成都市青羊区专利试点示范企业

认定与管理办法（试行）

第一章总则

第一条为提高企业知识产权创造、管理、运用和保护能力，增强企业核心竞争力，根据《成都市企业专利试点工作实施方案(试行)》，结合本区实际，制订本办法。

第二条通过开展企业专利试点、示范工作，进一步引导企业提高知识产权管理意识和管理水平，构建知识产权工作体系，实施知识产权战略，推进企业充分依靠和运用专利制度,促进企业技术创新，促进拥有自主知识产权的产品、产业的形成和发展。

第二章认定条件

第三条在青羊区内注册登记工商和税务关系、且从事科技活动、没有专利侵权行为的企业；

第四条知识产权试点企业

1、建立健全有效的专利机构,有领导分管,落实相应的工作人员、经费和工作条件。

2、专利管理、技术资料档案管理等各项制度健全。

3、制定切实可行的专利工作目标和计划，落实工作措施和考核指标。

4、开展知识产权宣传与培训。

5、企业拥有有效专利5件以上（发明专利不少于1件），专利申请量3件以上（不含外观设计专利）。

第五条知识产权示范企业

1、强化专利信息利用，定期开展行业专业技术专利分析与研究活动。

2、开展企业专利战略研究，制定适合企业的专利战略并认真组织实施。

3、建立企业专利工作绩效考核制度，形成有效的激励机制。

4、促进专利技术的实施和产业化。

5、企业拥有有效专利10件以上（发明专利不少于5件），专利申请量不低于6件（发明专利不少于2件，不含外观设计专利）。

第三章申报与认定程序

第六条申报专利试点、示范企业应提供资料如下：

1、青羊区专利试点、示范企业申报表。

2、企业营业执照、税务登记证复印件。

3、企业专利申请、授权专利汇总表。

4、申请专利示范企业的，上一应已获得专利试点企业称号。

第七条青羊区每年开展一次专利试点、示范企业的认定工作。申请专利试点、示范企业须在每年8月底前通过青羊科技网（）上申报系统提出，并报送申报材料一

式一份至区科技局（知识产权局），并同时报送电子文本。经区科技局（知识产权局）审核同意，授予“青羊区专利试点企业”和“青羊区专利示范企业”称号，开展试点示范工作。

第四章考核与管理

第八条区科技局（知识产权局）负责专利试点、示范企业管理工作。

第九条企业专利试点、示范期限为叁年，实行动态管理。试点、示范期满后，企业应提交企业专利试点、示范工作总结，由区科技局（知识产权局）组织考核验收。

第十条经考核合格的企业保留“青羊区专利试点、示范企业”称号，未通过考核的企业给予一个考核的整改期，到期仍未通过考核的，取消“青羊区专利试点、示范企业”称号。

第五章扶持措施

第十一条青羊区专利试点、示范企业可享受以下扶持：

1、对首次获得专利试点企业称号的企业补助经费3万元，首次获得专利示范企业称号的企业补助经费5万元，补助经费在区当年预算批复“应用技术研究与开发经费”项目中统筹安排。补助经费用于企业专利的宣传培训和管理工作等。

2、青羊区专利成果转化项目计划重点扶持专利试点、示范企业。

3、优先推荐申报国家、省、市知识产权（专利）工作示范企业。

4、优先推荐申报国家、省、市科技计划和专利实施项目；优先推荐申报国家、省、市科技进步奖和专利成果奖。

5、对申报区重点科技计划的项目，在评审通过的情况下预以优先立项。

6、优先为专利试点、示范企业提供专利宣传、培训、咨询、专利纠纷、专利维权、专利信息服务和企业知识产权战略策划。

7、组织参加学习、考察、交流合作和对口培训等。

第六章附则

第十二条本办法由区科技局（知识产权局）负责解释。第十三条本办法自公布之日起施行，有效期五年。
