高西庆校友在美国杜克大学法学院2014届毕业典礼上的演讲 在刚刚结束的美国杜克大学法学院2014届毕业典礼上,86届毕业生高西庆校友深情回忆了他年轻时修铁路不忘学习英语,后来到Duke法学院求学住在图书馆,再后来回国建立中国资本市场的人生经历,并给毕业生们提出了建议:保持开放的心态,肯吃苦、不过分追求物质生活,最重要的是愿意尝试别人没有走过的道路。不忘初心,方得始终。今天我们全文刊发高老师演讲全文(中英文对照),以飨读者。I was going to speak today about the necessity for an open-mind as you approach new opportunities, new environment and new paradigm, the need to have stamina in times of difficulty and to not be afraid to take the road less travelled.But I believe most of you know this or you wouldn’t be here today in the first place.我今天本来想跟大家讲讲未来当你们面对新的机会、新的环境以及新的模式时保持开放心态的必要性,以及遇到困难时应该怎样保持坚持不懈的努力和拥有另辟蹊径的勇气。可是,我相信在座的大部分人都已经十分明白这些道理,否则你们不会取得今天的成绩。
So I'm just going to give you a piece of avuncular advice, tell my story and be boring:
所以我只想从一个长者的角度给你们一点建议,讲讲我的故事,或许这会比较无聊。
Close to thirty years ago, I was where you are today and only a few years before that, it would have seemed impossible to me that I would ever sit where you are today.You have earned this seat, through intelligence, diligence and discipline, my deepest congratulations to all of you.For all the cynicism in the world today, especially given how people perceive the practice of law, I encourage all of you to preserve your optimism, idealism and passion for what you do.大约30年前,我正坐在你们现在坐的位置上;如果再倒回几年的话,我完全不敢想像自己有朝一日会成为你们其中的一员。你们通过自己的才智、勤奋和自律赢得了坐在今天毕业典礼上的资格,我衷心地祝贺你们。面对现今横行于世的犬儒主义,尤其是人们对整个法律行业的负面看法,我鼓励你们不要丢掉做自己想做事时的那份乐观、理想以及激情。不忘初心,方得始终。You have proven that you have a lot to offer this world, now you need to prove you can make a difference, whether that be in the courtroom, classroom, NGO or office lead by example because ANYTHINGIS POSSIBLE!I want to share with you some of my experience in the hopes that it encourages you to not accept barriers at any cost.各位同学已经证明你们有能力为这个世界贡献良多,但是现在你需要去证明你确实可以通过努力让这个世界变得不同。这种变化可以发生在法庭上、教室里,也可以发生在民间组织或是政府部门之中,因为一切皆有可能!我想和你们分享一些我的经历,希望以此鼓励你们面对挑战绝不退缩,勇往直前。
As a teenager, I was sent to a railroad construction site deep in the mountains in Western China.Food was rationed and workload was heavy.However, what made it more unbearable was the lack of knowledge and information.I devoured every piece of paper that had any word on it, like a hungry man.Together with a few co-workers we started a study group called “The Communist Laborer's Night School”, with the few old text books we brought with us, and a radio we used to learn English from VOA and BBC, at the risk of imprisonment for listening to “enemy stations”.当我还是一个十几岁少年的时候,我被送到中国西部的大山区里修建铁路。在那里,食物实行配给制并且工作强度很大,所以我们总是处于饥饿状态。但是,更加让人痛苦的是知识与信息的缺失。我贪婪地去看每张偶尔得到的写有字的纸片,如饥似渴。我还和其他几位工友们成立了一个“共产主义劳动夜校”。我们一同学习一些旧课本,冒着被判刑的风险用一台收音机听“敌国电台”:从“美国之音”和BBC学习英语。After 3 years of hard labor and a head injury, I was given a job in an artillery factory making machine guns.I biked about 10 miles twice a week to learn English taught in the Radio Engineering School of a university in Xi'an.Most of the 200 people quitted the class during the one-year study, and I was one of the dozen remaining, together with the chief engineer of my factory, who later put in a strong recommendation for me to go to college in Beijing, without having ever been to a high school.经过三年繁重的劳动和一次脑部受伤,我被分配到西安一家兵工厂制造机关枪。我每周两次下班后骑自行车去10英里外一所大学的无线电工程系学习英语。在这一年的学习中,200多名学员中的大多数并没有坚持。但是我是那坚持下来的十几个人之一,一同留下来的还有我工厂里的总工程师。他后来在我甚至没有上过高中的情况下强烈推荐我去北京读大学。
After graduating from both college and law school in BJ, I was sent as an exchange scholar to work in a law firm in California.Boy I remember the cultural shock I had when I first arrived in SF in 1982!There I realized that my knowledge of law was utterly inadequate to deal with international transactions, which I was supposed to teach back in Beijing.I decided to go through the hardship of studying for a JD degree in the US.That started my honey-decades with Duke law, which gave me a full scholarship and a fuller education in American law.从对外经贸大学的法学硕士班毕业后,我获得了去加州一家律所实习的交换机会。我仍然记得1982年当我第一次抵达旧金山时所能感受到的文化冲击。在那里,当处理一些有关国际交易的案子时,我意识到自己有关美国法律的知识非常匮乏,而这却是我回国之后准备教授的。我决定在美国咬着牙读一个法学博士学位。杜克法学院资助了我全额奖学金让我能够系统地学习美国法律,从此开启了我和杜克法学院长达三十年源远流长的甜蜜之旅。
I was once asked by a hard-struggling law student from China why I seemed so happy and content with my studies then, living mostly in the law library.I answered, if you have experienced the deprivation of knowledge for so long as I have, you would, too, view this place as the heaven of learning.I said that despite the many occasions when a few professors would vote against granting the scholarship to a “red Chinese”, or some fellow students spoke right in my face that they were “abhorred” by the Chinese communist system.When I was later asked of a similar question as a junior associate in the sweat shop of a Wall Street law firm, I happily told the fellow associate that Vladimir Lenin taught me to learn your skills so to dig the grave for capitalism.曾经有一个深受法学院学习压力痛苦折磨的中国学生问过我这样一个问题:“你几乎成天以图书馆为家,为什么还那么开心和满足?”我回答说,如果你像我那样,经历过如此之长的缺乏精神食粮的岁月,那么你同样会把这地方当做是求知的天堂。当然求学过程中也有很多不尽人意之处,比如有那么几位教授反对给我这个来自红色中国的人发奖学金,或者有几位学生曾当面对我说他憎恨中国的共产主义制度。我后来在华尔街一所律所里当律师的时候,也被问到这个问题时,我很开心地回答道,列宁教导我要学习西方的先进知识,才可以为资本主义挖掘坟墓。
The ensuing 1987 financial crisis jolted me to an opposite direction, though.I was so fascinated by the intricacies of the capitalistic financing machines that I decided to study it carefully and try to transplant it to my own home country.I went back to China in the summer of 1988, after visiting most of the stock exchanges in Europe and some in Asia, in a seemingly fool-hardy effort to persuade the Chinese government forthe establishment of a capital market.然而,随后1987年的金融危机却将我拉向了另外一个方向。我对这精妙的资本主义筹融资机器体系产生了巨大的兴趣,所以我决定认真仔细地研究它并且将这架机器移植到我自己的祖国。在自费调研过欧洲以及亚洲大部分证券交易所后,我于1988年夏天回国,以近乎愚公移山的努力说服中国政府建立中国的资本市场。
