严打“酒后驾驶”，势不容缓

2011年5月9日晚22时许，著名音乐人高晓松因酒后驾车发生追尾事故，造成四车连撞，警方的血检结果显示，其血液中酒精含量已达醉驾标准三倍，后被判拘役6个月并处罚金4000元。

近几年，因酒后驾驶发生的惨案屡见不鲜，场面更是触目惊心，非常严重地危害了社会公共安全和群众生命财产安全。酒后驾驶是危险的。2008年世界卫生组织的事故调查显示，大约50%—60%的交通事故与酒后驾驶有关，酒后驾驶已经被列为车祸致死的主要原因。在中国，每年由于酒后驾驶引发的交通事故达数万起，造成死亡的事故中50%以上都与酒后驾驶有关，酒后驾驶已经成为交通事故的第一大“杀手”。势不容缓，酒后驾驶必须要严禁，必须要严打。

为什么说酒后驾驶危险，要严禁严打呢？从生理学角度分析来看，有以下几点：

一、酒后驾驶，人的手和脚的触觉会比平常降低，敏感度减弱，这导致无法正常控制油门、刹车以及方向盘的转控方向，事故往往出其不意发生；

二、视觉容易产生模糊，观察不易集中，甚至对颜色辨别也会有所下降，把红灯看成绿灯，造成事故发生；

三、饮酒后，因酒精麻醉作用，人容易产生疲劳，尤其是午后和晚上，特别会产生困意，一不留神，事故不可避免，后果不堪设想；

四、饮酒后人的情绪是很亢奋的，不听任何劝说，高估自己的驾驶技术，对自己的能力充分自信，麻痹大意，也容易引发交通事故。有数据显示，40%的酒后驾车者“过高地相信自己的驾驶技术”，他们多认为自己酒量大，开车技术过硬，喝些酒不算什么，甚至想酒后驾车来“炫耀”自己的技术，结果险象环生。

种种原因表明，酒后驾驶是非常危险的。任何情况下，我们都不能抱着侥幸、大意、轻视、随便的心态驾驶，否则害人害己。

道理很明显，可是为什么还有些人拿自己和他人的生命安全开玩笑呢？我想原因主要有一下几点：

一、驾驶人对交通安全意识和法制观念仍然淡薄。调查显示，40%的酒后驾车生还者自我反省交代“安全意识不强”；

二、某些人利用自身的社会地位和关系网“走后门”。如果被抓到了，就叫人去“摆平”，若无其事，自我得意； 三、一些有钱人认为家里有钱，就算被罚款扣车也不怕，心想反正我家的钱多的是，完全不在乎被罚；

四、依旧有部分人喝酒前就抱定自己的酒量大，驾车技术好，经验老到，不可能出事，也不会被警 抓到，无所谓；

五、也有些人对酒后驾驶的理解模糊不清，甚至主观以为喝酒休息一小时两小时，或者喝点茶冲淡就测不到酒精度数了。

六、酒后驾车大多是在晚上发生。有些人愚蠢地认为执勤警察都下班了，不会那么容易被查被罚。

这些原因都成为了酒后驾驶屡见不鲜，屡禁不止的“背景”。酒后驾驶能不严打吗？事故惨案不仅让人痛心难过，同时我们更有一种急欲解决的迫切。绝对不能让酒后驾驶“横行霸道”“耀武扬威”，成为危害我们老百姓的“妖魔鬼怪。”

酒后驾驶的问题，我们不可能去禁酒，酒也是我们多年的传统文化之一，但是我们可以提倡文明有度、和谐安康的酒文化。酒后驾驶不在酒，而在于“人”和“人之间”。只有每一个人，每一位交通驾驶者提高酒后驾驶危险的意识，遵纪守法，互相监督，自觉践行，酒后驾驶才能防患未然。

