美国联邦法院的法官必须由总统提名，经过参议院的审议和认可，再由总统正式任命。在美国历史上，总统对法官的任命权一直被行政部门当做控制司法部门的一个重要手段。美国历届总统在任命法官，尤其是在任命最高法院法官时，几乎无一例外地偏向本党党员或至少在意识形态上接近自己的人。虽然这种做法会招来反对党的批评，但已为美国各方政治势力所接受，而国会也极少反对总统对法官的提名与任命。

美国实行法官专职及中立制。即法官不得兼职，包括不得兼任行政官员、议员、除教学以外的其它营利性职务，甚至不得有政党身份或从事政治活动。在西方学者看来，法官只有不从事第二职业并在政治上保持中立，才能得以超然地和真正独立地依法行使职权，否则就有可能受到商业利益、有报酬职务或党派的影响而丧失独立、公正的地位。

法官应是公平的、中立的。法官必须保证律师在出庭时履行职责合法，以便双方在陈述案件过程中处于平等地位。即便是实行陪审团审理案件时，法官也可有巨大的影响。所以，法官必须注意防止任何个人偏见或不公正出现，因为这种现象可能会对陪审团和案件判决结果造成不公正的影响。

法官应具备专业能力，对可能出现的法律事务具有全面的法律知识，充分掌握法律的变化。这要比对律师专业能力的要求更为重要，因为知识渊博的法官可以弥补律师出庭时的不足。法官也应营造一种有条理的工作气氛，在法庭上耐心、威严、谦和地对待诉讼当事人，陪审员和证人，并以同样的举止对待双方律师、法庭成员和其他工作人员。法官应避免在任何公共场合谈论未决案件的情况。

法官应有助于建立、维护和执行相关的道德水平，以保护司法界的团结和独立。在管理本系统成员的行为时，司法部门保留对政府其他部门的独立性。如果一名法官发现另一法官有不道德行为时，有责任采取适当的惩戒措施。法官在法庭上对律师也应具有相同的义务，因为对于律师是否具备有专业能力或违反职业道德，特别是律师无效的和违反规范的行为，法官是最有发言权的。例如，一名刑事辩护律师与其客户发生利益冲突，客户尚未察觉，审判法庭必须通知被告以保护他受到公平审判的权利不受侵犯。

法官在从事法庭以外的活动时，应该避免各种不正当的行为以及不正当的形式出现。如果法官的公正性受到怀疑，他就不能审理案件，因此法官无论何时，个人行为举止都应是值得公众信任和公平诚实的。法官受到公众监督，不得不承受比其他公民更为严格的约束。例如，法官可能无法成为某些机构的成员，因为某些机构的成员资格在种族、性别、宗教或血统上有歧视，这可能引起其他公众成员怀疑法官判案的公平性。法官不得允许其家人或朋友干涉司法行为，不得利用其职位声望谋取利益，法官还不得允许任何人认为某个个人或当事人对他具有特殊的影响力，这些规则都是避免使公众产生类似的印象。

法官仅限于参加纯私人、无公务的活动。他们不得参加有政府背景和公众事务有关的活动。但他们可以针对法律或司法运作撰写或发表演讲和对联邦法院发表建议。法官可以成为旨在促进法律制度的官员，参加慈善或民间活动，但不能引起他公正断案的任何问题，不得从事此类机构的基金捐赠活动。法官处理公务时，不得利用他的地位使其公正性受到影响，或者从事与可能成为其诉讼当事人从事的交易。

为了避免经济方面的利益冲突，联邦法律规定，所有的法官以及其他高层政府官员每年要申报他们自己以及配偶和未成年子女的资产、负债、接受的礼物和报销费用。联邦法官和某些司法部门的官员的财务申报纪录由联邦法院行政办公室保存，可以应公众要求随时提供。

法官不允许参加政治活动、法律执业和经商活动（投资除外）。从工作以外的活动中获得的收入，比如教学，不能超过大约法官工资的15％。

法官的监督机制

法官在美国体制中是独立的，同时，他们对道德法则的违反又受到纪律的约束和公众的监督。首先，法官（像其他公民一样）所承担的道德义务事先以书面文字的形式被明确规定，因此，对于必须达到什么样的标准，法官已经被充分的告知了。其次，任何公民都可以向审查委员会或专家小组就违反司法道德的现象进行投诉。这些委员会和专家小组由法官和一般公众组成。第三，司法审查委员会的意见将被公之于众。