Among all the people who were skeptical of our idea, was an American consul in Beijing.After suspiciously questioning my intention to have gone back to China and hearing my explanation about my ambition to start the stock market there, he said, this is all BS, and tore up my application forms.This is in early 1990, when I applied to come to teach a short course at Duke law.By the end of that year, we have helped the opening of two stock exchanges, the SHSE and the SZSE, which have a combined market cap of several trillion dollars today.Two years after, the unintended consequences started to show and the central government finally adopted our proposal of setting up the regulatory agency and persuaded me to join it.在所有质疑我这个想法的人群中,有一位是驻北京的美国领事。在怀疑我回中国的动机并且听完我想要在那里建立股票市场的想法后,他说,这完全是扯淡,并且撕碎了我美国签证的申请表。记得那是1990年初,我当时去申请美国签证回杜克法学院教几周课。当年年底,中国自己的两个证券交易所就建成了:上海证交所和深圳证交所。今天,这两家证券交易所交易的股票总市值达到上万亿美金。随后的两年,中央政府最终接受了我们的提议并启动成立了证券市场监管机构,并且劝说我加入其中。Being a regulator is like being a matchmaker, when the marriage is successful, the couple would think it's their own good fortune, will be busy enjoying themselves and very seldom grateful to you.But if anything goes wrong, then both sides blame you for it.I got just that sort of treatment, blamed all the time, for good or bad reasons.I was yanked out of the agency to run the newly established Social Security Fund in 2003, and then, 4 and half years later, the Sovereign Wealth Fund.After almost 7 years serving as an investor, I'm finally relieved of my duty and allowed to retire to do what I love the most, i.e., working with young people every day, teaching and, more importantly, learning.监管者的角色就好比是媒人,如果做媒成功,男女双方会认为这是他们自己的好运气,沉溺于爱河中而没有时间来感谢你。但一旦失败,双方都会指责你的不是。我就获得了那样的待遇:不管是什么样的原因,总是被骂。2003年,我被调离证监会成为新成立的全国社会保障基金的负责人,四年之后,又成为中投公司的总经理。在七年的投资生涯之后,我总算可以卸下身上的责任并且获准退休去干我最想干的事情——那就是每天和年轻人在一起,教授他们,更重要的是,向他们学习。
Why do I want to tell you the boring story of a personal life? Because I can't help offering you my advice, having made so many mistakes and suffered so many detours.Here are the few things I learned in life in the vain hope that you would avoid them.为什么我想向你们讲述我自己没有多大意思的人生经历?因为我在犯过如此多错误、走过无数次弯路之后,忍不住想提供给你们一些我的建议。下面就是我的一点人生体会,希望你们能够有所感悟,避免走我所走过的弯路。
1.Different views, different people, different culture and different ideology may not necessarily a bad thing.They just teach you to be more tolerant and open minded.Vive la difference, as the French would say.1.不同的思想、不同的人、不同的文化以及不同的意识形态或许并不是一件坏事。他们只是在教你更加宽容,保持更加开放的心态。就像法国人说的那样,Vive la difference(差别万岁)。
2.Taking hardship is not necessarily a bad thing, it may pay in the long run.Of course in the long run we will all be dead, as Maynard Keynes said.And that's why we need the next suggestion.2.吃苦或许不是一件坏事,总有一天你会获得回报。当然凯恩斯也说过:从长远来看,我们都会死的。但这也就是为什么我们需要下一个建议。
3.Taking the road less travelled is not necessarily a bad thing, it just makes your life much more interesting.Let's try to live an interesting and significant life.3.另辟蹊径走自己的路或许不是一件坏事,这只是意味着我们的生活会更加精彩。让我们尝试去过一种精彩并且有意义的生活。
4.Setting high material demands in this world today is not necessarily a good thing, as it may keep you from realizing your ideals or keeping your vision.在当今社会,对物质生活的过分追求或许不是一件好事。因为这将使你远离梦想,不能开拓你的视野。
I want to leave you today with the words of the great American poet, Max Ehrmann because he said it infinitely better than I can.Hope you guys can remember this as you go forth.最后,我想送给你们伟大的美国诗人Max Ehrmann的诗篇,他讲得比我好多了。我希望你们在前行的道路上,能够记住这首诗。
Go placidly amid the noise and haste, and remember what peace there may be in silence.As far as possible without surrender be on good terms with all persons.Speak your truth quietly and clearly;and listen to others, even the dull and the ignorant;they too have their story.Avoid loud and aggressive persons, they are vexations to the spirit.If you compare yourself with others, you may become vain and bitter;for always there will be greater and lesser persons than yourself.Enjoy your achievements as well as your plans.Keep interested in your own career, however humble;it is a real possession in the changing fortunes of time.Exercise caution in your business affairs;for the world is full of trickery.But let this not blind you to what virtue there is;many persons strive for high ideals;and everywhere life is full of heroism.Be yourself.Especially, do not feign affection.Neither be cynical about love;for in the face of all aridity anddisenchantment it is as perennial as the grass.Take kindly the counsel of the years, gracefully surrendering the things of youth.Nurture strength of spirit to shield you in sudden misfortune.But do not distress yourself with dark imaginings.Many fears are born of fatigue and loneliness.Beyond a wholesome discipline, be gentlewith yourself.You are a child of the universe, no less than the trees and the stars;you have a right to be here.And whether or not it is clear to you, no doubt the universe is unfolding as it should.Therefore be at peace with universe, and whatever your labors and aspirations, in the noisy confusion of life keep peace with your soul.With all its sham, drudgery, and broken dreams, it is still a beautiful world.Be cheerful.Strive to be happy.在嘈杂和匆忙中,平静地前行吧,也别忘了在寂静中,能找到多好的安宁。
可以的话,尽量不放弃原则而与所有人和睦相处。
细语清晰地说出你的肺腑之言,也聆听别人的说话,别人的话纵然又枯燥又无知,总会有他们的故事。
避开大声说话和好斗的人;他们是扰乱心性的人。
不要跟其他人比较,否则可能变得虚荣自负或忿忿不平,因为一定有人比你伟大,也一定有人比你渺小。
享受计划,也享受成就。无论自己的事业有多卑微,维持对它的兴趣;
在一生多变的命运中,它是你真正拥有的东西。
谨慎处理生意,因为这世界充斥着欺诈。
但是,不要因此而看不见人间美德; 很多人为崇高理想而奋斗,生命到处都有英勇的事迹。
做你自己。
尤其不要虚情假意。但也不要把爱视为虚伪;
因为尽管生命有时枯燥乏味、有时令人迷醉,爱,却如青草般日久常在。不轻视因年老而获得的阅历,并得体地舍弃年轻时拥有的东西。培育心灵上的力量,以面对突然而来的不幸。
但不要杞人忧天以致心神不宁。众多的恐惧,源自疲乏和孤独。要既不踰矩,又善待自己。
你是宇宙的孩子,身份不次于树木和星星;
身处这里是你的权利。不管你是否明白它的奥秘,毫无疑问宇宙在按其规律展现自己。因此,不管在你心中宇宙是什么模样,和他和睦相处吧。
也不管你怎样劳累和胸怀大志,在生命的烦嚣和困惑中,要保持心灵上的安宁。
不管经历了多少伪善、苦役、和破碎的梦,世界依然是美丽的。要保持轻松开朗。要努力让自己快乐。
第二篇:杜克大学毕业典礼苹果CEO库克震撼演讲:请无所畏惧!
