房屋租赁相关法律问题

许多人也许会有这样的误解:房屋租赁相比买卖要简单很多,基本上没有太多需要关注的问题,甚至有不少人认为租赁合同都可有可无。

实际情况却恰恰相反,由于房屋租赁中承租人并非房屋所有权人,他仅从所有权人处取得有限的使用权,因此在租赁期限内,承租人的房屋使用范围、相关设施的使用及费用承担均应有明确约定。而对于房东而言,毕竟租赁期限内房屋已脱离自己的实际掌控,如何确保自己的租金收益,同时又保护房屋不被人为损坏,避免租客违约提前退租后“人去楼空”的被动情形,这些问题都需要租赁双方事先达成共识并制定相应措施。笔者根据实践中的有关实例,对房屋租赁中可能涉及到的典型法律问题作一概括,希望对读者有所帮助。

一、确定租赁双方当事人身份首先,需要确定当事人是个人还是公司。若以公司身份作为出租人或承租人,租赁合同必须体现该租赁行为是公司行为,否则一旦出现问题,就很难向个人追究原本应由公司承担的法律责任。其次,承租人应当依据产权证上记载的权利人,或与该房屋产权证上记载的权利人签订租赁合同的合法承租人,来确定与其签订租赁合同的相对人是否确有出租该房屋的权利。若承租人与实际上并无出租权的人签订租赁合同,则该合同须经有权出租人的认可,在此之前该租赁合同的效力尚未确定。若未经认可,承租人则可能面临缺乏有效合同的不利处境。

二、确定房屋类型房屋类型基本分为居住用房和非居住用房两种。承租人应根据需要选择相应类型的房屋承租。特别需要提醒的是,如果该承租房屋需用于办公,则必须选择非居住用房。因为如果涉及办理营业执照,只有房屋类型为非居住用房的,工商行政管理部门才会核发营业执照。具体房屋类型需根据产权证上的记载确定。另外,确定房屋类型并选择相适应类型房屋租赁后,在租赁期间内承租人不得擅自改变该房屋用途,否则将视作违约行为。例如,居住用房不得擅自改变为非居住,除双方同意外还需取得有关部门的批准。

三、租金的支付时间及方式通常大多数人认为,就租金数额达成一致后就万事大吉了。其实租金的支付时间及支付方式,同样具有举足轻重的地位。出现承租人拖欠租金的情形时,事先约定有支付时间就显得尤为重要。这样,出租人就有权自该支付时间起向承租人加收滞纳金。(对于滞纳金数额若有约定,则依据双方约定;若双方未有约定,根据《上海市房屋租赁条例》第23条规定,以拖欠租金额的日万分之四计收)另外,法律规定承租人无正当理由未支付或者延期支付租金达一定期限的,出租人有权解除租赁合同。法律允许双方当事人自行约定该期限,若无约定,《上海市房屋租赁条例》第23条规定为累计超过6个月。至于租金的支付方式,包括现金、支票或银行转账等,承租人应依照双方约定的支付方式支付租金。

四、租赁保证金为确保承租人能够合理、善意地使用房屋,并按时支付租赁期间应承担的各项费用,双方可于租金之外另行约定租赁保证金,即俗称的押金。押金通常为一到三个月的租金。租赁关系终止时,租赁保证金可用于抵冲依合同约定由承租人承担的各项费用,剩

余部分应返还承租人。在出现承租人提前退租、拖欠相关费用等情形时,允许出租人先行以租赁保证金抵冲相关费用,这对于出租人较为公平。

五、租赁登记的重要性租赁合同经双方签字盖章后即行生效,但承租人应于之后要求将该租赁合同至房屋所在地的区(县)房地产交易中心做备案登记,至此该租赁关系才能产生对抗第三人的效力。签订租赁合同后,该合同于双方当事人之间固然有效,但如果此前于该房屋上已实际存在租赁关系或此后房东另行与他人设定租赁关系,且若该租赁关系经过备案登记,则承租人无法对抗已经过备案登记的租赁关系承租人,即实际由经过备案登记的承租人取得承租权。

六、转租关系中承租人应注意的问题房屋的合法承租人在一定条件下有权全部或部分出租该房屋,此种出租行为即为转租。但转租在租赁范围、时间等方面在很大程度上受到所有之前租赁合同的限制,即转租的租赁条件不得大于作为本次出租人即上手承租人于上手租赁合同中取得的租赁条件,主要指租赁范围、时间等,超出部分无效。另外在转租房屋时,需要取得所有上手同意本次转租关系的证明,该同意证明可以采用两种形式:上手租赁合同中已约定承租人有转租权或者所有上手直接对本次转租提供同意证明。若未取得所有上手对此次转租的上述任何一种同意证明,未同意转租的上手随时有权解除与其存在租赁关系的承租人之间的租赁合同,则此后所有转租关系均将被相应解除。

最后,对于租赁期限内相关附属设施、设备的使用,房屋的维修责任及相关费用的承担,承租人是否有权对房屋进行装修,及待租期届满时增添的设施、设备的归属、补偿问题等,双方也应有明确约定,以防在出现争议后相互扯皮的现象。