尽管有许多外部机制对法官的权力进行制约，但是在美国社会中法律与法官的最高境界最终归于内部的制约，即法官们的自律。这些人或者放弃了在个人法律执业中赚大钱的机会，或者离开了政府高位和可以为政治家所支配的所有权力。他们这样做在很大程度上是出于一种职业化意识和荣誉感，而这些是对美国法官滥用权力或贪污腐败的成功制约。几乎所有美国人都尊敬和敬仰法官，甚至在并不同意他们的判决时也是如此。

另外，任何人如果认为某个法官的行为对法院工作的高效快捷进行有害，或是某个法官由于身体或是精神方面的缺陷无法履行所有职责，都可以向该法官所在的巡回区的上诉法院投诉。如果投诉中所列举行为不符合法律中对于不当行为或是缺陷的定义，或者投诉与法官判决的好与坏有关，或者投诉属于琐碎小事，该上诉法院的首席法官有权退回投诉。实际上，大多数投诉都被退回。

如果首席法官没有退回投诉，他就必须任命一个由法官组成的特别调查委员会来审查投诉中所说的事件，准备一份书面报告和建议，递交给巡回区的司法理事会。司法理事会在考虑特别委员会的报告后，有权进一步调查投诉内容或是采取合适的措施，包括：要求投诉所涉及的法官自愿退休；证明该法官由于身体或精神缺陷，没有能力继续工作，从而产生一个空缺职位；决定暂时不再分配给该法官案件；公开宣布或者私下宣布对该法官的训诫；采取其他合适措施。

如果司法理事会认为一个宪法第三条规定的法官可能从事了犯罪行为，或者对法官的投诉自己无法处理，必须把此事呈请合众国司法会议处理。司法会议可以投票决定把此事呈请国会，进行可能的弹劾免职程序。实践中，弹劾和免职很少发生，一般是在一个法官已经被判犯有某项严重罪行的情况下。弹劾条款首先在众议院中被考虑。如果众议院投票决定弹劾法官，则这一问题将被移交参议院。参议院是惟一有权对法官进行弹劾的权力机构。在弹劾案中，被弹劾者无权要求陪审团审判。对弹劾决定判决必须由参议院三分之二多数表决做出。弹劾案中的惩罚措施包括撤销职务和不得再任此职。被宣告有罪的当事人也将会被依法起诉、审判和惩罚。

在美国司法实践中，对法官更有效的一种质量监督来自美国的判决体例与大众传播媒介对司法的大量报导。作为习惯法国家，美国的判决体例基本上沿袭了英国的传统：法官判决任何一个案子都采用判决书的形式。判决书的体例通常是：

一、首先对案件所涉及的重要事实做客观的描述与总结；

二、评介原告与被告（或其律师）的主要论点和论据；

三、根据有关法律、适用先例、立法部门的立法意图、对公众利益的考虑等等，对具体案情和法律条文进行推理、分析和论证，做出判决。在很多情况下，判决书就是一篇完整、严谨的论文，它把法官对一个案子的思考和推理完整地记录下来，从而使任何人都能据此对他的判决进行分析与评价，并感到信服。一件案子判决后，判决书通常马上公布。任何人都可以在图书馆查询、借阅。近期的案子和判决书更可以通过电子媒介，在互联网上检索和阅读。这种判决体例给司法活动带来了极大的透明度，成为对法官判案质量的一种有效监督和促进

遥想两百年前，一位年轻的海军士兵正在一艘美国军舰上执行夜巡任务。独立战争甫定，美国又再度与海上霸主英国交恶。这位海军士兵忐忑不安，理由不言自明。英国皇家海军拥有115艘一线作战军舰和126艘护卫舰，而美国海军只有17艘军舰。或许支撑海军士兵的信念源自这

突的结果起到决定性的作用。不过，在面对各种处境时，宪法号军舰很好地完成了自己的使命，“老铁壳”的胜利提振了战争初期美国海军低落的士气。宪法号军舰的功绩体现在托马斯·伯奇的画中、奥利弗·霍姆斯的诗歌中以及詹姆斯·芬尼莫尔·柯柏的散文中。在过去的两个世纪里，宪法号军舰代表着美国的坚强、勇敢和能力。宪法号军舰现在停泊在波士顿港口，至今仍可航行，并以世界上最古老的现役军舰而自豪。