月13日,杜克大学举办了2018届学生的毕业典礼。苹果公司首席执行官蒂姆·库克(Tim Cook)作为校友重返母校,进行了一场毕业演讲。演讲围绕着“无所畏惧”(Be Fearless)展开,鼓励新一届的毕业生们勇敢地做出改变。
美国当地时间2018年5月13日,杜克大学举办了2018届学生的毕业典礼。苹果公司首席执行官蒂姆·库克作为校友,重返母校,进行了一场震撼人心的演讲。
演讲围绕着“无所畏惧”(Be Fearless)展开,鼓励新一届的毕业生们不要默守陈规,不要因循守旧,要敢于想,要敢于突破。
库克还在演讲中提到了一些社会问题,比如:气候变化、枪支暴力和“Me too”运动等。他还鼓励年轻人与不公正、不平等的行为作斗争。

Hello Blue Devils!It is great to be back at Duke.It is an honor to stand before you both as your commencement speaker and a graduate.Hi,蓝魔们(杜克大学别名),我很高兴回到这里。很荣幸能够站在大家的面前进行演讲,你们都是毕业典礼的主角,也是杜克大学最新的毕业生。I earned my degree from the Fuqua School in 1988.In preparing for this speech, I reached out to one of my favorite professors from back then.Bob Reinheimer taught this great course in management communications, which included sharpening your public speaking skills.我在1988年获得了杜克大学福库商学院的学位。在准备这次演讲的时候,我与当时自己最喜欢的一位教授取得了联系。他的名字叫做Bob Reinheimer,负责“管理交流”课程的教学,这门课程可以提高你的演讲技巧。
We hadn't spoke for decades.So I was thrilled when he told me he remembered a particularly gifted public speaker who took his class in the 1980's with a bright mind and a charming personality.He said he knew way back then this person was destined for greatness.我们已经有几十年没有联系过了,所以,当他告诉我,我能够回到母校进行演讲后,我非常激动。他说他在定演讲人选的时候,想起了一位自己在上世纪80年代教过的学生,不仅极具演讲天赋,而且还有聪明的头脑和迷人的个性。他说,他当时就知道,这个人注定不平凡。

You entered the world at a time of great challenge.Our country is deeply divided, and too many Americans refuse to hear any opinion that differs from their own.Our planet is warming with devastating consequences.And there's some that even deny it is happening.Our schools and communities suffer from deep inequality.We fail to guarantee every student the right to a good education.你进入了一个充满挑战的世界,美国面临着深刻的分歧,太多的美国人拒绝倾听与自己相左的意见;我们的地球正在变暖,未来会有灾难性的后果,但依旧有很多人不以为然;我们的学校和社区正遭受着巨大的不平等,无法保证每一个学生都有权利接受良好的教育。

That makes this the best time in history to be alive.Whatever you choose to do with your life, wherever your passion takes you, I urge you to take the power you have been given and use it for good.Aspire to leave this world better than you found it.这是历史上最好的时代。无论你选择如何对待你的生活,也不论你的热情会将你引向何处,我都会鼓励大家接受赋予你们的力量,并用其向善。去给你最初认识的这个世界增添美好。I didn't always see life as clearly as I do today.But I've learned the greatest challenge of life is knowing when to break with conventional wisdom.其实,我并不总是能像此刻这样清晰地认识生活,但我已经知道人生最大的挑战就是拥有知道何时应该打破传统的智慧。
Don't just accept the world you inherit today.Don't just accept the status quo.No big challenge has ever been solved and no lasting improvement has ever been achieved unless people dare to try something different.Dare to think different.不要只是一昧地接受你今天所继承的世界。不要只是接受现状。
除非我们敢于尝试、敢于思考不同的东西,不然所有的困难都无法解决,我们也无法实现持久的进步。I was lucky to learn from someone who believed this deeply.Someone who knew that changing the world starts with following a vision.Not a path.He was my friend and mentor, Steve Jobs.我很幸运,能够从一位坚信这个理念的人那里学到很多东西。他之所以能够改变世界,就是因为他坚信要追随自己的理想,不因循守旧。他就是我的朋友兼导师,史蒂夫·乔布斯。
Steve's vision was that great ideas come from a restless refusal to accept things as they are.Those principles still guide us at Apple today.We reject the notion that global warming is inevitable.That's why we run Apple on 100 percent renewable energy.史蒂夫的远见是,伟大的想法来自不安的内心以及拒绝默守陈规。这些原则今天仍然指引着苹果公司的发展。我们反对全球变暖不可避免的观念。这就是为什么我们要用100%可再生能源来维持苹果公司的运营。

In every way at every turn, the question we ask ourselves is not what can we do, but what should we do?
Because Steve taught us that's how change happens.And from him, I learned to never be content with the way that things are.在每一个方面,在每一个转折点,我们要问自己的问题不是“我能做什么”,而是“我应该做什么”。
因为乔布斯让我们看到改变是如何发生的。从他身上,我学会了永远不要安于现状。
I believe in mindset comes naturally to young people.And you should never let go of this restlessness.So today's ceremony isn't just about presenting you with a degree.It is about presenting you with a question.How will you challenge the status quo? How will you push the world forward?
我认为这种心态对年轻人来说很自然的。你们不要放弃这种年轻人的特质。所以,今天的典礼不仅是向你们授予学位,更是为了向你提出一个问题:你将如何挑战现状? 又将如何推动世界向前发展?
years ago today, May 13, 1968, Robert Kennedy was campaigning in Nebraska and spoke to a group of students who were wrestling with the same question.Those were troubled times too.The U.S.was at war in Vietnam.There was violent unrest in America's cities.And the country was still reeling from the assassination of Dr.Martin Luther King a month earlier.50年前的今天,1968年5月13日,罗伯特·肯尼迪在内布拉斯加州进行了竞选活动,并与一群面临同样问题的学生交谈。

President Brodhead, Trustees, members of the Duke University Community, thank you for inviting me to come back to my alma mater for this important occasion.I am grateful for the honorary degree, and moved by the opportunity to address the graduating seniors.To the Class of 2013: Let me start by saying congratulations......and by reminding you to thank your mothers and wish them a happy Mothers' Day......and by admitting that I'm still bitter about the Louisville game.I was a student here in 1986 when Coach K took the team to the finals for the first time.We lost to Louisville then, too, so you and I share that particular agony.However, you had the good fortune to be here on campus when Duke won its fourth national championship.I never got to see us cut down the nets, but I did see us beat UNC, in Chapel Hill, when Michael Jordan was the star of the team.The fact that Michael Jordan recently turned 50 years old tells you how long it's been since I was a student.No matter how much time passes, though, I always feel connected to Duke.I love visiting my favorite landmarks, especially the Duke Gardens, where I used to go when I was stressed out before exams and needed to clear my head.I went yesterday, because I wanted to make sure I was centered before giving this speech.There's also my feeling of deep connection to the community my classmates created during our four years, and to the lifelong friends I made here--in short, to the people.I doubt there is a word that captures the combination of experiences and places and people that we summarize under the label “Duke.” The best one I can think of is “connected.” And this is a word I'd like to talk about for a few minutes on your Commencement Day.In August, 1982, I left my home in Dallas, Texas, to come here to Durham.To mark this rite of passage, my parents gave me a terrific present: the cutting-edge Olympus B12 portable typewriter, with a carrying case included.One of its best features was how light it was: Amazingly, the whole bundle weighed just 12 pounds!
It was during my time at Duke that the personal computer displaced the typewriter as the technology of choice on campus.Those of us in the computer science department actually resented the change.There were so few computers available, and all of a sudden the humanities majors were hogging our machines to write their papers.We had to do our programming in the middle of the night, usually in the creepy basement of the old biological science building.We'd set up contests--who programmed the fastest or made the fewest mistakes--kind of like a prehistoric hack-a-thon.The punishment for the losers was a trip to the biology lab at the end of the hall, where they had to touch the scariest mutant frog specimens.CONNECTION, AN INTRODUCTION
The personal computer--and later, after I'd graduated and taken a job at Microsoft, the Internet--started a communications revolution.My kids are a few years younger than you, but raising them has proved to me that the way you communicate is the single biggest difference between you now and me a generation ago.One popular way of describing this aspect of your lives is to say that you're “connected.” Some pundits have even started to refer to you as Generation C.One recent report overdid the c-thing by saying you are “connected, communicating, content-centric, community-oriented, always clicking.” It went on to say that, for these reasons alone, you will “transform the world as we know it.”
Of course, all the hype about how connected you are has contributed to a counter-narrative--that, in fact, your generation is increasingly disconnected from the things that matter.The arguments go something like this: Instead of spending time with friends, you spend it alone, collecting friend requests.Rather than savoring your food, you take pictures of it and post them on Facebook.I want to encourage you to reject the cynics who say technology is flattening your experience of the world.Please don't let anyone make you believe you are somehow shallow because you like to update your status on a regular basis.The people who say technology has disconnected you from others are wrong.So are the people who say technology automatically connects you to others.Technology is just a tool.It's a powerful tool, but it's just a tool.Deep human connection is very different.It's not a tool.It's not a means to an end.It is the end--the purpose and the result of a meaningful life--and it will inspire the most amazing acts of love, generosity, and humanity.In his famous speech “Remaining Awake Through a Great Revolution,” Martin Luther King Jr.said, “Through our scientific and technological genius, we have made of this world a neighborhood and yet we have not had the ethical commitment to make of it a brotherhood.”