同时，治理酒后驾驶是一个复杂的过程。客观上，中国法律严惩力度不明显，过于轻微，容易让人简单应付。同时，在交通安全的教育宣传上，过于追求大、空、泛。另外，部分执法人员出现有不执法或者马虎执法现象，更甚者，做了金钱的傀儡。主观上，当事人的掉以轻心、麻痹大意是主要原因。他们多存在侥幸心理，也有人钻法律漏洞。部分有权有势的人也是嚣张至极，唯他人性命而不顾，肆意猖狂。正因为如此，治理酒后驾驶的问题更需要大家联合起来监督协管，遏制如此不文明、不遵法、不道德的气焰，给老百姓一个交代。

对于不知悔改的人，我们要进行严肃处理，不能让他们无法无天，破坏道路交通的秩序，危害他人的生命健康。以下是我的一些建议：

一、2010年8月，十一届全国人大常委会第十六次会议将首次审议刑法修正案

（八）草案，醉酒驾驶或被判刑。这个消息一出，老百姓都高兴地拍双手支持。所以，希望我们的政府部门要不断地加大力度制定、落实酒后驾驶违反交通安全的惩罚规定，让酒后驾驶的人“真正”害怕，以后不敢违法；

二、要加强交通安全的宣传教育，但只靠一个交警部门是远远满足不了需求的，还需要通过广大人民的参与，形成良好的教育监督氛围；也可以通过新闻媒体的公益广告宣传，广泛鼓励广告创作，一定能降低酒后驾驶事故频率。交通环境是服务大家的，每个人都应该做贡献。

三、交警部门也要加强查处力度，执法过程不能手软。同时，注重加大路面设施的管理力度，利用高科技手段监测监管驾车人员，不能让一些人逍遥自在；

四、我们身边的朋友亲戚，都会有喝完酒就驾车的情况，我们应该建议劝告并尽可能阻止他。这也是我们应该履行的监督义务。甚至，我们可以打电话举报这些酒后驾驶的行为。

第五篇：关于酒驾处理

关于酒驾“零容忍”政策:一律按上限处罚，对饮酒后驾驶机动车的，一律暂扣驾驶证6个月，驾驶非营运车辆

罚款1000元，营运车辆罚款2000元；对

醉酒驾驶机动车的，一律移送检察部门追

究刑事责任。

关于酒驾车祸认定:

1、据最高院司法解释及交强险相关规定,即便是

醉驾后发生的车祸，交强险也要在责任

限额范围内予以赔偿。方式为先行垫

付，再由保险公司向被保险人追偿。

2、保险理赔的前提是事故责任认定，主要责任人

需对无辜第三者的死亡，以及其他车辆的损失

予以交强险的赔付。但主要责任人自身车辆

上死亡的司机及另外的N名乘客，由于不是

第三者，不属于主要责任人自身车辆（制造车

祸者）交强险的赔付对象。

3、《交强险的限额为12.2万元，其中11万元是

死亡赔付，1万是救治产生的医疗费用，2千

元是物损》。

4、当交强险赔付的钱不足以赔付损失时，那么

不足的部分，则需要受害者及其他车辆的损失

者对主要责任人进行民事索赔。与此同时，由

于主要责任人如系酒驾肇事，即便其投保了第三者责任险等商业车险，保险公司也会因其酒

驾拒赔。

关于另一方的事故责任认定：

1、首先看其是否有责。如果无责，则

大货车方顶多承担10%的交强险无责赔付，商业车险不需要赔付。（10%的无责赔付也要商榷，因为并非所有无责科目都适应于无责赔付。无责赔付是一种人性化的规定，限额为10%。例：拿交强险12.2万元的限额，去掉1万元的治疗费用，顶多赔付1.1万元左右，赔偿对象为主要责任人车上的N人及另外的N名行人——对大货车（另一方）而言，他们都是属于第三者。

2、但如果大货车被认定有责，则很可

能司机会承担较大金额赔付。如果

被认定有次要责任，比如占30%的责

任，那么货车的交强险和商业第三者

责任险都要赔偿这30%所对应的金

额。通常货车投保商业第三者责任

险的保额多为20万元。但20万元对多人死亡和涉及豪车的赔付肯定远远不够。