美国主权债务危机背景下的司法成本控制

1812年战争的两百年后，美国面临着新的挑战，包括广为人知的“财政悬崖”以及长期存在过度浪费和新出现的国家债务问题。公众都期望总统能够提出周密的解决方案。站在司法机构的立场，我们置身于政治舞台之外，不过，我们可以继续从自身的角度提出应对财政危机的方案。8年前，司法机构就担负起了这项职责，当时在首席大法官伦奎斯特的领导下，司法联合会率先实施了一项有效的成本控制战略。4年前，我在2008年年终报告中对司法机构所付出的努力进行了概述。现在是时候重提这个主题了。

一如既往的是，司法机构的支出仍然只占联邦预算中极微小的一部分。在2012财政中，包括联邦最高法院、识别并消除超支的情况。然后我们采取了增长上限的方式规定法官等司法机构人员的办公面积，并缓建新项目。在2005财政，办公租金预计平均每年增长6%，到2013年将超过14亿美元。我们努力进行成本控制的成果是，2013财政美国联邦事务管理局暂定的司法机构办公租金总额将少于11亿美元。也就是说，自2005年实施成本控制战略以来，办公租金费用减少了近3.22亿美元。办公租金现在占司法机构工资和费用支出的21%。

不过，我们不能止步于此。我们努力去查明可利用的办公用房提供给司法工作人员，比如缓刑和审前服务官，目前他们仍然是租借办公用房。如果他们能够搬出租借用房，那么就可以减少租金成本。此外，我们不断采取其他方式以更好地利用空间，比如精简图书馆，利用数字图书馆进行收藏，为减少总体的预算支出做贡献。

司法成本控制之司法人员工资

我们也在采取措施控制司法人员工资的增长，这项成本支出占2005财政司法预算的62%。司法人员预算中近85%是用来支付包括书记员、秘书和行政人员的工资。在这方面，进一步节约的办法是有限的。在过去的三年中，司法人员的工资没有发生变化：和其他联邦机构的雇员一

司法成本控制之信息技术的运用

此外，我们还通过加强信息技术的运用来节约支出，该部分费用占2005年法院财政预算的6%。通过采取配置计算机系统管理备审案件目录、管理财务和辅助人员工资与福利等降低成本、提高效率的措施，法院节约了更多的成本。例如，法院已经采取了合并服务器和其他信息技术基础设施的节约措施。这些合并措施将扩展到陪审团管理系统、缓刑案件管理系统和联邦法院财务系统，这样，从2014财政开始，每年可节省几百万美元的支出。作为司法机构全国数据和通讯系统的一部分，法院正在推行一个覆盖全国的“IP语音电话”系统，通过在同一个网络平台上提供数据、语音和视频服务来减少支出。同时，我们不断提高电子数据库利用率以降低购买法律专业书籍和维护传统图书馆的费用。

司法成本控制新举措

联邦最高法院将继续带头控制司法成本。自2004年以来，法院一直在探索如何节约纳税人的钱。在2012财政年

财政困境中坚守司法职责

尽管有财政和资源方面的困难，法院系统依然坚持在最困难的环境下履行职责。我们法院一贯能在最具挑战性的时刻表现出坚韧不拔和刚毅的精神。当飓风桑迪袭击东部沿海时，对公私财产造成了毁灭性破坏，并摧毁了大量必要的通讯和交通基础设施。作为回应，联邦法院迅速行动起来确保司法功能正常运行。不顾个人处境，司法人员坚守工作，并且与陪审员、律师和工作人员保持联络及时处理紧急司法事件。例如，在飓风袭击的第二天，在没有正常暖气和热水供给，仅靠应急燃气发电机提供能源的工作环境下，纽约南部的联邦地区法院依然在下曼哈顿区召开紧急听证会。

两百年来，很多事情一以贯之，没有改变。一直以来，国家感激那些顺应国家需要并为造福美国民众提供忠诚且无私奉献的人们。类似的例子在司法系统举不胜举，在此我只列举其中之一。

