第一篇：民法show

1各位同学下午好，此次班会主题为“学法立行，守法做人”。而在此。我们又不得不提法律了。所谓法律，是一种公平的规则，即人类在社会层次的规则，社会上人与人之间关系的规范。它并不是简单机械的对人们违反规则的行为进行相应的惩罚，它是维持国家正常运行的工具，它也已经深入我们的生活。对于我们青少年来说，法律是我们正常生活的有利保障，更是我们今后生活乃至人生路上的行动指南。由此，我们必须正确认识法律并且加以运用。下面有请王旭同学为我们带来诗歌朗诵《一二四普法>,2有请贾慕熙同学带来拉丁舞。

3在现实生活中，由于我们缺乏法律知识与法律观念，青少年犯罪的现象时有发生，并且已经成为严重的问题，我想我们都需要思考，下面就有请李倩等同学为我们带来小品

第一部分 案情介绍

2009年12月6日17时30分，被告胡伟国（男，38岁）持***518驾驶证，驾驶黑A58992号轿车，沿道里区抚顺街由西向东行驶至抚顺街电话分局门前时，将原告彭建华（男，77岁）撞伤。

原告：彭建华，男，1931年11月22日，汉族，住道里区安心街79号2栋6单元203号 被告：哈尔滨市鑫池出租汽车有限公司，地址南岗区七政街35号 被告：胡伟国，男，1966年4月6日生，住香坊区香明街12——1号 被告：于志宏，男 诉讼请求

1、请求判令被告支付医疗费、护理费、交通费、伙食补助费、医疗器具费、营养费、精神抚慰金共计60万元。

2、申请做伤残鉴定，被告支付伤残赔偿金，终身护理费，再治疗费、残疾器具费数额以鉴定结论为准。

3、三被告互相承担连带承担责任。

4、案件受理费由被告承担。事实和理由

2009年12月6日17时30分，被告胡伟国驾驶黑A58992号轿车在道里区抚顺街将原告撞伤，在此事故中被告胡伟国负全责，原告无责任。

该事件原告头部和腿部受伤，入院38天，共花医疗费45218元，其中胡伟国支付5000元，其余均是原告支付，原告多次的找三被告要求支付医疗费，均拒付，现原告头内有水肿，还需手术治疗，且原告已经伤残，终生需要护理，所有请求做伤残等级鉴定。

该肇事车辆为哈尔滨市鑫池出租汽车有限公司，于志宏承包该肇事车辆，于志宏又雇胡伟国为夜班司机。

原告彭建华诉被告胡伟国、于志宏、哈尔滨鑫池出租汽车有限公司道路损害赔偿纠纷一案，本院于2010年4月20日受理后，依法适用民事诉讼普通程序于2007年7月2日公开开庭审理，现已审理终结。

本院认为，被告胡伟国违反《中华人民共和国道路交通安全法》和《中华人民共和国道路交通安全法实施条列》，其所驾车辆与原告相撞，造成原告彭建华受伤致残的后果，根据交警部门的事故认定，被告胡伟国在此次事故重负全部责任。本院依照法律法规和司法解释的规定，结合原告的诉讼请求及相关证据确认如下：医疗费41549.71元、医疗器械费596元、住院期间护理费3000元（2人，38天）、出院后护理费3200元（4个月）、住院伙食补助费520元、交通费157元、二次手术费31000元。

为此，依照《中华人民共和国民法通则》第一百一十九条，《中华人民共和国道路交通安全法》第八条、第九条，最高人民法院《关于审理确定民事侵权精神损害赔偿责任若干问题的解释》第八条第二款、最高人民法院《关于审理人身损害赔偿案件适用法律若问题的解释》第十七条、第十八条、第十九条、第二十条、第二十一条、第二十三条、第二十五条之规定，判决如下：

一、限被告胡伟国在本判决生效后十日内赔偿原告彭建华医疗费、医疗器械费、护理费、住院伙食补助费、交通费、二次手术费，共计80015.71元。

二、被告哈尔滨鑫池出租汽车有限公司、被告于志宏承担连带责任。

三、本案受理费1300元由原、被告双方各承担650元。

如不服本判决，可在判决书送达之日起十五日内向本院递交上诉状，并按双方当事人的人数提交副本，上诉法院黑龙江省哈尔滨市中级人民法院。