With 50 years of hindsight, I think it's fair to say Dr.King was premature in calling the world a neighborhood.Back then, Americans lumped whole continents into something they referred to as the Third World, as if the people on the other side of the planet were an undifferentiated mass whose defining feature was that they were not like us.But as a result of the ongoing communications revolution, your world really can be a neighborhood.So the ethical commitment Dr.King spoke of is yours to live up to.What does it mean to make of this world a brotherhood and a sisterhood? That probably sounds like a lot to ask of you as individuals, or even as a graduating class.I'm pretty sure none of you will respond to the annoying question “What are you going to do after graduation?” by saying “I plan to have the ethical commitment to make of this world a brotherhood.”
But you can change the way you think about other people.You can choose to see their humanity first--the one big thing that makes them the same as you, instead of the many things that make them different from you.It is not just a matter of caring about people.I assume you already do that.It's much harder to see all people, including people whose experiences are very different from yours, as three-dimensional human beings who want and need the same things you do.But if you can really believe that all 7 billion people on the planet are equal to you in spirit, then you will take action to make the world more equal for everyone.PAUL FARMER, TESTAMENT TO CONNECTION
Paul Farmer, the Duke graduate I admire most, is a testament to the deep human connection I'm talking about.As many of you know, Paul, who's here today, is a doctor and global health innovator.For years, he traveled back and forth from Boston, where he is a professor of medicine, to Haiti, where he ran a health clinic giving the highest quality care to the poorest people in the world.Now, he lives mostly in Rwanda, where he's working on changing the country's entire health care system.I first met Paul in 2003, when I went to see him in Haiti.It took us forever to walk the 100 yards from our vehicle to the clinic because he introduced me to every single person we met along the way.I am not exaggerating.Every single person.As we moved along, he introduced each person to me by first and last name, wished their families well, and asked for an update about their lives.He hugged people when he greeted them and looked them in the eyes throughout each conversation.If you believe love plays a role in healing, there was healing happening at every step of that journey.When we finally reached the waiting area outside the clinic, I saw a lovely garden with a canopy of flowering vines.Paul told me he built it himself, for two reasons.First, he said, it gets hot, and he wants to his patients to be cool in the shade while they wait.Second, he wants them to see what he sees, the beauty of the world, before they have to go into the clinic for treatment.The next day, I visited a different clinic in Haiti.The clinic was there for the same reason as Paul's--to provide poor people with the medical care they desperately need but cannot afford.The doctors worked there for all the right reasons.But I noticed that the patients were waiting outside in the scorching sun.Inside, it felt like the doctors considered themselves health providers, and the patients were recipients.There was no sense, as there was in Paul's clinic, of an equal partnership with the community.Experiencing those two clinics one right after the other showed me that Paul made a moral choice to do the hard work of deep connection.He took the time to do the little things: provide shade, remember surnames, and make eye contact.These small acts were born of a big idea--the boundless dignity of all people.

一、珍重自己(2002届)
你们即将远航。不论你们在校期间曾有过多少抱怨,有过多少不快,或对我或其他老师有什么不满,现在都请你们原谅,并且都正在过去;“而那过去的事”,如普希金所言,“都会变成甜蜜的回忆”。我相信,无论你们到天涯海角,北大,北大法学院都会不时在你们的梦境或闲谈或周围的议论中出现。当你们成功时,人们会说,没说的,北大的!当你们平庸时,人们也会说,还是北大的!乃至当你们失败或丢脸时,人们还会说,看看,居然是北大的!
是的,北大,北大法学院已经是你们生命的一部分了,是你们无法挣脱的一部分了。
但北大不能注定你们的命运。尽管你们已经成为品牌的象征,尽管随着中国市场经济的发展,品牌的效应肯定会日益显赫,但无论成功和失败最终都将属于你们自己的努力。而我们,永远只能用欣赏的、惋惜的、感叹的目光看着你们。我们不可能替代你们。“你就是你,我就是我,即使你在那里苦苦挣扎,我也只能默默注视。”人生的相互间性注定了也界定了我和你,界定了你们各自的区别,一个永远无法抹去的个体的区别。
因此,在这临别之际,我必须告诫你们:珍重自己。
珍重自己,并不只是珍重身体;更重要的是要珍重自己的才华,要珍重自己才华的运用。在未来的航程上,最危险的并不是漩涡、暗礁、惊涛、骇浪,而是古希腊神话中塞壬女妖,她用迷人的歌声诱惑那些无畏且高明的水手,最终导致过往船只触礁沉没。而这种诱惑,在当代中国社会转型期间,可能尤为突出。社会旧有的控制体系在一定程度上已经功能失调,现代的以法治为中心的社会控制体系尚未完成,因此在这一时期,种种诱惑可能驱使你们用自己的才智以各种名义、甚至以法治的名义干一些不道德的事、违法的事,龌龊的事、卑鄙的事;甚至做了,也可能不会被抓到,不受惩罚,特别是因为你有超过常人的聪明和才智。但我必须提醒你们,有许多事,如果你的良心不能认同,就一定不要做,一定不能做。是的,也许你会得逞于一时或一事,但这个社会是在变化的,相信法治会越来越细密严格,而法治不仅会给你更多的自由和权利,同样法治也会剥夺你另外一些所谓的自由或权利——如果这些自由触犯了他人的自由的话。说不定那一天你就会面临一次无法挽回的失败,带来一次终身的耻辱;就算你逃脱了,你的良心也可能终身追逐你——假如你还有良心的话。俗话说,不是不报,时辰未到。是的,你们聪明智慧,但是一定要知道,聪明和智慧本身并不能保证聪明才智的正当运用;干坏事的其实更多是聪明人。聪明才智也许可以保证你未来的富贵荣华,但不能保证你们未来的坦然幸福,更不能保证我们会为你们骄傲,母校和祖国会为你们骄傲,你的父母亲人会为你骄傲。
