同居住人同意出售该房屋并对本《房屋买卖居间合同》予以认可,否则甲方则应承担相应的违约责任。
三、甲方在办理过户手续之前,必须将租赁户腾退。
四、甲方保证该房屋不存在抵押等其他权属瑕疵,否则应承担相应的违约责任。
五、甲方需积极配合乙方及丙方办理全程过户手续,如因故不能前往需在两日内通知丙方,否则因甲方原因延误过户期限视甲方违约,并向乙方承担违约责任,赔偿损失。
[第八条] 乙方责任:
一、乙方保证在交易过程中应支付给甲方的款项按以上规定期限支付,若到期未支付,视乙方违约,并向甲方承担违约责任。
二、乙方需积极配合甲方及丙方办理全程过户手续,如因故不能前往需在两日内通知丙方,否则因乙方原因延误过户期限视乙方违约,并向甲方承担违约责任,赔偿损失。
[第九条] 丙方责任:
一、见证本合同并保管其中一份;
二、代办相关过户及房屋交验手续等;
三、对该房屋交易全过程有见证及协调的义务;
四、在签订《买卖合同》前丙方有义务向甲乙双方告知国家相关部门所执行政策、制度及税费标准,如在房屋交易过程中以上标准有变化,合同各方均有义务按照最新标准来执行合同,不得以此为理由拒绝或延误执行《买卖合同》。
[第十条] 违约责任:
一、自乙方向甲方交付定金之日起,甲方不得将上述房屋出售予第三方,否则甲方应向乙方双倍返还定金。
三、如果由于所售房产的权属纠纷而导致该房屋交易无法进行,则甲方应向乙方双倍返还定金。
四、本合同签定之日起,在甲方未发生违约的前提下,乙方因任何原因提出终止本合同,均视为乙方违约,则甲方收取的定金不予退还,丙方已收取的居间服务佣金不予退还。
五、若因甲、乙任意一方违约而导致《买卖合同》无法履行,违约方仍应向丙方支付本合同第四条所规定的佣金及交易过程中实际发生的费用,同时,守约方应支付的各项费用也由违约方支付,上述费用违约方应在接到丙方书面通知后三个工作日内付清。
[第十一条] 免责条件:
因自然灾害、政府重大政策调整等不可抗力而导致本合同无法履行,本合同三方均不承担违约责任。但甲方应退还乙方已支付的定金及房款。
[第十二条] 争议的解决方式:
本合同履行过程中如产生争议,三方应协商解决;协商不成的,三方均可向该房屋所在地的人民法院提起诉讼。
[第十三条] 生效及其他:
一、甲、乙双方就《买卖合同》条款的未尽事宜,可协商签订《补充协议》,《补充协议》为《买卖合同》的附件,具有同等法律效力。甲、乙双方自行协商的条款,丙方仅负责见证(三
方另有约定的除外)。
二、房地产交易部门、房地产开发部门、银行、政府相关部门对外承诺的工作日和丙方无关,丙方只是负责按照以上部门的有关规定协助甲、乙双方办理相关手续。

甲乙双方共同委托丙方提供居间服务,买卖位于哈尔滨市区街/(路)号小区(栋)单元层号的私产(公产)房屋(门市房),现甲乙双方在自愿、平等和协商一致的基础上,订立本合同,以资共同遵守:
一、买卖条款

