随着经贸交流的日益频繁，全国涉及外籍当事人的知识产权纠纷案件数量由2013年的2 840件上升至2015年的5 675件。

该数据由最高人民法院民事审判第三庭

(知识产权审判庭)庭长宋晓明披露。

在4月26日世界知识产权日前一天，宋晓明在接受《中国日报》专访时说道：“涉外知识产权案件是知识产权审判庭的重要领域，尤其是行政案件。”

根据最高人民法院提供的数据，2013年中国法院审理涉外知识产权行政案件1 143件，2015年上升至4 383件。在这些诉讼案件中，众多政府机构，如各级著作行权管理部门，通常被指控官方裁定不当。

宋晓明称，涉外知识产权行政案件大多与专利及商标有关。他还表示，近年来涉及商业秘密案件数量迅速上升。

知识产权审判庭近期审理知识产权案件5 432件，来自第三方知识产权机构ip house报道分析了其中的5 022件，并发现高达1 095起案件牵涉外籍当事人。

该机构表示，美国企业位列涉外案件榜首，牵涉395件案子，超出位列其次的德国企业

2.7倍。

在涉及美国公司的案子中，有346件是与商标、专利等项目相关的行政知识产权案件。

宋晓明说：“知识产权纠纷激增应归因于中国的‘走出去’和‘引进来’战略以及外国企业，尤其是美国企业维护自身在华知识产权的强烈意识。

他表示，许多美国企业向中国知识产权局申请专利及商标，因此产生了大量涉美知识产权纠纷。

北京知识产权法院副院长陈锦川称，美国在华创新投资巨大，也最勤于申请专利保护。

宋晓明认为，越来越多的中国企业将业务拓展到海外，他们也应该多注意保护自身在相应海外国家的知识产权。

目前极少中国企业在海外申请专利或商标保护，他还不说道：“既然中国不断呼吁发展高端、精密及高端技术，相应的发明创新就应在国内外都受到保护。”

(知识产权审判庭)副庭长毛明强称，涉外知识产权纠纷增多其实未必是件坏事。

毛明强说：“部分中国企业从此类诉讼中受教良多，或者在事后与外籍当事人握手言和，开展进一步合作。”

根据有关法律的规定，专利侵权行为人应当承担的法律责任包括民事责任、行政责任与刑事责任。

一、行政责任

对专利侵权行为，管理专利工作的部门有权责令侵权行为人停止侵权行为、责令改正、罚款等，管理专利工作的部门应当事人的请求，还可以就侵犯专利权的赔偿数额进行调解。

二、民事责任

1、停止侵权，是指专利侵权行为人应当根据管理专利工作的部门的处理决定或者人民法院的裁判，立即停止正在实施的专利侵权行为。

2、赔偿损失。

侵犯专利权的赔偿数额，按照专利权人因被侵权所受到的损失或者侵权人获得的利益确定;被侵权人所受到的损失或侵权人获得的利益难以确定的，可以参照该专利许可使用费的倍数合理确定。

3、消除影响。

侵权行为人就应当采用适当的方式承担消除影响的法律责任，承认自己的侵权行为，以达到消除对专利产品造成的不良影响。

三、刑事责任

依照和的规定，假冒他人专利，情节严重的，应对直接责任人员追究刑事责任。

苹果因Siri专利纠纷起诉中国国家知识产权局

IPRdaily消息，网易科技讯 2月25日据国外媒体报道，苹果因Siri的专利纠纷对中国国家知识产权局和一家上海的公司提起诉讼。

中国国家知识产权局因为没有撤销一家中国公司的语音软件专利，而遭到苹果的诉讼。目前，这家上海的智臻网络科技公司（音译）正在开发类似苹果Siri的软件。

苹果此前要求中国国家知识产权局宣布智臻网络科技公司拥有的语音识别专利无效，但中国国家知识产权局对此表示拒绝。中级人民法院将在周四听取苹果对案件的阐述。

苹果和智臻网络科技公司之间的争端已经持续了一段时间。苹果公司去年起诉智臻网络科技公司，指责其2004年窃取自己的Siri软件专利，开发类似的软件。该申诉的听证会去年七月举行，但没有任何裁决。

法新社针对诉讼向苹果寻求相关的信息，但苹果公司拒绝回应。（秉翰）
