第五篇：误工时间如何计算

当事人的误工时间是简单的计算至定残日前一天还是根据鉴定机构鉴定认为的实际误工时间

在司法实践中,常常出现鉴定机构鉴定认为当事人误工时间超过当事人受伤到该鉴定机构评定伤残的时间,那么此时误工时间是简单的计算至定残日前一天还是根据鉴定机构鉴定认为的实际误工时间?

如由于鉴定机构作出的鉴定认为原告受伤后误工时间为伤后4个月，但原告受伤至鉴定伤残的时间只有3个月，因此被告(包括保险公司)均认为原告的误工时间只能计算至定残日前一天（即3个月），定残日后的损失应为残疾赔偿金的赔偿范围，而不应计算在误工费的损失之内。

但本人认为被告(包括保险公司)对司法解释以及误工费和残疾赔偿金的区别和定性的理解是错误和片面的，原告的误工时间应为4个月，而不应计算至定残日前一天：

首先，最高人民法院的司法解释规定的是可以计算至定残日前一天，而并非必须计算至定残日前一天，其主要目的之一也在于防止鉴定机构作出鉴定误工的时间和作出鉴定的时间相冲突。另外，在最高人民法院民事审判第一庭编著的《最高人民法院人身损害赔偿司法解释的理解与适用》一书第287页也对计算误工时间作出了解释，其解释为“受害人因伤致残或者死亡的，误工时间应当计算至定残之日的前一日或者按照实际误工时间计算”。最高人民法院民一庭对上述解释是具有指导作用的，并且也认为误工时间应根据实际误工时间计算；

其次，残疾赔偿金与误工费计算的理论基础不同。《解释》第25条第1款规定：“残疾赔偿金根据受害人丧失劳动能力程度或者伤残等级，按照受诉法院所在地上一城镇居民人均可支配收入或者农村居民人均纯收入标准，自定残之日起按二十年计算。但六十岁以上的，年龄每增加一岁减少一年；七十五周岁以上的，按五年计算。”这一规则实质上是以定额化赔偿或定型化赔偿为理论基础制定的。所谓定额化赔偿，即所有构成相同残疾等级的人，在同一类别内（目前区分城乡居民），不论其性别、就业状况、收入差距都享受同样的计赔标准。采取定额化计算时，不再考虑个体区别，其实质是根据劳动能力丧失程度抽象确定统一的标准。《解释》第20条第3款规定：“受害人有固定收入的，误工费

按照实际减少的收入计算。受害人无固定收入的，按照其最近三年的平均收入计算；受害人不能举证证明其最近三年的平均收入状况的，可以参照受诉法院所在地相同或者相近行业上一职工的平均工资计算。”这一规则是在差额化赔偿理论与定额化赔偿理论相结合的基础上制定的，并且以差额化为主。所谓差额赔偿，就是以被害人的财产状况于损害事故发生与损害事故不发生两种情形下的差额为根据确定赔偿数额，体现全部赔偿实际损失的原则。此种赔偿方法充分考虑受害个体实际收入的差别，其根据受害人的具体情况和特点主观量化计算利益损失。上述规定中，有固定收入的人和无固定收入但能举证证明最近三年平均收入状况的人，实质上都采用的差额化赔偿；而无固定收入又无法举证证明最近三年平均收入状况的人，才采用定额化赔偿。因此，由于定额赔偿与差额赔偿存在区别，残疾赔偿金与误工费计算的理论基础不同。该理论基础也是得到了最高人民法院的支持的。（参见《最高人民法院人身损害赔偿司法解释的理解与适用》一书第288—291，317—318，437—

438、449页）；

再次，评残日作为误工计算界限日缺乏科学性。根据目前的评残规则，评定伤残的时限主要有两个：常规在临床治疗终结后进行；涉及功能障碍的一般在受伤6个月至9个月后方可进行。因此，对绝对大多数案件的受害人而言，何为临床治疗终结就显得十分重要。法医学上一般认为，所谓“临床治疗终结”是指受害者经过一定时间治疗后，临床医学一般原则确定已治愈，或有一定后遗症，但客观检查无阳性特征，或虽有症状和病理改变，临床认为不需要处理或目前医疗手段无法处理的医疗时间。由此可见，法医学上医疗终结概念既带有较强的医学知识，又非常抽象，伸缩空间很大，非常难以把握，并在司法实践中产生严重分歧。有的认为，医疗终结日应为受害方第一次出院日；有的则认为，应为其在提起诉讼前最后一次治疗日；还有的则认为，应为受害方申请评残鉴定日。这一分歧，本应通过法律或司法解释的强制性规定来加以弥合和缩小，遗憾的是我国有关法律和司法解释并没有对如何判断医疗终结作出规定，进一步造成了仁者见仁、智者见智的状况。显然，计算至定残日前一天的规则，建立在争议很大、认识极不统一又无法律规制的“临床治疗终结”上，缺乏科学性；

最后，现行计算规则为当事人恣意规避法律提供了巨大空间。任何一项法律或司法解释规则的制定，都应当最大限度地考虑合理性和最大限度地保障社会公平，如果让当事人规避法律、恣意行事的空间过大，就会违反公平原则，有悖规则制定的初衷。正如上述第三点所述，由于“临床治疗终结”本身难以确定，误

工时间计算至定残前一天的规则，就给了当事人很大的自由操作的空间，甚至恣意规避法律。

综上所述，无论是司法解释的立法本意还是最高人民法院的理解或是误工费和伤残赔偿金的理论差异，均认为误工时间应计算至实际误工之日，而不应计算至定残之日。因此，原告的误工时间应根据鉴定机构确定的误工时间加以确定（参见《最高人民法院人身损害赔偿司法解释的理解与适用》一书第288—291，317—318，437—
