公司登记机关签发的公司营业执照是确定公司成立的法律文件，公司营业执照的签发日期为公司成立之日。公司自成立之日起成为独立享有权利、承担贵任的法人。从公司营业执照签发之日 起，公司登记机关对公司各主要事项的登记同时产生法律效力，对公司具有约束力。
依据《公司法》规定，公司营业执照应当载明如下事项:
其一，公司名称。公司名称是公司区别于其他公司和市场主体的标志，公司都必须有名称。公司营业执照所载明的公司名称是公司的法定名称，是确认公司权利义务归属的依据。
