女生留学 翻译出错怒诉公证处并将其告上法庭 时间： 2014-01-06 09:06 中国法院网讯(李媛洁)家住广西钦州市一蔺姓女大学生，本怀揣一颗出国深造的梦想，兴冲冲跑去公证处办理出国留学手续，岂料，因为公证处翻译出了差错让她痛失了出国留学的机会，该女学生一怒之下将公证处告上了法庭。近日，广西钦州市钦南区人民法院审理了此案。

原告小蔺称自己本想要前往韩国留学，辞去了原来稳定的工作，并事前已经积极联系好了韩国的大学。一家韩国大学经审理原告的资料后同意接受原告的留学申请，于是原告按学校的要求实际缴纳了留学学费，等韩国大使馆办理完毕留学签证后即可出国留学。韩国大使馆经审查原告资料后，告知原告需提供亲属关系公证证明书及公证书的中英文对照版本后才即可办理留学签证。于是原告前往被告处办理亲属关系公证书，并要求被告提供中英文对照公证书。被告受理原告相关公证申请后，于2013年1月10日作出公证书，对原告申请办理的亲属关系证明以及中英文对照版本作出了相应公证证明。原告拿到被告提供的公证书后，前往韩国大使馆办理相关出国留学签证，但是，韩国大使馆最后拒绝了原告的出国留学签证申请，理由为原告提供的亲属关系公证证明错误，怀疑原告提供虚假证明材料。至此，原告才知道被告提供的公证书中的英文翻译存在多处明显错误，这让大使馆严重怀疑原告的诚信，韩国学校将原告的学费退回，导致原告出国留学的梦想破灭，原告的人生轨迹发生了重大变化，对原告及原告家人带来了巨大的伤害。

原告小蔺庭审时称，被告作为一家专业性的、专门的司法证明机构，依法应对提供证明材料的真实性、合法性予以保障，但由于被告的严重不负责任，提供的具有法律效力的证书存在多处明显错误，使得原告在办理出国留学签证被认定为提供虚假证明材料，直接导致原告未能出国留学，对原告精神造成了巨大伤害。同时，原告因办理出国留学事宜，前期已花费了大量的人力财力，包括但不限于公证费用、毕业证认证费用、体检费用、材料复印邮递费用及相关差旅费用。被告公证处辩称，原告没有提供证据证实其申请出国签证及不能办理签证手续的原因是因为公证文书的错误所致使，也没有提供证据证实其经济损失情况，因此，原告的诉讼没有事实和法律依据。

综合全案证据，法院确认以下法律事实：2013年1月10日，原告前往被告处办理亲属关系公证书，被告根据原告提供的材料作出公证书，对原告申请办理的亲属关系证明以及中英文对照版本作出了相应的公证证明，但在英文翻译版本中，笔误译错了“关系人related(译错为relatted)”、“申请人applicant(译错为applicantuo)”及“公证员 notary(译错为notay)”三处。原告据此向法院起诉，认为韩国大使馆因为原告提供的亲属关系公证书中的英文翻译存在多处明显错误、怀疑原告提供虚假证明材料，最后拒绝了原告的出国留学签证申请，韩国学校将原告的学费退回，导致原告出国留学的梦想破灭，原告的人生轨迹发生了重大变化，对原告及原告家人带来了巨大的伤害，要求被告赔偿公证费用、毕业证认证费用、体检费用、材料复印邮递费用及相关差旅费用等合计人民币2000元及精神损失费人民币10万元。

一、公证书标题的翻译

一般来说，公证书翻译为“notary certificate”。要注意，切忌将公证书翻译成“notarial certification”。

公证书标题必须全部大写或大写标题中每个单词的第一个字母。除非位于局首，公证书标题中的冠词（articles）及少于5个字母的连词（conjunctions）、介词（prepositions）不应大写。

在具体应用中，涉外公证书翻译工作量最多的往往是：毕业证公证书（notarization of diploma）、学位证公证书（notarization of degree certificate）、成绩单公证书（notarization of academic transcription）、亲属关系公证书（notarization of family relation）、婚姻状况公证书（notarization of marital status）、无刑事犯罪记录公证书（notarization of no record of criminal offense）、及（涉外）收养公证书（notarization of adoption）等。

二、公证词的翻译

我国公证书公证词多以“兹证明??”开头，其英文翻译（english equivalent）应该是：“this is to certify that?”。

而外国公证书公证词开头一般为“我，xxxx，xxxx公证员，特此证明??”（i, xxxxx，notary public, duly authorised, admitted and sworn, practising in the city and county of dublin do hereby certify that??)。2.公证词翻译应忠实于原文（conformity）

在结尾方面，中国公证书一般为“特此证明”，翻译为“it is hereby certified”。

而外国公证书结尾一般为一段宣誓这类的语句，如“in faith and testimony whereof i have hereunto set may hand and affixed my seal of office this10th december 2008”。这段公证词翻译成中文比较费解，一般来说采用意译更符合中国国情，翻译成“我宣誓，上述公证属实??”。特别注意，英文公证词结尾在描述日期上不使用“on”这个词。

三、涉外公证书的落款