我们当中没有谁会愿意成为成克杰、胡长清、慕绥新;但是千万不要以为你我与这些共和国所不齿的人、这些被钉在历史耻辱柱上的人之间有什么不可逾越的、截然分明的界限。其实,我们和他们都是人,我们和他们的差别也许仅仅在人生的某一步以及后来的某几步。不错,每个人的生命都是自己创造的,但创造并不意味着只会成为英雄,其实,赖昌星也认为自己是个生命的创造。
二、这一个大学生活的尾巴(2003届)
第一句更多是说给马上要走向工作岗位的同学的,一句大实话:社会和学校很不一样。在校园里,个人努力也起作用,但作用更大的其实是天分。老师不要求你们的物质回报,只要你考试成绩好,人格上没有大毛病,基本上就会获得老师的欢心,就会获得以分数表现的奖励。在这个意义上,大学基本是一个“贤人政治”或“精英政治”的环境,更像家庭,评价体系基本由老师来定,以一种中央集权的方式,奖励的是你的智力。社会则很不同。社会更多是一个世俗利益交换的场所,是一个市场,是“平民政治”;评价的主要不是你的智力优越(尽管你的聪明和智慧仍然可以帮助你),而是你能否拿出什么别人想要的东西;这个标准不再由中心——老师——确定,而是分散——由众多消费者——确定的。因此,尽管定价178元,不到十天,3千册英文版《哈利波特与凤凰令》在北京新华书店已经脱销,而许多学者的著作一辈子也卖不了这么多,甚至只能“养在深闺人未识”;也因此,才有了“傻子瓜子”年广九,才有了“搞导弹的不如卖茶叶蛋的”,才有了IT产业中的退学生现象(大家还记得甲骨文公司首席执行官埃里森2000年在耶鲁大学毕业典礼上的讲话吗?)。这种“脑体倒挂”,不完美,但也恰恰表明了市场的标准,人类的局限——你甭指望通过教育或其他,把消费者都变成钱钟书或纳什。因此,我们的同学千万不要把自己16年来习惯了的校园标准原封不动地带进社会,否则你就会发现“楚材晋不用”,只能像李白那样用“天生我材必有用”来安慰自己,更极端地,甚至成为一个与社会、与市场格格不入的人。
尽管社会和市场的手是看不见的,但它讲的却都是看得见摸得着的;它不讲期货,讲也都是将之转为现货。你可以批评它短视,但它通常还是不会,而且没有义务,等待你成长和成熟。它把每个进入社会的人都当作平等的,不考虑你刚毕业,没有经验。如果你失去了一次机会,你就失去了;不像在学校,会让你补考,或者到老师那里求个情,改个分数。“北大学生有潜力、有后劲”;别人这样说行,你们自己则千万不要说,也不要相信。这种说法不是安慰剂,在某种程度上,实际上就是说你不行,至少现在不行。如果你有什么素质,有什么潜力,有什么后劲,你就得给我拿出来,你就得给我变成实打实的东西——也许是一份合同起草,也许是一次成功诉讼。
我们每个人都只能生活在日常的琐细之中。
因此,第二句话,要安分守己,这是对每个同学说的。这句话对于我们这个时代也许过时了,但对你们,可能还不过时。因为我从来也不担心北大的毕业生会没有理想以及是否远大,而更多担心你们能否从容坦然面对平凡的生活,特别是当年轻时的理想变得日益遥远、模糊和暗淡起来的时候;还因为,我要说,几乎——如果还不是全部的话——每一个雄心勃勃的人都注定不可能完全实现他的理想。我当然希望而且相信,你们当中能涌现杰出的政治家、企业家、法律家、学问家,但只可能是少数——多了就挤不下了,多了也就不那么值钱了——边际效用总是递减的。无论在世俗的眼光还是在自我评价中,绝大多数人都必定是不那么成功的。但是,我们要知道,成功并不必定同幸福相联系,所谓的不成功也未必等于不幸福。因此,在你们离开校园之际,你们不仅要树立自己的雄心,更必须界定自己的成功。
三、走不出的背景(2004届)
明天,你或许会坐在建国门外的某间写字楼中,从深色的玻璃墙后,俯瞰着窗外公路上的车流,无声地涌动;也不无可能,后天,你会在谈判桌上同外国同行bargain投资甚或并购索尼、宝马或通用公司的问题„„
但是,玻璃墙隔离了城市的喧闹,会不会也隔离了你对城市以外的感知?成天的飞来飞去会不会令你疏远了土地,走南闯北多了会不会什么都看不到了,或懒得看了?成堆的文件让你变得更务实了,但会不会也让你变得漠然?严谨的法条让你的思维更象法律人了,但会不会使你的判断远离普通人?不错,知识改变命运,也确实改变了你的命运;但如同从老子、卢梭到王朔和波斯纳说过的那样,知识也会败坏人的纯朴天性。知识不可能令你消除困惑和烦恼。你不可能拿着法理学要点去面对生活,“法律信息网”中也没有诊治人生的良方。当某个午夜从律所加班归来,打开房门,你是否会感到孤独,或有种“梦里不知身是客”的恍惚?而且,你们还有时间,或还有心情同你的父母对话吗?说得更俗一点,你会不会忘了自己姓什么?
因此,我建议,如果遇到了一些就是“找不到感觉”或是“剪不断理还乱”的问题,无论是个人的还是社会的,你都可以甚至应当问一问你的父母,或设想一下他们的可能回答,即使他们的言词不那么雄辩,不符合教科书上的定义,甚至不符合什么“历史潮流”。也不是说你一定要听父母的话,那不可能。但如果你要真正能做大事,而不仅仅是当一个“知道分子”,那么起码你要能够同你的父母对话;你们要能理解他们的好恶,他们的情感,他们的愤怒和担心,他们的直觉、想象和判断,甚至他们的错误和平庸。否则,谁还能指望你有能力同无数的普通人对话?而你的成功,又能与谁分享?
四、你得是有出息的孩子(2005届)
其实外面的世界确实很精彩。走出大学校园,你会发现我们这个社会,这个国家,充满着活力。当然,活力并不都是美好、清新、温情脉脉的,吉它、摇滚和玫瑰花;社会中的活力常常很“糙”,更多野性、欲望和挣扎,还有你们要时时提防的贪婪、阴谋和背叛—— 一如桑德堡笔下的《芝加哥》。但这就是真实世界的活力,伴随着小麦颜色的农民工、水泥森林和汽车尾气中灰蒙蒙的朝阳,以及我们这个民族的身姿一同在这块土地上崛起。按照一种说法,一个男人(其实女人也是如此)不成熟的标志就是他(或她)还愿意为某种东西(甚至包括爱情)献身。咋看起来,这好像是对我们这些理想主义者的一个讽刺。其实不然。这句话只是从另一个角度揭示了生活,暴露了那种浪漫主义的理想主义之脆弱和虚妄。献身其实是比较容易的,也许只要一丝血性,一点勇气,有时甚至只要一分冲动。但这往往不能改变什么,最多只满足了青春期那一份个人英雄主义的激情。激情过后,则往往是空虚、失落,甚至堕落。然而,真正的理想主义往往在激情之后。它不是夏日的骄阳,而是秋日的明亮,它要经受时光的煎熬和磨砺,要能够接受甚至融入平和、平凡、平淡甚至看似平庸的生活,从容但倔强地蜿蜒,在不经意中成就自己。它常常包含了失败甚至屈辱,还必须接受妥协、误解、嫉妒、非议。它同坚忍相伴,它同自信携手。
也因为理想并不完全是个人的选择,在相当程度上,它是社会的构建,基于一个人对自身能力、时代和社会环境的理解、判断和想象。你们也不例外。也许你们的理想会显得比我们的,比我们前辈的更宏阔,更高远,但那不过是你们的能力以及北大和今日中国为你们展示了更多选项以及更大的可能性。而我们最关心的是,许多年后,在漫长的再也谈不动理想的年月后,你能否像你所敬重的甚或不那么敬重的前辈那样,拿出一个作品,值得你向世人自豪——即使仅仅如同此刻站在你父母亲骄傲目光中的你?
因此,我希望你们切记,真正的理想,无论大小,无论高下,最终都一定要用成果来兑现,否则最多只是一个令人遗憾的、但对这个世界多一个少一个都没有意义的愿望表达,甚至只是一通大话、一张空头支票或一个笑柄。
我们会宽容、理解并心痛你们必定会有的失败和挫折,但我们祝福、渴望并欣喜你们成功,即使是微不足道的成功——如同当年你跌跌撞撞迈出的第一步。我们并不苛刻。
五、你柔软地想起了这个校园(2006届)
其实入学和毕业都只是人生的片刻。“天地不仁,视万物为刍狗”,想来,在天地的眼中这一刻也不会有什么特别。只是,与之相伴的微笑和泪水表明了我们人类不完全是,或者说注定无法成为,纯粹理性的动物。我们无法超越肉身,成为自己生活的无情旁观者。许多时刻、许多地方和许多人因我们获得了特别的意义——对于我们;我们为它或他或她而感动。
我们是为自己感动:为我们的无知,为我们的年轻;为我们故意装出来的粗鲁和野蛮,为我们掩饰不住的温情与脆弱„„为所有虚度的和没有虚度的时光感动,为我们是那么容易感动而感动;或者,什么都不为,就只是感动,因为我们自恋、敏感和矫情,因为我们率性和真诚。
在这个因市场竞争而日益理性和匆忙的年代,说实话,我希望你们保持这样一份真性情。有所追求但不刻意,渴望成功但也接受平凡,无论是在学业上还是在事业上,无论是从政还是经商,无论是面对爱情还是面对功名。我在其他地方说过,不是一切努力都没有结果,但也不是一切努力都有结果;不是最努力的就一定最有结果,更不是努力就有一个确定的结果。不要把生活变成一项志在必得的竞赛,因为生活不是竞赛。
因此,不要总是拿自己同别人比,无论是昨天的同学还是明天的同事,除非你想把自己往死路上逼,把自己变成别人的影子,把生活变成自己的炼狱。每个人的天分和机会都有差别。
我们当然希望,也相信,你们有骄人的成就;但如果没有,只是做好了自己的事,问心无愧,那就足够好了,那就是有出息。不要仅仅生活在他人的期待中,或者被北大的牌子压得喘不过气来,也千万不要把“明天北大为我而自豪”太当真。什么地方规定了北大的毕业生就不能平凡、平庸甚或是失败?就不能比别人收入低,房子小,就必须有车?请记住你父母亲的话,一句老百姓的话,“平平安安就是福”。
也因此,你们千万不要上了某些法学教科书的当,总觉得,或刻意寻找,社会或某个人欠了你什么,这里没有起点公平,那里没有结果公平。一不小心,你会把一生都用来挑剔抱怨了。生活从来就有许多偶然、意外,幸与不幸,以及许多你认为的不公平,无论是在事业上还是在情感上。但无论什么,都只能面对,那为什么不从容一些——人所谓的荣辱不惊?其实,你走进和毕业于北大法学院,虽不是纯属偶然,但也并非天经地义;其中就可能有一丝幸运,而你这一丝幸运的背后或许就有你的许多不知名同代人的失落、遗憾甚至不公平感。我当然不是在劝说你们听天由命;你们一定不会。我想告诉你们的只是,愤懑和抱怨都是沙漠,山野丛莽间的杜鹃才会让你懂得什么叫做怒放;当你抱怨时,你就是在毁灭你的当下,就正在失去创造和享受生活的这一刻。如果你看不清这一点,你就不会有幸福,也不配享受幸福。
六、走出校园(2009届)
你们就要走出校园了,有些话老师该说不说,那就是失职。因此,趁今天这个场合,我首先代表北大法学院和全体老师祝贺你们;也感谢你们多年的努力,造就的不仅是你们,还有我们,此刻的成就感;但还想唠叨几句。话题是几年前看电影《天下无贼》留下的,一直耿耿于怀。
影片中,傻根忠厚老实,对所有人都没戒心、不设防。怀了孕的女贼(刘若英)突然良心发现,想保护傻根,生怕他了解了生活真相,失望、受伤或学坏,愿意他“永远活在天下无贼的梦里”。男贼(刘德华)则认为,不让一个人知道生活的真相,就是欺骗;生活要求傻根必须聪明起来;而一个人只有吃亏上当受过伤,才能重获新生。他强悍地反问:“[傻根]他凭什么不设防?他凭什么不能受到伤害?凭什么?就因为他单纯,他傻?”
