to repair itself, and the repair expenses should be borne by Party A.Article 9: During the lease term, if Party A does need to take back the house for self-occupation, Party A must give a written notice to Party B one month in advance.After the termination of the contract, Party A shall pay penalty to Party B which account for 5% of the total rental of the remaining lease term.Article 10: If Party B needs to return the premise during the lease term, a written notice should be given to Party A one month in advance.The two parties agree to terminate the contract through consultation.Party B two parties cannot reach an agreement, Party B shall remove them within seven days from the date of termination of the contract.For more than seven days, Party A shall have the right to retain free of charge or remove by themselves, the cost of removal shall bear by Party B in a reasonable amount.Article 13: Early termination of the contract or after the contract expires according to the contract, Party B shall move out of all equipment and items within fifteen days from the date of receiving a formal written notice from Party A, unless the two parties have other consultation.If Party B does have difficulties in finding another house in short term or other special circumstances, Party A shall allow Party B an extension of 30 days, however, Party B shall pay the entire rental which the contract set at one time.If there is still belongings left by Party B after seven days of the removal, it will be deemed to be abandoned by Party B and Party A has the right to dispose it , unless the two parties have other agreement Article 14: If Party B fails to move after lease expiration or termination of the contract, Party B shall compensate for Party A the economic losses.Article 15: Within one month before the contract expires, Party B will notify Party A if it intends to extend the leasehold.After receiving the written notice, Party A can raise an objection or discuss matters over the extension with Party B within 30 days.If Party A does not give a written reply to Party B during the 30 days, it will be deemed to give tacit consent to renew the premise.This contract is automatically extended for one year, from the next day of the expiration of 30 days.Article 16: Any dispute arising from the contract or in connection with the contract should be settled through friendly discussion between the two parties.If no settlement can be reached through discussion, both parties shall have right to sue with the people’s court, which has jurisdiction over the matter.Article 17: This contract shall go into effect the moment it is signed by both parties and shall abide by the administrative laws and regulations.Article 18: If Party B delays such rental 七、乙方义务 obligations of party b 1.乙方应按合同的规定按时支付定金、租金及保证金。

八、合同终止及解除的规定 termination and dissolution of the contract 1.乙方在租赁期满后如需退租或续租，应提前两个月通知甲方，由双方另行协商退租或续租事宜。在同等条件下乙方享有优先续租权。

if party b fails to pay the deposit or other fees payable under this contract, or party a has paid for party b such other fees payable by party, party b shall pay late payment interests for the period of late payment at the rate of 0.5‰ of the outstanding amount per day.如乙方未能按照本合同规定支付应付的保证金和其他款项给甲方，或甲方为乙方垫付应由乙方支付的其他款项，乙方应付迟延支付期间的迟延利息，该迟延利息应按日息为所欠款项的0.5‰计算。

6.1 party a shall ensure that the construction structure and the equipment and facility of the premises conform to the safety conditions concerning construction, fire prevention and others, and the premises has not any danger to the personal safety.party b shall ensure that the relevant laws and regulations of national or beijing government shall be observed during use of the premises.6.1甲方应保证房屋的建筑结构和设备设施符合建筑、消防等方面的安全条件，不得危及人身安全；乙方应保证在使用过程中遵守国家、北京市的相关法律法规规定。? 6.2 during the term, both parties shall ensure that the premises and its contents, equipment and facilities are in usable and safe condition: 6.2租赁期内，甲乙双方应共同保障房屋及其附属物品、设备设施处于适用和安全的状态： 6.2.1对于房屋及其附属物品、设备设施因自然属性或合理使用而导致的损耗，乙方应及时通知甲方修复。甲方应在接到乙方通知后的7日内进行维修。逾期不维修的，乙方可代为维修，费用由甲方在合理合法范围内承担。6.2.2因乙方保管不当或不合理使用，致使房屋及其附属物品、设备设施发生损坏或故障的，乙方应负责维修或承担赔偿责任。