首先要签定租赁合同,签合同时应注意事项:

1、查看出租人的房产证明和有效身份证明

2、签订租房合同时,应问清房租包含的内容,水、电、暖、煤气(天然气)和物业管理费由谁承担。

3、要求出租人在房屋出租前结清水、电、暖、煤气(天然气)和其它费用。

4、明确租期、房租的付款时间和付款方式。

5、问清屋内家具、电器、其他设施的使用是否额外收费,由谁来承担维修费用。

6、应对能否转租做出约定。

7、要明确违约责任和违约的补偿标准。

8、入住前检查屋内家具、电器、其他设施的好损情况。其次,根据规定,租赁合同签定后要去房产管理部门办理登记备案手续。不过,出租方一般不太愿意办理,因为要交纳一些费用。

房屋租赁合同是指房屋出租人将房屋提供给承租人使用,承租人定期给付约定租金,并于合同终止时将房屋完好地归还出租人的协议。房屋租赁合同内容主要包括房屋地址、居室间数、使用面积、房屋家具电器、层次布局、装饰设施、月租金额、租金缴纳日期和方法、租赁双方的权利义务、租约等。

承租人的权利在承租期内占有、使用房屋。租期届满后,原承租人优先继租。承租人的义务正当使用承租的房屋,按合同规定交付租金,在租期届满时将原房完好返还出租人。

出租人的权利是监督合理使用房屋,按合同收取租金,在租期届满后收回出租的房屋。其义务是将出租的房屋按合同规定交付承租人使用,并定期对房屋及设施进行检查、维修,保证承租人使用。出租人和承租人就房屋出租的租金、期限、违约责任等条款达成一致意见后,租赁合同就成立了。成立后的房屋租赁合同有无法律效力,主要从下面四个方面进行审查。

(一)合同主体是否符合规定,即出租人与承租人是否具备有效民事行为的构成要件。如是否为无民事行为能力人或限制民事行为能力人,或出租人是否为房屋所有人或合法使用权人等。

(二)房屋是否为法律法规禁止出租。只要法律法规不禁止出租的房屋,都可以依法出租。根据规定,有下列情形之一的房屋不得出租:(1)未依法取得房屋所有权证的;(2)司法机关和行政机关依法裁定、决定查封或者以其他形式限制房地产权利的;(3)共有房屋未取得共有人同意的;(4)权属有争议的;(5)属于违法建筑的;(6)不符合安全标准的;(7)已抵押,未经抵押权人同意的;(8)不符合公安、环保、卫生等主管部门有关规定的;(9)有关法律、法规规定禁止出租的其他情形。

(三)房屋租赁合同的内容是否合法。在实践中,有些房屋租赁合同约定房客逾期支付租金、水电费等的滞纳金按每日2%计算。从法律来说,这种约定因滞纳金过高有失公平,属于可撤销条款。还有一种常见的情形是,有人用租来的房屋进行违法犯罪活动,若属实,则在出租人明知或应当知道的情况下,这样的租赁合同均是无效的,不受国家法律保护,租金依法没收。

(四)是否进行过登记备案。《城市房地产管理法》、《城市房屋租赁管理办法》及本市的租赁法规均规定,租赁当事人应向房产管理部门办理登记备案手续。在实践中,对未登记备案的租赁合同是否有效有两种观点,一种认为合同是无效的,另一种认为租赁合同仍然有效,但不具有对抗第三人的效力。出租人:(简称甲方)身份证号码:

根据有关法律规定,经协商,甲、乙双方共同签订本租赁合约,达成以下协议并共同遵守。

2、该房屋月租金为人民币 元(元整),并在每月 日前将当月租金交清。

如拖欠租金达10天以上,视乙方违约,甲方有权收回该住宅,并没收押金。

3、签订本租赁合约时,乙方须向甲方缴交人民币 元(元整),作为履约保证金和财物押金。合同期满后,如乙方无违约或把房内财物丢失、损坏等情况,甲方须如数退回押金给乙方。

5、乙方应维护该房清洁卫生,注意防火、防盗等到安全防范,不得在房内做任何违法行为,否则由此带来的后果由乙方负责。

6、甲方承担该房屋工程质量及维修责任。乙方在室内装修时须得到甲方的同意,但不能改变房屋的墙体、结构及用途,乙方故意或过失造成该房及配套设施、财物损坏或丢失,应恢复其原状或赔偿经济损失。

7、租赁期间,甲方要收回房屋,必须提前壹个月书面通知乙方,并双倍返还乙方租房押金;如乙方需退房,必须提前壹个月书面通知甲方,经甲方同意所交押金退回。未经甲方同意,乙方提前解除合同,甲方有权没收押金。

8、如合同期满,乙方有权优先租赁的权利;租赁期满后,乙方应将房屋交回甲方使用,并缴清负责的费用,经双方移交无误,甲方须退回押金经乙方。