这是两种教育理念的尖锐论战。都有道理;道德高下也并非一目了然。今天中国几乎所有的父母、老师更多偏向刘若英。不是不知道生活有阴暗面,但怕年轻人学坏,不让他们接触,最多来些话语谴责。我们太注意区分知识的善恶,与时俱进,还搞了各种各样的政治正确。似乎只要严防死守,像对付萨斯或“甲流”一样,或是装上个“绿坝”什么的,就不会有人感染,就能消灭病源,最终培养出一批时代新人,全面提升人类的道德水准和生活质量了。也就二十年吧,说是不能让纯真的心灵受伤,以保护隐私、防止歧视为名,我们就进步(或堕落?)到从小学到大学都不公布考试成绩了!
鸵鸟战术不可能成功,校园也非净土;我只是担心有人被忽悠了。真傻还不要紧,傻人有傻福——想想傻根;而“天真是冬天的长袍”,能帮助我们抵御严冬。我最担心的是,过于纯洁、单
一、博雅或“小资”的教育,一方面让人太敏感、太细腻,一方面又会让人太脆弱。考试不好都“很受伤”,那考不上大学呢?求职或求爱被拒呢?更别说其他了。瓷器太精致了,就没法用,也没人敢用。生活中谁还没个磕磕碰碰?!
也确实很难接受刘德华的“残酷教育”,更无法实践。影片中,刘德华也没做到;他还是倒下了,为保护梦着天下无贼的傻根。更可怕的是,刚听罢“无毒不丈夫”,一转身,理论联系实际,活学活用,李冰冰就满含热泪恳请原谅,把自己的导师交给了警察;老奸巨猾的黎叔只能连连感叹“大意了”。一个字——报应!
莫非我们和刘若英一样,“怕遭报应,想做点善事积点德”。但一时的善良会不会变成长远的残忍?而且,我们真的善良吗,或只是为了证明我们善良——其实证明的是我们的虚幻、虚弱并因此是虚伪?
这是教育的深刻且永远的两难。由此才能理解中国古代的“易子相教”、斯巴达教育以及毛泽东的“大风大浪培养革命事业接班人”。但这还只是生活磨难的替代品;严苛不让人长记性,吃一堑才能长一智。我有时甚至怀疑,今天大学搭起的知识殿堂,只是暂时搁置、部分隔离、更多是推迟了你终将面对的严酷,也缓解了我们内心深处的疑虑和不安。
知识也未必能走出这个困境,尽管我们常常王婆卖瓜,说什么“知识改变命运”。这话没错,但弄不好也,甚至很,误人子弟。它夸大了知识、博学、思想和理念的作用,捎带着也就夸大了知识传授者的意义;却低估了行动的意义,更严重低估了行动者的艰难。其实,至少我,或许还有其他老师,选择校园并不只因为酷爱学术、追求真理,还部分因为读书比做事、特别是比做成事更容易,也更惬意。校园教育注定是残缺的。它确实拓展了你某些方面的想象和思辨能力,却也可能因此弱化了你应对和创造生活的能力。
出于责任,而不是愧疚,我把这些困惑和担忧,包括自身局限,都告诉你们。就是没法给你一张IQ卡,也没有密码;而且“是真没有”,即使“这可以有”,即使你像范伟一样举着斧子。希望你们重新审视并尽快走出校园。不要只用规范的眼光看世界。生活世界一定不规范,有时还抵制规范。不要把符合逻辑或看似普世的话都当真或太当真。生活不是逻辑;真正普世的无需倡导,有人促销的则一定不普世,还可能假冒伪劣。如果没有准备,一旦遇上忽悠行家或策略高手,甚至卑鄙小人,你就会手足无措。无论是消极无为,还是同流合污,即便愤世嫉俗,那也是行动力的丧失。说不定,一次情感创伤就毁了你的善良和未来——想想法大的付成励同学。
你就得像宋丹丹说的,“做人就是要对自己狠一点”;请记住,是对自己。要抗造,经得起摔打,顶得住飞来横祸或无妄之灾。“好人一生平安”也就一只歌,听听就行了。出门被车撞的,并非都是,其实基本不是,不孝子孙或贪官污吏。就算民主法治能让国家长治久安,也消除不了办公室政治。安徒生童话里,你也得走到结尾,才能“从此过着幸福的日子”。
不是说放弃诚实和善良;只是老百姓说的,“害人之心不可有,防人之心不可无”。真正的善良只能出自知情的选择和坚持。
这些话冷峻,却不冷酷,更非冷漠。怎么可能不希望你们每个人都一帆风顺?!只是既然你走进了这个校园,生活在这个世界,你就注定不是为重复昨天的故事,听从教科书的安排。我们只能创造你的此刻,你要创造的却是自己的未来;你要实现的,不是别人——包括父母——对你的期待,而是,最好是,你对自己的期待。你必须有能力承担起想象中你独自无力承担的责任,即便是为人子/女、为人夫/妻,为人父/母或为人师/友。
而且你们是共和国的年轻公民!你们当中应当产生,也定会产生这个国家和社会各行各业的精英,甚至领袖。我们的共和国很快将迎来她的六十周年,但凭什么说你的今生今世或此后,中国就不再遭遇汶川,就没人折腾了,就没人打西藏或台湾或南海的主意了;或贪婪不再引发其他什么全球危机,人类就此与9.11决绝,一路高歌,直奔历史的终结。
过去一年来,我强烈感到,中国不是正走向,而是被推上更大的世界舞台。主要还不是“奥运”,而是金融海啸。当然还有索马里护航、美国要中国为巴基斯坦提供军备以及盘算中的收购悍马或沃尔沃。即使看似波澜不惊,也意味着波澜壮阔、也一定波诡云谲的挑战。不尽是机遇,一定有莫测的风险、陷阱、圈套,弄不好还有灾难。
而所谓精英,就是人们感觉良好,他却见微知著,小心翼翼,默默为整个社会未雨绸缪。这就是先天下之忧而忧。仅有理想、知识或爱心还不够,你们必须,也相信你们会坚定、冷静、智慧和执着;还必须有人准备,紧要关头,挺身而出,当仁不让,承担起对这个民族乃至人类的责任,直至为之献身。这就是后天下之乐而乐。
我不是推荐这条路。没有。我只是指出有这么个选项。和天下的父母差不多,其实,我们更愿意你们平平安安;也算想过,却未必期待你们成为英雄。英雄路注定坎坷,更是狭窄;无人允诺,更没法保证,你选择了,终点就是成功,而不是悲壮。至少,我的这番婆婆妈妈,在很大程度上,恰恰是想到了,你们当中也难免有人失落、失意甚或失败。
但无论如何,我们都祝福你们!北大法学院都祝福你们!
