依劳动法辞退员工之十种情形

辞退员工,以劳动法的专业术语来讲,叫做“用人单位单方解除劳动合同”。辞退员工,不论对企业还是对员工,都是一个沉重的话题。对于大多数企业来讲,辞退员工处理不当,很容易引发劳动纠纷甚至对簿公堂,对企业的正常营运产生深远影响。因此,企业辞退员工如何在劳动法的框架范围内进行,尤其显得重要。

根据《劳动合同法》及相关规定,北京沈斌倜劳动法律师服务将企业在劳动法的框架内辞退员工分为以下十种情况,并将逐一进行讲解,抛砖引玉。

劳动法下的辞退之一:试用期辞退

试用期辞退的法律依据为《劳动合同法》第39条,具体表现为:

首先,依据劳动法在试用期聂要辞退员工前提是双方签订有劳动合同,且劳动合同中关于试用期的约定合法,即符合《劳动合同法》第19条的规定,劳动合同期限三个月以上不满一年的,试用期不得超过一个月;劳动合同期限一年以上不满三年的,试用期不得超过二个月;三年以上固定期限和无固定期限的劳动合同,试用期不得超过六个月。同一用人单位与同一劳动者只能约定一次试用期。以完成一定工作任务为期限的劳动合同或者劳动合同期限不满三个月的,不得约定试用期。试用期包含在劳动合同期限内。劳动合同仅约定试用期的,试用期不成立,该期限为劳动合同期限。企业如违反上述规定与员工约定试用期的,由劳动行政部门责令改正;违法约定的试用期已经履行的,由企业以员工试用期满月工资为标准,按已经履行的超过法定试用期的期间向员工支付赔偿金。

其次,依据劳动法在试用期内辞退员工,须证明员工不符合录用条件。企业要证明:有明确的录用条件;录用条件已向员工书面明确;员工不符合录用条件;在试用期内作出辞退决定。这四个方面均具备了,才能保证在试用期辞退员工不会出现法律风险或将法律风险降低到最小。

我们认为,对于具体录用条件的制定,特别是禁忌性条件,除了应当不违反法律的强制性规定,还应当具有合理性。合理性的标准会因岗位和行业不同而有差异,建议企业在设置录用条件条款时,可以考虑通用与特别的分别规定,如将违纪、工作态度、工作能力等规定在通用条款中,将性别、健康状况、技能证书等规定在特别条款中,且说明这样特别规定的原因。这样做的好处,既可以避免违反法律,出现歧视性条款,也可以让员工明白录用条件的合理性,消除未被录用者的不满心理,避免劳动争议的出现。制定了可靠的录用条件,只是成功运用它的 第一步,还需要制定在操作上的

程序制度,包括向员工公示录用条件(如在录用制度中规定告知条款,详细列明告知义务的具体执行人、告知时间等,建议告知时间放在签订劳动合同的同时,且要有员工签字的知晓并表示遵守执行的说明书),制定详细的考核制度(如哪个部门考核,何时考核,如何考核等),考核结束后,应及时比对考核结果和录用条件,及时在试用期内作出处理决定等。

劳动法下的辞退之二:严重违纪员工的辞退

以严重违纪为由辞退员工,注意以下要点:首先应有规章制度作为依据,需要企业在员工手册或者规章制度对严重违纪的情形作出明确定义并做具体列举,这种定义和列举同时还必须符合法律法规规定,符合人之常情。规章制度制定后,还需要按照法律规定的程序让员工参与讨论、与工会或者员工代表协商、向员工公示等。这种民主讨论、协商、公示的程序必须按照法律规定的要求去做,同时还应注意保留相关的证据,以免在将来发生争议时无法举证说明制度已经履行了法定的制定程序。员工是否违纪需要有明确的证据来证明,企业在处理员工违纪事件时,要注意保留证据,否则会面临败诉的法律风险。此外,企业还应事先将辞退的理由通知工会,通知员工本人,否则将可能导致辞退永远没有结果,不会发生法律效力。

依此条辞退员工,必须符合两个条件:一是严重失职;二是重大损失。所谓严重失职,企业必须能够证明员工的职务要求是明确的,还要能够证明员工的行为是否属于失职,是否属于严重失职。严重失职是指员工在履行劳动合同期间,没有按照岗位职责履行自己的义务,违反其忠于职守、维护和增进企业利益的义务,有未尽职责的严重过失行为或者利用职务之便谋取私利的故意行为,使企业有形财产、无形财产遭受重大损害。所谓重大损失,企业需举证证明其遭受了经济损失,这个经济损失需要企业来计算,然后企业还要有证据能够证明这个经济损失已经到了重大的境地。多少属于重大损失,企业可以在合理的范围内进行规定,企业没有规定的,由司法机构来裁定。如果员工认为企业规定的不合理的,有权申请仲裁要求仲裁委或者法院对其合理性进行界定。

律师提醒:符合以上一至六其中任何一种情形者,企业可以立即通知解除劳动合同,并无需向被辞退员工支付解除劳动合同经济补偿金。

工作量。若签订劳动合同时没有明确工作量的,只能参照同工种同岗位人员的工作量来确定,一般来讲,应参照平均的同工种同岗位人员的工作量,不能参照最高的同工种同岗位人员的工作量。建议企业在劳动合同中或者岗位说明书中确定员工的工作量且保存相应培训材料。

