尽管安乐死至今还没有在多数国家合法化,但人们对给予病情危重而又无法治愈的病人以死的权力和自由以摆脱残酷的病痛折磨的做法,愈来愈多地采取同情的态度,认为这是符合人道主义精神的。
持肯定态度的学者认为安乐死必须符合下列条件:
①从现代医学知识和技术上看,病人患不治之症并已临近死期;
②病人极端痛苦,不堪忍受;
③必须是为解除病人死前痛苦,而不是为亲属、国家、社会利益而实施;
④必须有病人神志清醒时的真诚嘱托或同意;
⑤原则上必须由医师执行;
⑥必须采用社会伦理规范所承认的妥当方法。
持否定态度的则认为安乐死有悖生存权利。首先,在现有的法律条件下,“安乐死”可能引致“故意杀人”。患者自杀不会影响别人,但是,如果他本人想结束生命,医护人员及家属协助满足其请求,在《刑法》中是“帮助自杀”行为,涉嫌故意杀人罪。其二,“安乐死”如果以法律形式确认下来,可能会被一些人利用,用以非法剥夺他人的生命。另外,在人类对疾病的认识还十分有限的情况下,未经法律许可而结束他人生命,有悖于生存权利的道德准则。
“安乐死”要实现真正意义上的立法,一个前提基础必须具备,即在最后选择这种结果的时候,应该保证这些公民是因为难以摆脱疾病给身心带来的痛苦,而不是因为丧失治疗机会而产生的心理绝望使然。如果国家没有能力向百分百的患病公民提供这种救治机会与兜底的福利制度,“安乐死”的立法就缺乏足够的社会立法基础。否则,这将可能意味着一种不道德的人性灾难。
从伦理方面讲,公民在遭遇非常的不可逆的身体疾病痛苦,自愿要求结束自己生命的条件下实施“安乐死”,本身也是合乎道德的。
从历史的趋势来看,安乐死的合法化,势在必行,只不过是时间与实施细则问题。一旦安乐死立法,它就像横在病人面前的一把双面刃,用得好,就可以真正解除病人的痛苦;用得不好,就可能成为剥夺病人选择生命权利的借口,被不法不义之徒滥用。
