From 1980, one-child policy has been a momentous part of the family planning policy and played a certain role in controlling the rapid growth of population.But this policy is obviously of great disadvantages.First of all, China is entering the aging society and couples, both of whom are the only child, have to support four old.Supporting the old has become a prominent problem of family and society.One couple, both of whom are PhD, wants to make some achievements in their jobs after graduation.However, they have to support three aged parents, two of whom are in hospital.They even have no time and energy to bring up their own children.They are eager to have brothers and sisters, with whom they will be able to share these responsibilities.Secondly, gender imbalance is serious.Men, five or six in ten, cannot find wives.Because of one-child policy, some couples go to the hospital to check the fetus’s gender and will have an abortion if it is a female fetus.Thirdly, the only child is prone to having a lot of

河南省农村〈独生子女父母光荣证〉发放管理规定

第一条 为了保障公民实行计划生育的合法权益，进一步规范全省《独生子女父母光荣证》（以下简称《光荣证》）的发放管理工作，根据国家《人口与计划生育法》、《河南省人口与计划生育》（以下简称《条例》）等法

第一条 为了保障公民实行计划生育的合法权益，进一步规范全省•独生子女父母光荣证‣（以下简称•光荣证‣）的发放管理工作，根据国家•人口与计划生育法‣、•河南省人口与计划生育‣（以下简称•条例‣）等法律、法规，制定本规定。

第二条县级以上人口和计划生育行政部门负责•光荣证‣发放管理的监督指导工作。

乡、镇人民政府和街道办事处负责辖区内•光荣证‣的发放、建档和日常管理工作。

第三条本省户籍公民，未违反生育政策规定生育、未违法收养子女，夫妻的生子女、养子女、继子女合计只有一个（依法收养的残疾儿童、孤儿不计），不再生育的，可以申领•光荣证‣。

第四条夫妻均系本省户籍，经双方单位（村（居）民委员会）核实，向女方户籍所在地乡镇人民政府或街道办事处申领•光荣证‣。

一方为本省户籍，一方为外省、自治区、直辖市户籍的夫妻，由符合条件的本省户籍一方向本人户籍地的乡、镇人民政府或街道办事处申领•光荣证‣。

居住在本省的外省、自治区、直辖市户籍公民，按国家和其户籍所在地有关规定申领•光荣证‣。

第五条•光荣证‣丢失的，向原发证机关申请补办。户籍地变化的，凭原发证单位出具的证明，到现户籍地的乡、镇人民政府或街道国企申请补发•光荣证‣。

第六条夫妻双方申请领取•光荣证‣，应填写•独生子女父母光荣证申请表‣。申请从的在村（居）民委员会应将申请人名单张榜公布 3日。无异议者，申请人的在村（居）民委员会将材料上报乡、镇人民政府或街道办事处。

乡、镇人民政府或街道办事处，对村（居）民委员会出具意见的•独生子女父母光荣证申请表‣进行审核，对符合条件的，发给•光荣证‣；对有异议或不符合条件的，应当在 5个工作日内调查核实完毕，书面通知申请人，并说明理由。

对材料不齐全或不符合程序的申请，乡、镇人民政府或街道办事处应当告知申请人需要补正的全部内容。

第七条申请领取•光荣证‣的公民，应提供下列材料：

（一）身份证明；

（二）夫妻及子女户籍证明；

（三）婚姻状况证明；

（四）子女的出生证明或合法收养子女的证明。

第八条有下列情况之一的，•光荣证‣无效，持证人应将•光荣证‣缴回所在地乡（镇）人民政府、街道办事处：

（一）申请生育第二个子女的，从申请之日起无效；

（二）违反规定生育子女的，自生育行为发生之日起无效；

（三）收养子女的，自收养关系确立之日起无效（依法收养残疾儿童、孤儿的除外）；

（四）再婚夫妻双方的子女存活数合计在 2个或 2个以上（包括自己抚养或离婚时叛随对方、托人抚养、送人的存活子女）的；

（五）申请领取•光荣证‣时，提供的申请材料不真实的，自始无效。发现当事人所持•光荣证‣无效的，乡、镇人民政府或街道办事处应当通告当事人所在单位，停止其独生子女父母待遇；通知当事人退回•光荣证‣和已享受的独生子女父母奖励费、其他计划生育奖励。

第九条对领取•光荣证‣后，又生育第二个子女的夫妻，行政村负责上报名单，发证机关填写•河南省退回†独生子女父母光荣证‡家庭追缴、终止奖励费登记表‣。对已收缴•光荣证‣的，名单张榜公布 3日，乡、村计生工作人员在独生子女父母光荣证档卡 “备注 ”栏内注明•光荣证‣收回日期，并及时变更乡级 “优先优惠政策信息库 ”户资料。

第十条乡、镇人民政府和街道办事处应对本辖区•光荣证‣发放、变更等情况建档立卡、统计上报，发放•光荣证‣名单报县（市、区）人口和计划生育行政机关备案。

省辖市人口和计划生育委员会对本辖区•光荣证‣发放、管理情况，按照省人口计生委要求，定期上报。

第十一条 县（市、区）人口和计划生育行政机关应加强对•光荣证‣的发放管理工作的监督检查，对无故拖延发证、弄虚作假的，要追究经办人的责任和有关领导责任。

第十二条•光荣证‣证件编号由各地自行规定；证件发放夫妻双方合持一证，特殊情况独生子女父母要求各持一证的，可分别办理。

第十三条•光荣证‣全省统一样式，定点负责制，免费发放。

第十四条 本规定自文件下发之日起施行。凡农业人口此前持有效•光荣证‣的，乡、镇人民政府和街道办事处需在 2006年 3月底前统一换发完毕。

•河南省独生子女父母光荣证管理工作规范‣（予计生政字„ 2001‟ 16号）自本文件下发之日废止。