康涅狄克州联邦地区法院法官马克·R·克拉维茨，因肌萎缩侧索硬化症——葛雷克氏症于2012年9月30日辞世，享年62岁。他不仅是一名优秀的初审法官，同时也是一位

联邦最高法院——

起诉到最高法院的案件总数从2010司法的7857件下降到2011司法的7713件，下降了1.8％。司法援助案件总数从2010司法的6299件下降到2011司法的6160件,下降了2.2％。收取诉讼费的案件从2010司法的1558件下降到2011司法的1553件，下降了0.3％。在2011司法，共讨论案件79件，73件得到处理，64件签署了正式判决，而2010司法讨论了86起案件，处理了83起案件，75件签署了正式判决。

联邦上诉法院——

联邦地区上诉法院受理的案件上升了4％，共57501件。除民事上诉案件的数量下降1%外，其他各种类型的上诉案件数量均上升了。刑事上诉案件的数量上升了12%。初审案件和破产上诉案件的数量也上升了，随着针对移民

破产法院受理的案件数量下降了14%，为1261140件。破产案件数量在90个地区中有89个地区下降了。非商业案件下降了14%，商业案件下降了16%。与《2005防止滥用破产与消费者保护法》第七章有关的案件下降了16％，与第十一章有关的案件下降了12％，与第十三章有关的案件下降了10％。这是自该法生效后，2007年至2010年积聚了大量破产案件后出现的明显下降。

联邦缓刑与审前程序——

2012年9月30日，被监管的罪犯数是132340人，比上一年的总数上升了2％。从矫正机构释放后接受释放监管的人数增长了3％，达到108372人，是被监管罪犯总人数的82％。2012年，包括审前程序分流案件在内的审前程序案件下降了4％，共109242件。

张文学，男，1964年10月出生，中国共产党党员，大学学历，四级高级法官。1982年6月考入空军航空学校，1988年从空军航空兵部队转业到齐齐哈尔市中级人民法院工作，历任书记员、代理审判员、审判员、副庭长、庭长。现任民事审判第三庭庭长（审判委员会委员），主要负责审理商事、破产、公司清算等案件。

依安县人民法院 付春红

付春红，女，1970年2月22日出生，汉族，中国共产党党员，1991年7月参加工作任依安县第一中学教师，1995年通过公务员考试调入法院，现任依安县人民法院红星人民法庭庭长。

她热爱审判工作，锐意进取，不断创新，一直把让当事人满意作为自己的工作目标，工作中勤勉敬业，任劳任怨，其所审结的案件连续三年居全院之首，多次获得省、市、县法院授予“优秀法官”、“办案标兵”、“调解能手”等荣誉称号，其中 2014年被授予全省法院系统“办案标兵”,齐齐哈尔市法院系统“模范法官”,2015年、2017年两次被授予全省法院系统“调解能手”,2016年齐齐哈尔市政法系统“先进个人”,齐齐哈尔市法院系统“优秀法官”,无论是在县法院还是在社会上都树起了一个法官的良好形象。

注重自身修养，政治、业务素质高。作为法庭党支部书记，她注重政治学习，坚持与党中央保持高度一致，积极把握学习的针对性、实效性，把职业操守强化于行，知行合一。

完善措施抓服务，切实解决告状难。她坚持便民、利民、亲民、护民的原则，完善服务措施。为了方便当事人，她每年巡回审理，就地办案40余次，释法解疑，促进息诉服判，提高了办案的效率，获得当事人的好评。

创新调解方法，化解矛盾促和谐。她本着“能调则调，当判则判，调判结合，案结事了”的基本原则，因案制宜，总结了“冷却降温法、情理交融法、分析疏导法、心理沟通法、借助外力法”等切实可行的调解方法。她还善于发挥联动调解的作用，通过诉前调解的方式，妥善解决赡养、土地等纠纷，取得了双赢的效果。