三、定金及违约责任

3、本合同签订后,如因甲乙双方中的一方违约,致使本交易无法进行则按下列约定办理;
a、如甲方违约,提出不卖,提高价格或不提供过户所须证件、材料及不协助办理过户手续等行为造成本合同无法履行的,应双倍返还乙方支付的定金,并向丙方支付与乙方应付佣金及信息咨询费等额的违约金。
b、如乙方违约,提出不买,不提供过户所须证件、材料及不协助办理过户手续等行为造成本合同无法履行的,乙方无权收回定金,丙方代收的定金扣除丙方佣金及信息咨询费后交于甲方。
4、丙方不对房产质量进行担保。
四、甲方权利义务
1、甲方保证房屋情况真实,无产权、债权纠纷,现未被查封且不在动迁范围之内,可以转让;甲方配偶及其他权利人同意转让该房屋,且不得隐瞒婚姻状况。甲方提供房屋产权情况不真实或实际格局与产权证格局不符,所产生的后果,由甲方负责。
2、该房屋现正出租□,租赁期至年月日。甲方保证承租人按期交房并已经放弃优先购买权。
3、甲方应配合乙方、丙方办理相关手续,在乙方全款或首付款到位后,甲方在七日内拒不到场办理相关交易手续的,乙方有权要求甲方按每日承担总房款2‰的违约金。并赔偿由此给乙方和丙方造成的损失。逾期15日,视同甲方提出不卖,甲方承担其相应的违约责任。
4、房屋交接前发生的(1)水(2)电(3)煤气(4)有线电视、数字电视(5)电话(6)包烧、物业管理费、房费(包括由于欠费而产生的滞纳金)等费用由甲方结算。如果不能及时缴清有关欠费,甲方愿意在取得全额房款同时,将与欠费相等的保证金存放于丙方处,待甲方将欠费激清后凭激费发票取回保证金,若无法缴清欠费,甲方将以保证金冲抵欠费并授权丙方将保证金转付乙方(保证金不足冲抵欠费的部分,由甲方按实补足金额)。
5、甲方产权取得为(1)交易□(2)赠予□(3)继承□(4)初始登记□(5)其他所得□
注明:如因赠予或继承所得产生的税费由甲方承担。
6、甲方应保证屋内装修、固定设施与看房时状况一致,完好无损。保证赠送物品没有缺失,如有毁损或缺失,应由甲方承担相应赔付责任。
7、双方交易确认,甲方得到全部房款同时,交接房屋,每逾期一日,甲方应向乙方支付总房款2‰的违约金。注明:甲乙双方不通过丙方而自行交付房款、自行办理房产交易手续、自行办理房屋交接,出现任何纠纷与丙方无关,由甲乙双方自行负责,丙方不负任何法律责任。
五、乙方权利义务
1、乙方保证其向丙方出具的办理房屋权属过户及申请贷款所需的相关文件资料真实、合法、有效。
2、乙方应按照合同约定的日期和数额交付房款,同时提交过户所需的相关资料。如乙方在七日内拒不到场办理相关交易手续,应按日承担总房款2‰的违约金。并赔偿由此给甲方和丙方造成的损失。逾期超过15日,视同乙方不买,乙方承担相应的违约责任,甲方有权解除合同并追究其违约责任。
3、甲乙双方选择贷款交易,因乙方自身原因不能履行贷款交易,乙方需按现金交易方式执行。否则视同乙方违约,由乙方承担相应的违约责任。
六、丙方权利义务
1、在公平、公正、公开的原则下,为甲、乙双方提供房地产居间服务。
2、丙方带领双方到房产交易所,正式受理之日起,个工作日内将过户及贷款手续办理完毕。如因丙方原因逾期一日,丙方需赔偿甲乙双方房款万分之一的违约金。若因相关办理部门原因或甲乙双方原因影响办件进程,办件时间自动向后顺延,若因甲方或乙方不配合而导致手续延迟与丙方无关。
3、如甲乙双方有违约行为,丙方有义务协助无错方追究过错方的违约责任。
4、丙方有义务进行纳税指导。
七、费用责任
1、本次交易是否办理委托公证由双方协商,如需公证,费用由
2、办理交易需交纳税费以实际发生额为准。如房产交易未终结前,政府另行征收其他税费按政府规定执行或甲乙双方协商解决。
八、如有争议至诉讼时,甲乙双方可到本房产所在地法院起诉。本合同未尽事宜,在补充协议中另行约定,补充协议具有同等法律效力。此合同对其配偶、财产共有人和法定受益人及代理人具有同等约束力。
九、本合同一式三份,甲乙丙三方各持一份,签字盖章之日起生效。有效期至房屋交接完毕自动作废。