这是情事变更原则在劳动合同中的体现。何为“客观情况”,劳动法对此没有做出明确规定。根据劳动部关于《中华人民共和国劳动法》若干条文的说明第26条,“客观情况发生重大变化”是指:发生不可抗力或者出现致使劳动合同全部或者部分条款无法履行的情况,如企业兼并、迁移、资产转移等,并且排除劳动法第27条所列的清况。从审判实践看,一般是指因不可抗力或者企业条件发生变化等无法避免的情况,如自然条件、企业迁移、被兼并、分立、企业资产转移、生产结构重大调整;转产等,但绝不限于或等同于以上情况。新情况会不断出现,尚有待在审判实践中去摸索总结。

律师提醒:符合以上之七至之九其中任何一种情形的,企业可以单方通知解除劳动合同,但需提前30天书面通知员工(或支付相应的代通知金代替),并向员工支付解除劳动合同经济补偿金,标准为:按员工在本企业工作的年限,每满一年支付一个月工资的标准向员工支付。六个月以上不满一年的,按一年计算;不满六个月的,向员工支付半个月工资的经济补偿。

劳动法下的辞退之十:经济性裁员

劳动法下经济性裁员法律依据为《劳动合同法》第41条,具体表现为:

第一,依照企业破产法规定进行重整的; 第二,生产经营发生严重困难的;

第三,企业转产、重大技术革新或者经营方式调整,经变更劳动合同后,仍需裁减人员的;

第四,其他因劳动合同订立时所依据的客观经济情况发生重大变化,致使劳动合同无法履行的。

企业需要裁减人员二十人以上或者裁减不足二十人但占企业职工总数百分之十以上的,企业提前

三十日向工会或者全体职工说明情况,听取工会或者职工的意见后,裁减人员方案经向劳动行政部门报告,才可以裁减人员。

经济性裁员,应

优先留用三类人员:与本单位订立较长期限的固定期限劳动合同的;与本单位订立无固定期限劳动合同的;家庭无其他就业人员,有需要扶养的老人或者未成年人的;企业在六个月内重新招用人员的,应当通知上述被裁减人员,被裁减人员在同等条件下具有优先就业权。

律师总结和提醒:在符合以上之一至之六其中任何一种情况下,企业可以依据劳动法立即解除劳动合同且不支付经济补偿金;在符合以上之七至之九其中任何一种情况下企业可以依照劳动法解除劳动合同,但是需要提前30天通知(可支付相应的代通知金代替)并同时支付解除劳动合同经济补偿金;在符合以上第十条的情况下,企业可以依据劳动法解除劳动合同但是必须提前三十天通知(不能用代通知金代替)及支付解除劳动合同经济补偿金。同时北京沈斌倜劳动法律师服务还提请您需要注意的是,在职员工符合《劳动合同法》第42条规定在六种情形之一的情况下,禁止企业根据上述第七至第十的情况下单方解除劳动合同。这六种情况分别是:

1、从事接触职业病危害作业的劳动者未进行离岗前职业健康检查,或者疑似职业病病人在诊断或者医学观察期间的;

2、在本单位患职业病或者因工负伤并被确认丧失或者部分丧失劳动能力的;

3、患病或者非因工负伤,在规定的医疗期内的;

4、女职工在孕期、产期、哺乳期的;

5、在本单位连续工作满十五年,且距法定退休年龄不足五年的;

6、法律、行政法规规定的其他情形。

当然,若员工存在本文提到的依劳动法辞退的前一至六中的行为,即便同时符合《劳动合同法》第42条规定在六种情形之一的情况下,企业依然可以依照劳动法进行辞退,并无需支付解除劳动合同经济补偿金。

欢乐的日子就要到尽头了,面前的只有死亡,而面对的不仅仅是死亡,还有对这世界的不舍,对朋友的担心,对死亡的恐惧。

风一吹,树叶就纷纷落下,像泪,凄冷婉转。树枝有些已经干枯变型,好像一碰就得折掉。心情已经大不如前,有时烦躁,有时伤心,无力的在森林深处哭泣。本应毫无牵挂,但是树枝上还有一颗颗新的种子,新的生命,新的希望。在我倒下时,我应该保护这一个个新的生命,不受伤害,尽情享受阳光的沐浴,雨滴的滋润,还有我的怀抱。这就像我当年,在大树中的情景一样,我是他的希望。现在他们是我的希望,我一定要将希望之种撒下大地。

又是一天过去了,种子还在慢慢成长,而我也越来越虚弱。我还在想象,这些种子一定会在大地上发芽成长的。

这一天,天渐渐变了,雨点从天空撒下。以前清凉甘甜的雨点,现在对我却是无比的伤害,雨点从天空砸向于我,我只能忍,用憔悴的身体挡住雨点,以免弄伤了这些希望。这将注定是个漫长的夜晚,当阳光将我召唤,我从睡梦中醒来,一睁眼,发现这些希望之种已经不在了。天啊,这些还没有长大,是不可能发芽成长的,是我将希望打破,生活没有了希望,我就像是一个泡影,随风飘摇,随时都有破灭的可能。当最后一片树叶落下,我知道我的人生也要走向另一个阶段。