作为一名基层女法官，她一直兢兢业业，默默无闻地履行着一个法官的神圣职责，以出色的工作，展现一个新时期女法官所独有的魅力。

龙沙区人民法院 孙晓光

孙晓光，男，1962年1月出生，汉族，法律本科学历，中国共产党党员，历任龙沙区人民法院刑事庭书记员、助理审判员、审判员、副庭长，现任龙沙区人民法院刑庭庭长。

30多年来，他在自己的岗位上默默无私奉献、清正廉洁、兢兢业业，共审理了1000余起刑事案件。2013年2月被市法院评为“全市法院优秀法官”,2013年10月，齐齐哈尔市龙沙区人民法院刑事审判庭被最高人民法院评为“全国法院刑事审判工作先进集体”,2016年6月，龙沙区委区政府授予刑事审判庭先进集体称号，2017年2月，市法院授予龙沙区人民法院刑事审判庭集体三等功。

作为基层法院的一名法官，他始终恪守着审判人员的职业道德，牢记审判人员应当遵守的各项纪律，为自己立下了“钱财面前天平不斜心不偏”的诺言。他执法如山，法律面前无私情，维护法律的尊严。在工作中，他用精通的业务知识纠正检察机关错误定性案件多起，经他审理的案件没有上访缠诉的，社会效果较好，他还用业余时间写了多篇有价值的调研文章，被省法学会评为一等奖。

他就是这样恪尽职守，清正廉洁，铁面无私地工作，他的工作作风和两袖清风精神有口皆碑，多年来，他始终将奉献和廉洁放在首位，因为他给自己立下的座右铭是：丹心沥血甘奉献，清正廉洁不染尘。

克东县人民法院 国庆富

国庆富，男，1972年10月出生，汉族，法律本科学历，中国共产党党员，历任书记员、助理审判员、审判员、民一庭副庭长，现任克东县人民法院宝泉人民法庭庭长。

自担任宝泉法庭庭长以来每年处理各类民商事案件超过300件，调解率达到96%,服判息诉率达到98%.2017年审结各类民事案件296件，结案率98.01%.其中调撤结案273件，调撤率达到95.3%.调解案件自动履行率98%.实现了无超审限案件，无因工作不当引发当事人上访案件。案件质量好、办案效率高。2017年院内考评办案数占位第一，调撤案件数占位第一、调撤率占位第一。院内测评为优秀（满意率98%），综合排名第三。

他连续多年被市中院评为“人民满意好法官”、“优秀法官”,被县委县政府授予“优秀共产党员”、“嘉奖、记三等功、优秀政法干警”;多次被市中院授予“调解能手、办案标兵、星级法官”等称号；多次被省法院授予全省法院“调解能手”称号。

在调解工作中，他能够区别不同案件，找准调解不同方向，有针对性的开展调解工作，调动各方积极因素，营造工作亲和力。他采用外围调解法、亲情调解法、淡化对立情绪调解法、冷却处理调解法、下大力气查找被告下落进行调解法，有效化解矛盾纠纷，促进了法律效果和社会效果相统一。“耐心调解出平安、诚信调解换和谐、心系群众息纠纷”始终是他的最终追求。

富拉尔基区人民法院 王谊兰

王谊兰，女，1975年7月出生，汉族，法律本科学历，中国共产党党员，历任克东县人民法院书记员、助理审判员，梅里斯区人民法院助理审判员，富拉尔基区人民法院民庭助理审判员、审判员，现任富拉尔基区人民法院民三庭副庭长。

自参加工作以来她一直从事民事审判工作，先后优质高效地审结了4000多起民事案件，平均每年审结案件近200件，最高曾年审结近400件。因其工作成绩突出，连续多年被评为区优秀公务员，区法院办案能手，多次被评为区法院、市法院先进个人，并分别于2008年，2016年两次荣立个人三等功，2015年被评为全省法院办案标兵。2016年被选为中国共产党富拉尔基区第十二次代表大会代表，中国共产党齐齐哈尔市第十三次代表大会代表，中国共产党黑龙江省第十二次代表大会代表。2017年被富拉尔基区区委授予红旗党员荣誉称号。

