都是两个方面的判断。第一个方面要判断的是作证的时候；第二个判断在现场的时候是不是出现这种情况。如果是现场出现这种情况，提的可能是不能正确的感知当时的事实，要重点审查这方面的问题。如果是作证的时候不能，直接可以得出结论，不能做定案根据。

证据能力规则还要注意的问题是年龄、认知水平问题。这个问题，不要跟民事行为能力和刑事责任能力混淆，在审查证据的时候要注意这个问题。

另外，证据能力要跟证明力分开。如果不能正确表达，这个就没有证据能力。没有证据能力，就不得作为证据使用。证明力是什么？

(三)证据的合法性规则

证人证言的取得程序、方式应当符合法律及有关规定，下列方式取得的证人证言不得作定案根据：

暴力、威胁、欺骗、引诱等非法手段取得的证人证言；

没有经过证人核对确认并签名(盖章)、摁指印的书面证言；

询问聋哑人、不通晓当地语言文字的少数民族人员、外国人，应当提供翻译未提供的。

对证人证言的瑕疵证据如何去质证：

证人证言笔录没有填写询问人、记录人、法定代理人的姓名及询问的起止时间、地点的，可以从证据的客观性角度来质证；

询问证人的地点不符合规定的，如茶馆、饭店、看守所。这种情况下有理由怀疑是以残忍不人道、折磨等方式暴力取证的。可以从这个角度出发进行质证；

询问证人没有告知其义务与责任的，可以从证人是否受欺骗或威胁的角度出发进行质证；

如果询问笔录反映出在同一时间段内，同一询问人员询问不同的证人，这种情况下从证据的客观性是否有伪造证据的角度出发进行质证。

(五)当庭翻证的采信规则

一、凡是知道案件情况的单位和个人，都有义务出庭作证。有关单位的负责人应当支持证人作证。但是，不能正确表达意志的人，不能作为证人。

待证事实与其年龄、智力状况或者精神健康状况相适应的无民事行为能力人和限制民事行为能力人，可以作为证人。

二、当事人申请证人出庭作证，应当在举证期限届满十日前提出，并经人民法院许可。

人民法院对当事人的申请予以准许的，应当在开庭审理前通知证人出庭作证，并告知其应当如实作证及作伪证的法律后果。

证人因出庭作证而支出的合理费用，由提供证人的一方当事人先行支付，由败诉一方当事人承担。

三、证人应当出庭作证，接受当事人的质询。但是证人确有困难不能出庭的，经人民法院许可，可以提交书面证言。“证人确有困难不能出庭”，是指有下列情形：

(一)年迈体弱或者行动不便无法出庭的；

(二)特殊岗位确实无法离开的；

(四)因自然灾害等不可抗力的原因无法出庭的；

(五)其他无法出庭的特殊情况。