也无论如何,我们都尊重你们各自的选择;并相信你们,会无怨无悔!
七、不可能的告别(2010届)
因为学院换届,各位同学,我原以为今年不用致辞了,可以轻松了;但新班子还没定下来或是没宣布,临了临了,我只好再一次,也是最后一次,在这里代表北大法学院真诚祝贺并欢送你们毕业。尽管有些年了,但致辞还真不是件惬意、风光的事。我嗓子也不行,唱不了高调,还老跑调,每每让那些挤在真理身边的人士听了窝心(都往那儿挤,若是把真理挤掉下去,那可就狼狈了)。而且也就那么些话,真诚的重复还是重复,深情的唠叨也还是唠叨,这两年还有了赝品,今年就有,还不能算什么“山寨版”(差别是声称的作者);因此,我很担心你们厌烦。何况这一次还是临阵磨枪,昨晚和今天一大早我都在办公室写和修改。
但怎么办呢?我们生活在一个日益制度化即所谓法治的时代,不管你愿意不愿意、喜欢不喜欢,都得遵守制度,履行职责。
因此就不全是调侃。因为,法治并非某个文件或书本上那些让一些人热血上头让另一些人昏昏欲睡的语词,而就是现代生活少不了的大大小小的规矩,包括毕业由谁致辞,说些什么,以及怎么说等等,自然也就不得假冒。规矩不一定起眼,有时还让人闹心,却大致能给人们一个稳定的期待。而你即将踏入的社会,就是我们参与创造的这样一个制度网络。她对你会有全新的稳定的期待;你要从更多接受他人的关爱和宽容转向更多地关爱和宽容他人;甚至仅仅因为你北大法学院毕业,要求更高、更苛刻。不错,我说过“发现你的热爱”,那是在新生入学之际,是就大学学习而言;对于毕业生,我的告诫从来都是“责任高于热爱”。记住,承担责任,有时不是因为你喜欢,而是尽管你不喜欢。这是对成人的要求;理解并做到了这一点就算大人了。这或许是毕业对于你最重要的意味。与此相关的则是要守住自己。去年我已说过,大学教育天生有缺陷,还无法弥补。今年再加两句吧:学校会增加你的知识,但知识不等于德性,提升不了人的德性,也增加不了你的判断力和意志。别以为学了多年法律,有了法学学士、硕士、博士学位,嘴边挂着正义,就真以为自己正义了或是比别人更正义。这是一些脑子不清楚或是脑子太清楚的法律人编出来的,忽悠别人,捎带着推销自己,但弄不好也会把自己给忽悠了。想一想,难道学经济的,天天念叨亚当•斯密或成本收益,就个个亿万富翁了?好像(这个“好像”完全是个修辞)比尔•盖茨、斯蒂夫•乔布斯都不是学经济的,还都辍学了。“知识越多越反动”当然不对,但也别以为念过几本书,知道几个词,还会说“我很happy”,人就聪明或高尚起来了。这些年来,我们就生生看着一些法律人倒掉了,学位、地位甚至学问都不低;最近,还包括我们一位86年毕业在商务部工作的校友。我不怕丢人,也不怕这一刻令各位扫兴,提及这位校友,是因为,对于承担更多更大社会责任的精英来说,对于你们来说,这是个真问题,很现实,也很要紧。腐败会追着社会责任,农民工即使想受贿也会受歧视。孔子早就看到了这点,因此他提醒君子——不是普通人——三戒;说的是一回事,就是任何时候,都别光看见眼前那点私利,都别给自己干坏事找借口。如果你能戒,就是君子;没戒或没戒成,就不知该如何称呼你了。君子的界定是行为主义的,不是自我想象的——莎士比亚说过:在恶棍心里,自己也会是个大好人。
人们常说今天是一个充满机遇和挑战的时代,是社会转型、社会道德共识重建的时代。但换个说法,同义反复一下,会让我们看到和想到更多的问题。这句话也是说,今天是一个诱惑很多、外在规范特别是制约不够的年代。这挑战法治,更挑战一个人德性、操守和判断力。如果没有或不足,或是有侥幸心理,你就把握不了自己,容易忘乎所以,随波逐流,一不小心也可能混迹于成功人士。但记住鲁迅先生的话,大意是:如果你真能折腾,真会忽悠,也会小有斩获;但要想凭此成大事,自古以来,门都没有。当外在规范和制约不足时,我们心里就更需要有点荣辱感,也就是当独自面对自己或永恒时,你心头会突然掠过的那一丝莫名的骄傲、自豪和优越感;借用李敖的诗,还“不要那么多,只要一点点”。有了这么一点,你就会更看重做事、努力做成事,而不是太计较所谓的公正回报,也不那么关心或总是关心别人对你的看法;你就可以不要求别人理解和原谅,却可以,恰恰因为你理解了而不原谅、不宽恕某些人,某些事。人生有许多事不值得较真,但有些事必须较真,要对得起自己。如果觉得不该做的,无论是折腾人还是倒腾事,就是不做;该做的,那么,“虽千万人,吾往矣”,爱谁谁!但这不是知识问题;就算是,北大也给不了你。得你自己养成,在一次次艰难有时甚至是痛苦的选择和行动之后。它拒绝机会主义,需要德性,对自己的真诚,有时还要有点血性。听起来像是说教和劝善,其实不是。我55岁了,有点天真,却不只有天真;我也毫不掩饰自己相信后果主义和实用主义(别有人认得这几个字,爱拿北大说事,就以为可以开练了。当心闪了腰!)。我是认为,只有这样,一个人才可能穷达淡定,荣辱不惊,守着自己的那点事业,守着自己的那分安宁,哪怕在世俗眼光中他/她既不富有也不成功,甚至很失败;也只有这样,我们才有一个虽不完美却还是值得好好活着并为之努力的社会,而许多人也会因此多了一个好好活着的理由。就让你我站成这个理由!
难道我们不就是为此才走进北大的吗?尽管,许多同学就要告别这个校园了,我也将告别院长的职责。我们都如流水;我们都是过客。但我们不可能告别北大。北大并不只是一所大学的名字,不是东经116.30北纬39.99交汇处的那湾清水、那方地界,甚至不是所谓的北大象征——“一塔湖图”或墙上铭刻的北大校训。你我都有一个属于自己的北大,包括农园的油饼或二教的自习,一帮子伪球迷半夜爬起来光着膀子看世界杯,或是“淘宝网”上等侯秒杀,当然还有岁末晚会上许校长那并不动人却因此更加动人的歌声,或是那枚从没别上你胸前、已经找不到了却永远别在你心头的校徽„„北大也是近代以来许多中国人的一个梦。你我就生活在,明天则会说曾经生活在,他们的梦中;他们也因此永远生活在你我的梦中了。不是什么庄生梦蝶;我说的只是,因为北大,我们懂得了责任,并且有能力担当。更何况高铁和飞机,google街景、短信以及刚上市的Iphone 4G,已经彻底改变了农业社会的“此去经年,应是良辰好景虚设”。天涯比邻,法学院随时欢迎你回家看看,也会以更多方式与你同在——无论你身在何方!但为什么,为什么呢?穿过时光,穿过南方的山、北方的河,我们祖先的基因又一次跋涉而来,在你年轻的心中撩起了古老的离愁„„
如果实在扛不住,就“小资”一下吧。用剩下的几天,细细体会一下你似乎从未有过的软弱和温情,伤感那“小鸟一样不回来”的青春,告别——在你入学时我祝福的——这段“也许不是你最幸福,肯定不是你最灿烂,但必定是你最怀念的时光!”
然后,我们出发。
这个夏日,北大见证了一批过客,他们要到一个叫做“前方”的地方去!