她参加工作20多年来始终工作在民事审判工作第一线，由于工作日程总是排得很满，为了不耽误工作，孩子小经常生病她也无暇照顾，而且在生小孩后38天就上班工作了，未休产假。由于繁忙的工作，超负荷的工作量，使她劳累成疾，但她也从未因病请假。在处理案件时她积极探索民事案件处理新机制，面对疑难复杂案件，能够做到思路清晰，认真分析案情，找出双方矛盾所在，帮助双方找到合理的解决方式，化解对立情绪。她不仅着眼于案件的质量，更注重案件的社会效果，有效地保护了公民、法人和其他组织的合法权益，在处理案件中，她经常冒着酷暑，奔走于城镇乡村，对当事人耐心释法答疑，使当事人消除抵触情绪，自愿按法律程序解决。她虽然只是一名普通基层的法官，但是她淡薄名利，廉洁奉公，把一个女人全部的情感倾注到了执法为民的公正天平上，践行着“让人民群众在每一个案件中都感受到公平正义”.以一个共产党员的先进性为标准，一个新时期女法官所独有的魅力，赢得了人民群众的信赖，为树立人民法官的良好形象增了光，添了彩。

甘南县人民法院 刘春涛

刘春涛，男，出生于1981年3月10日，汉族，法学本科，党员，2006年进入甘南县人民法院工作，历任书记员、代理审判员、审判员、平阳法庭庭长，现任甘南县人民法院长山人民法庭庭长。

2015年审结案件183件，2016年审结案件654件，2017年审结案件383件，无涉诉信访案件，无超审限案件。2013年刘春涛被省法院评为全省办案标兵、被市法院评为全市法院优秀法官；2014年被市法院评为全市法院优秀法官、全市法院模范法官；2015、2016年获得县政府嘉奖；2017年被省法院评为全省法院办案标兵。

崔霞，女，1975年1月出生，汉族，法律硕士学位，中国共产党党员。历任书记员、助理审判员、审判员、妇女儿童维权合议庭审判长，现任铁锋区人民法院民商事审判庭副庭长。

任法官的十余年间，她始终坚持在民事审判工作的第一线，工作勤勉，任劳任怨，至今已累计主审各类民事案件一千五百余件，其中，2017年主审各类民事案件229件，办案数量在全院名列前茅。崔霞勤于学习，善于钻研，至今已在省、市级期刊发表各类调研文章近二十篇篇，其中，有三篇调研文章分别获得全国法院系统理论研讨会优秀奖、东北三省法治论坛学术研讨会三等奖、黑龙江省法院系统理论研讨会二、三等奖。她办案效率高，结案速度快，从未有陈年旧案积压在手；办案质量好，调撤率高，上诉率低，多年无发回重审和改判案件，所主审的一千五百余起民事案件无一被确认为错案。

她淡泊名利，廉洁自律，坚持司法为民的宗旨，全心全意为百姓排忧解难，其担任审判长的妇女儿童维权合议庭及所开通的“百合热线”,为辖区妇女儿童提供了大量的法律咨询和诉前调解服务，还多次应铁锋区妇联的邀请为辖区妇女工作者和各社区居民进行法律培训，被人民法院报、黑龙江日报等多家媒体予以广泛报道。崔霞担任铁锋区政府法律顾问工作后，积极为区政府提供法律咨询，为辖区经济建设献言献策。崔霞以其过硬的法学功底、扎实的工作作风，赢得到了社会各界的交口称赞。

昂昂溪区人民法院 徐万玉

徐万玉，男，1981年9月出生，汉族，中国共产党党员，2006年7月毕业于齐齐哈尔大学经济管理学院，法学学士学位，现任昂昂溪区人民法院执行局局长。

三道镇人民法庭管辖三乡两镇和两个国营林场，辖区人口16.6万，五年来，全庭共受理各类民事案件1969件，他个人承办案件715件，综合结案率达97.58%,无一起更审改判案件、无一起涉诉涉访案件，真正实现“保稳定、促发展、伸正义”的工作目标，他在全院绩效考评中多年连续名列第一。

他注重深化服务层面，亮化窗口建设。他针对人民法庭的工作特点，努力打造法庭服务窗口这一亮丽名片：一是立案窗口明亮化，凸显“效率”二字。二是服务礼仪标准化，凸显“文明”二字。他优化服务方式，创新管理理念。他结合所在法庭自身特点，创造性地总结出了“四字”管理法：一是抓审限，突出一个“快”字。二是抓评查，突出一个“优”字。三是抓环节，突出一个“质”字。四是抓调解，突出一个“和”字。注重立案、巡回审判站、点的调解，大胆创新，提出巡回审判，庭审设在田间地头。

