2017年河南省交通事故四级伤残赔偿标准

一、医疗费的赔偿标准

医疗费是指受害人接受医学上的检查、治疗和康复所必需的费用主要包括：挂号费、检验费、医药费、治疗费、住院费及其他必要的医疗费用。因侵权行为诱发受害人其他疾病的医疗费用，应当根据侵权行为与损害后果之间的因果关系和原因力比例等实际情况，予以适当赔偿对因果关系和原因力大小难以确定的，参照专业鉴定机构的鉴定结论由人民法院自行确定。

(一)挂号费。一般以就诊治疗单位的挂号凭据为凭证进行赔偿。

受害人无固定收入或除固定收入外还有其他不固定正当收入的，应参照受害前一年至三年的平均收入计算;

受害人不能举证证明其最近一年至三年的平均收入的，参照受诉法院所在地同行业或相近行业同等劳动力上一的平均收入计算。

受害人因没有工作或因离退休而主要从事家庭劳动的，参照当地县(市)级统计部门公布的上居民平均收入计算。

计算护理费应考虑护理人数护理时间和护理人员的正当收入标准：

(一)护理人数。一般不得超过二人，未住院或出院之后仍有护理必要的，护理人员为1人

(二)护理时间。限于受害人因伤害所导致生活不能自理或不能完全自理的期限。

(三)护理人员的正当收入标准。一般应参照受害人误工费正当收入标准进行计算;雇人护理的，护理费的赔偿额按当地护工从事同等级别护理的劳务报酬标准确认。但劳务费赔偿数额最高不得超过受害人所在地县(市)级统计部门公布的上服务业平均收入的两倍;

四、住院伙食补助费

营养费的赔偿数额一般为每天二十至三十元;计赔营养费的时间，以恢复伤情需要补充营养的实际期限计算。但计赔时间最长不超过六个月。

六、交通费、住宿费

就医交通费、住宿费是：指在治疗伤情的过程中，受害人及必要的护理人员必须乘车、乘船和住宿所支出的费用。

(一)就医交通费一般以交通费票.据的实际数额予以确认，交通费的票据应与就医及转院的：时间和次数相一致

住宿费每日的赔偿数额，最高不得超过受害人所在地一般国家工作人员出差的每日住宿费标准。受害人确有必要到外地接受治疗，因客观原因不能住院发生的实际费用，包括受害人本人以及护理人员的住宿

费和伙食费，其合理部分应予赔偿。

七、残疾用具费

为配备残疾用具所必须支出的交通、住宿等相关合理费用，亦应予以适当补偿

要求赔偿的安装假肢费数额，必须以受害人就地就近的残疾用具配制单位的普通性国产器具的价格为准加以确认;以大陆以外生产或进口的产品价格为准确认的赔偿数额一般不予支持，但该数额低于普通性国产器具价格的除外。八、四级伤残赔偿金

残疾赔偿金根据受害人丧失劳动能力程度或者伤残等级，按照受诉法院所在地上一城镇居民人均可支配收入或者农村居民人均纯收入标准，自定残之日起按二十年计算。但六十周岁以上的，年龄每增加一岁减少一年;七十五周岁以上的，按五年计算。

根据河南省各地法院在实际案例中判决的情况，为充分维护交通事故受害人一方的合法权利，本建议因交通事故死亡的，其近亲属可以所考虑一下因素：