1.rights and obligations of party a 2.甲方权利及义务

7.1 party a hereby guarantees that party a is the legal owner and has the right to lawfully lease the premises.otherwise, party a shall bear the legal liability arising therefrom in full.7.1 甲方保证是项目合法的拥有者，其有权合法出租该单元，否则产生的法律责任均由甲方承担。

7.3 甲方保证在租期内，乙方将有权平静地占有和享用该单元，不会受到甲方或甲方代理人的干扰，但前提是乙方支付了本合同规定的租金和其它费用，并遵守和履行了本合同规定的应由乙方遵守和履行的条款。

7.4 party a has the right to terminate this contract unilaterally upon occurrence of any of the following to party b: 7.4 乙方出现下列任何情况时, 甲方有权单方解除本合同。

7.4.1 violates the laws or the regulations of prc or uses the premises for illegal business operations;7.4.1 违反中华人民共和国的法律/法规, 利用该单元进行不法经营活动； 7.4.2 changes the uses of the premises without consent of party a;7.4.2 未经甲方同意擅自更改该单元的用途；

7.4.3 fails to pay the rent pursuant to relevant provisions hereunder;or 7.4.3 未按本合同的有关条款缴纳租金；或 7.4.4 sub-lets the premises or parts of the premises to others, transfers the premises to others or uses the premises jointly with a third party without the consent of party a.7.4.4未征得甲方同意, 擅自将该单元或该单元的部分转租、转让给第三方或与第三方共同使用。

7.5 party b agrees to waive its right of first refusal in respect of the premises voluntarily and unconditionally during the term.during the term, party a shall be free to transfer the premises to any third party, provided that such transfer shall not prejudice party b’s rights to occupy, control and use the premises in accordance with the terms and conditions of this contract.if party a transfers the premises to a third party, such third party shall continue to enjoy and bear all rights and obligations of party a under this contract.party b undertakes to cooperate in full with party a in handling the relevant formalities to sell and hand-over of the premises.party b’s failure to cooperate for the hand-over shall not affect the assumption of the rights and obligations of this contract by the new owner.party b shall pay rent to the new owner in accordance with this contract after receipt of party a’s notice, otherwise party b shall bear the liability for breach of contract and late payment under this contract.7.5在租期内，乙方自愿无条件放弃该单元的优先购买权。在租期内，甲方有权自由转让该单元予任何第三方，但是该转让不得影响乙方根据本合同的条款和条件占有、控制和享用该单元的权利。若甲方将该单元出售予第三方，第三方将继续享有和承担甲方在本合同项下的所有权利和义务。乙方承诺充分配合甲方办理该单元的出售及交接手续，不影响新业主开始继受出租方在本合同项下的权利义

第三篇：房屋租赁合同要点(英文)

breach of agreement :

10.1 甲、乙任何一方如未按本合同的条款履行，构成违约，应承担相应的违约责任。双方同意违约方应赔偿守约方之直接损失人民币____________元。

c.无故拖欠租金超过三天（除双方就本合同存在争议除外）。

fails to pay rent without any reason for more than thirty(30)days after the due date except where there is a dispute in respect of this agreement.十一、适用法律：

本合同的成立，其有效性、结实、签署和解决与其他有关的一切纠纷均应受中国法律的管辖并依据中国法律解释。

the formation of this agreement ,its validity,interpretation,executiong and settlement of any disputes arising hereunder shall be governed by and construed in accordance with the laws of the people’s republic of china.十二、争议的解决：

dispute resolution:

凡因执行本合同所产生的或与本合同有关的一切争议，双方应通过友好协商解决；协商不成，应提交中国国际经济贸易仲裁委员会，按其仲裁规则和中华人民共和国仲裁法进行仲裁。仲裁解决是终局的，对双方都有约束力。

in the case of disputes arising over this agreement of any matters related hereto ,the parties shall negotiate in good faith to resolve such disputes.if such negotiation fails, the parties shall submit the dispute to arbitration by the china international economic and trade arbitration commission in accordance with its arbitration rules and the arbitration law of the people’s republic of china.the decision of the arbitration body is final and shall be binding on the parties hereto.十三、其他

13.1 本合同如有未尽事宜，由甲、乙双方洽谈解决。