郭海波，女，1975年2月1日出生，汉族，1996年参加工作，2005年通过全国司法考试，历任讷河市人民法院民三庭助理审判员、行政庭副庭长，现任龙河人民法庭庭长。

工作以来，她多次获得省、市、县各级法院的多项荣誉。郭海波同志自2007年任法官以来，2008年、2009年、2010年连续三年受到讷河市政府嘉奖，并于2010年荣立三等功一次，2011年因在下乡送达回程中途中救火，被省法院授予见义勇为三等功，2008年、2010年二次评为讷河市政法系统先进个人。2012年被评为全省法院办案标兵，2014年被评为齐齐哈尔市法院系统调解能手，2015年所在的民一庭被授予全省法院先进集体，本人被评为讷河政法系统先进个人，2016年被讷河市委、市政府评为全市维稳先进个人，并被讷河市政府授予嘉奖，2017年被齐齐哈尔中院评为调解能手，并被讷河市政府授予嘉奖。

郭海波她的办案数量历年来在本院一直名列前茅。2014年承办民事案件192件，2015年承办案件172件，2016年承办民事案件197件，2017年承办民事案件284件。2018年截止6月5日审理案件180件，审结115件。且审理的案件质量较高，更审改判率低。在所承办的案件中无一起因个人原因引起信访、改判，无一起错案。

that we’ve been through, I don’t believe that rolling back regulations on Wall Street will help the small businesswoman expand, or the laid-off construction worker keep his home.We’ve been there, we’ve tried that, and we’re not going back.We’re moving forward.I won’t pretend the path I’m offering is quick or easy.I never have.You didn’t elect me to tell you what you wanted to hear.You elected math.I refuse to go along with that.And as long as I’m President, I never will.I refuse to ask middle class families to give up their deductions for owning a home or raising their kids just to pay for elderly, or disabled – all so those with the most can pay less.And I will never turn Medicare into a voucher.No American should ever have to spend their golden years at the mercy of insurance companies.They should retire with the care and dignity they have earned.Yes, we will reform and strengthen Medicare for the long haul, but we’ll do it by reducing the cost of health care – not by asking seniors to pay thousands of dollars more.And we will keep the promise of Social Security by taking the responsible steps to strengthen it – not by turning it over to Wall Street.This is the choice we now face.This is what the election comes down to.Over and over, we have been told by our opponents that bigger tax cuts and fewer regulations are the only way;that since government can’t do everything, it should do almost nothing.If you can’t afford health insurance, hope that you don’t get sick.If a company releases toxic pollution into the air your children breathe, well, that’s just the price of progress.If you can’t afford to start a business or go to college, take my opponent’s advice and “borrow money from your parents.” You know what? during this recession, even when their competitors shut down dozens of plants, even when it meant the owners gave up some perks and pay – because they understood their biggest asset was the community and the workers who helped build that business – they give me hope.And I think about the young sailor I met at Walter Reed hospital, still recovering from a grenade attack that would cause him to have his leg amputated above the knee.Six months ago, I would watch him walk into a White House dinner honoring those who served in Iraq, tall and twenty pounds heavier, dashing in his uniform, with a big grin on his face;sturdy on his new leg.And I remember how a few months after that I would watch him on a bicycle, racing with his fellow wounded warriors on a sparkling spring day, inspiring other heroes who had just begun the hard path he had traveled.He gives me hope.I don’t know what party these men and women belong to.I don’t know if they’ll vote for me.But I know that their spirit defines us.They remind me, in the words of Scripture, that ours is a “future filled with hope.” And if you share that faith with me – if you share that hope with me – I ask you tonight for your vote.If you reject the notion that this nation’s promise is reserved for the few, your voice must be heard in this election.If you reject the notion that our government is forever beholden to the highest bidder, you need to stand up in this election.If you believe that new plants and factories can dot our landscape;that new energy can power our future;that new schools can provide ladders of opportunity to 当您听到这样的话时，脸上也许会浮起淡淡的笑吧。你是否也想起了自己的小时候呢，当老师和大人们问你长大后的理想时，你是否也曾有过这样的回答呢？而你是否也和我一样，在你儿时的理想里，“法官”这两个字从来就没沾过边呢。但是，如果现在有人问我，你