I was going to speak today about the necessity for an open-mind as you approach new opportunities, new environment and new paradigm, the need to have stamina in times of difficulty and to not be afraid to take the road less travelled.But I believe most of you know this or you wouldn’t be here today in the first place.我今天本来想跟大家讲讲未来当你们面对新的机会、新的环境以及新的模式时保持开放心态的必要性,以及遇到困难时应该怎样保持坚持不懈的努力和拥有另辟蹊径的勇气。可是,我相信在座的大部分人都已经十分明白这些道理,否则你们不会取得今天的成绩。So I'm just going to give you a piece of avuncular advice, tell my story and be boring: 所以我只想从一个长者的角度给你们一点建议,讲讲我的故事,或许这会比较无聊。

As a teenager, I was sent to a railroad construction site deep in the mountains in Western China.Food was rationed and workload was heavy.However, what made it more unbearable was the lack of knowledge and information.I devoured every piece of paper that had any word on it, like a hungry man.Together with a few co-workers we started a study group called “The Communist Laborer's Night School”, with the few old text books we brought with us, and a radio we used to learn English from VOA and BBC, at the risk of imprisonment for listening to “enemy stations”.当我还是一个十几岁少年的时候,我被送到中国西部的大山区里修建铁路。在那里,食物实行配给制并且工作强度很大,所以我们总是处于饥饿状态。但是,更加让人痛苦的是知识与信息的缺失。我贪婪地去看每张偶尔得到的写有字的纸片,如饥似渴。我还和其他几位工友们成立了一个“共产主义劳动夜校”。我们一同学习一些旧课本,冒着被判刑的风险用一台收音机听“敌国电台”:从“美国之音”和BBC学习英语。
After 3 years of hard labor and a head injury, I was given a job in an artillery factory making machine guns.I biked about 10 miles twice a week to learn English taught in the Radio Engineering School of a university in Xi'an.Most of the 200 people quitted the class during the one-year study, and I was one of the dozen remaining, together with the chief engineer of my factory, who later put in a strong recommendation for me to go to college in Beijing, without having ever been to a high school.经过三年繁重的劳动和一次脑部受伤,我被分配到西安一家兵工厂制造机关枪。我每周两次下班后骑自行车去10英里外一所大学的无线电工程系学习英语。在这一年的学习中,200多名学员中的大多数并没有坚持。但是我是那坚持下来的十几个人之一,一同留下来的还有我工厂里的总工程师。他后来在我甚至没有上过高中的情况下强烈推荐我去北京读大学。After graduating from both college and law school in BJ, I was sent as an exchange scholar to work in a law firm in California.Boy I remember the cultural shock I had when I first arrived in SF in 1982!There I realized that my knowledge of law was utterly inadequate to deal with international transactions, which I was supposed to teach back in Beijing.I decided to go through the hardship of studying for a JD degree in the US.That started my honey-decades with Duke law, which gave me a full scholarship and a fuller education in American law.从对外经贸大学的法学硕士班毕业后,我获得了去加州一家律所实习的交换机会。我仍然记得1982年当我第一次抵达旧金山时所能感受到的文化冲击。在那里,当处理一些有关国际交易的案子时,我意识到自己有关美国法律的知识非常匮乏,而这却是我回国之后准备教授的。我决定在美国咬着牙读一个法学博士学位。杜克法学院资助了我全额奖学金让我能够系统地学习美国法律,从此开启了我和杜克法学院长达三十年源远流长的甜蜜之旅。
I was once asked by a hard-struggling law student from China why I seemed so happy and content with my studies then, living mostly in the law library.I answered, if you have experienced the deprivation of knowledge for so long as I have, you would, too, view this place as the heaven of learning.I said that despite the many occasions when a few professors would vote against granting the scholarship to a “red Chinese”, or some fellow students spoke right in my face that they were “abhorred” by the Chinese communist system.When I was later asked of a similar question as a junior associate in the sweat shop of a Wall Street law firm, I happily told the fellow associate that Vladimir Lenin taught me to learn your skills so to dig the grave for capitalism.曾经有一个深受法学院学习压力痛苦折磨的中国学生问过我这样一个问题:“你几乎成天以图书馆为家,为什么还那么开心和满足?”我回答说,如果你像我那样,经历过如此之长的缺乏精神食粮的岁月,那么你同样会把这地方当做是求知的天堂。当然求学过程中也有很多不尽人意之处,比如有那么几位教授反对给我这个来自红色中国的人发奖学金,或者有几位学生曾当面对我说他憎恨中国的共产主义制度。我后来在华尔街一所律所里当律师的时候,也被问到这个问题时,我很开心地回答道,列宁教导我要学习西方的先进知识,才可以为资本主义挖掘坟墓。

Being a regulator is like being a matchmaker, when the marriage is successful, the couple would think it's their own good fortune, will be busy enjoying themselves and very seldom grateful to you.But if anything goes wrong, then both sides blame you for it.I got just that sort of treatment, blamed all the time, for good or bad reasons.I was yanked out of the agency to run the newly established Social Security Fund in 2003, and then, 4 and half years later, the Sovereign Wealth Fund.After almost 7 years serving as an investor, I'm finally relieved of my duty and allowed to retire to do what I love the most, i.e., working with young people every day, teaching and, more importantly, learning.监管者的角色就好比是媒人,如果做媒成功,男女双方会认为这是他们自己的好运气,沉溺于爱河中而没有时间来感谢你。但一旦失败,双方都会指责你的不是。我就获得了那样的待遇:不管是什么样的原因,总是被骂。2003年,我被调离证监会成为新成立的全国社会保障基金的负责人,四年之后,又成为中投公司的总经理。在七年的投资生涯之后,我总算可以卸下身上的责任并且获准退休去干我最想干的事情——那就是每天和年轻人在一起,教授他们,更重要的是,向他们学习。
Why do I want to tell you the boring story of a personal life? Because I can't help offering you my advice, having made so many mistakes and suffered so many detours.Here are the few things I learned in life in the vain hope that you would avoid them.为什么我想向你们讲述我自己没有多大意思的人生经历?因为我在犯过如此多错误、走过无数次弯路之后,忍不住想提供给你们一些我的建议。下面就是我的一点人生体会,希望你们能够有所感悟,避免走我所走过的弯路。
1.Different views, different people, different culture and different ideology may not necessarily a bad thing.They just teach you to be more tolerant and open minded.Vive la difference, as the French would say.1.不同的思想、不同的人、不同的文化以及不同的意识形态或许并不是一件坏事。他们只是在教你更加宽容,保持更加开放的心态。就像法国人说的那样,Vive la difference(差别万岁)。
2.Taking hardship is not necessarily a bad thing, it may pay in the long run.Of course in the long run we will all be dead, as Maynard Keynes said.And that's why we need the next suggestion.2.吃苦或许不是一件坏事,总有一天你会获得回报。当然凯恩斯也说过:从长远来看,我们都会死的。但这也就是为什么我们需要下一个建议。
3.Taking the road less travelled is not necessarily a bad thing, it just makes your life much more interesting.Let's try to live an interesting and significant life.3.另辟蹊径走自己的路或许不是一件坏事,这只是意味着我们的生活会更加精彩。让我们尝试去过一种精彩并且有意义的生活。
4.Setting high material demands in this world today is not necessarily a good thing, as it may keep you from realizing your ideals or keeping your vision.在当今社会,对物质生活的过分追求或许不是一件好事。因为这将使你远离梦想,不能开拓你的视野。

不要跟其他人比较,否则可能变得虚荣自负或忿忿不平,因为一定有人比你伟大,也一定有人比你渺小。享受计划,也享受成就。
无论自己的事业有多卑微,维持对它的兴趣; 在一生多变的命运中,它是你真正拥有的东西。谨慎处理生意,因为这世界充斥着欺诈。但是,不要因此而看不见人间美德;
很多人为崇高理想而奋斗,生命到处都有英勇的事迹。做你自己。尤其不要虚情假意。但也不要把爱视为虚伪; 因为尽管生命有时枯燥乏味、有时令人迷醉,爱,却如青草般日久常在。不轻视因年老而获得的阅历,并得体地舍弃年轻时拥有的东西。