最想做什么？我想说，我要成为一名法官，一名像他们那样的法官。

“找工作”“就业难”“毕业就失业”，相信大家对这样的话一定不会陌生。在找工作的茫然中，考公务员已经逐步成为众多学子毕业后的首选。而当你问及大家考公务员的理由时，答案基本都和下面这几个词儿有关，那就是：清闲，稳定，地位，权力……而这一切与儿时的豪言壮语、与青春的激情和梦想好象都已毫无关联。在越来越现实的世界里，大家关心的似乎只有“面包”。而我，也正是寻着这样的脚步怀着并不崇高的理想，跌跌撞撞地闯进了公务员的队伍，成为了法官队列中的一员。

“哎哟，这姑娘考上法官了呀，呵，这回他们老两口儿可享了清福喽！这法官可了不得啊，那小槌当那么一敲，那就是古代的大人哪！”有人这样议论着。一提及法官这个称呼，大家除了想到那“一张报纸，一杯茶，一台电脑，一整天”好象已经专属于公务员的清闲外，似乎更多的是将法官定义为手握特权，一锤定音的大官儿。而我，也正是带着对法官的敬畏和些许的疑问慢慢地走进了法官的生活。

还记得第一天报到时的情景，来到萝北县人民法院时已将近中午，却并未见办公室里喝茶看报的悠闲，而是看到他们刚刚开完庭拿着案卷步履匆匆的身影。所以，“忙”是他们给我留下的第一印象。记得庭长第一天和我说的话，“法院就像是一个矛盾的漩涡，而民一庭就处在这漩涡当中，总有办不完的案件，解不完的纠纷，你要做好吃苦的准备，多向老同志学习，“咸盐”吃多了，你也就成熟了。”说实话，当时，我并没听懂“咸盐吃多了”这句话的含义，但现在我懂了，那就是走进社会这个大熔炉，汲取生活经验、社会经验，识人间烟火，品人生百态，在摸爬滚打中百炼成钢！

在这近一年的时间里，我看到的不是说一不二的蛮横，而是他们遇到当事人的误解或吵闹而受了委屈时依然微笑着为当事人疏导和讲解时的耐心和细致。我看到的不是传说中那所谓高高在上的权威，而是他们谨小慎微地处理着家长里短、是是非非的纠纷，试图将矛盾缓解到最小而不厌其烦地给当事人做思想工作的忙碌和辛苦，甚至于休息时也会考虑着某某案子应该怎么解决最好，突然想到办法时，会马上坐起来拿笔记下。

我看到，在一起土地纠纷中，他们为了给这农民视为命根子一样的土地一个准确的说法，穿着水靴来来回回地在泥泞的土地里丈量，一干就是一小天儿；我看到在庭审中，当父女间的心结被打开，法官走下审判台，让姑娘、姑爷儿给老人三鞠躬时，坐在被告席上年近七旬父亲的老泪纵横；我看到他们在周末加班来院写裁判文书;看到他们因忙于工作而不得不放弃难得的年休假期；看到他们终于将案子顺利解决时的满脸喜悦；看到当事人握着他们的手连声说着感谢；我看到在院党组的感召下全体干警齐心协力，干劲儿十足的精神面貌；看到老百姓对你们竖起大拇指时的那份欣慰。

我看到了，我看到了亲如兄弟姐妹的团结，我看到了以院为家、无私进取的责任。我的身心也已融入到了这个集体当中，看到他们奔波忙碌，我也心焦力瘁；看到他们舒展眉头，我也心满意足；看到他们忙里偷闲的欢快，我也会像孩子般的愉悦。

《真水无香》这部电影大家应该都看过，真水无香：表面平淡、不张扬的，却是滋养生命万物、不可或缺之物，用以形容人品格的淡泊、纯净和高尚。是啊，我身边的法官就是这样的人。没有什么豪言壮语，也没有什么高大威严的形象，他们就是一群平凡的人，但是他们用团结、责任和奉献支撑出一片天地，一片和谐的天地。

还记得第一次站在国徽下的时候，那一刻，我在想，我能为你奉献出什么呢？而今天，我的心里已多了一份理解，肩上也更多了一份责任，所以，我会不断地努力，我坚信，我决不会愧对“法官”这个称号，我一定要成为像他们那样的法官！
