要求：提高补偿安置标准和落实社会保障补偿。

事实与理由：城郊乡实施紫东项目远离城区，在农业耕作区，200多亩上好的基本农田合理合法吗？

改变改善刘马洼村村民居住环境能实施吗？ 村里还在原宅基地上盖房，要他们搬可能吗？ 占补复垦能实施吗？土地综合整治能落实吗？

按4万元/亩补偿标准大部分未领，只有少部分是组干部代签的，而且有些还未领，要实事求是的说问题，回家土地承包政策长远有效，法律法规一再强调使征地农民生活水平有改善，长远生计有保障，失地农民没有了依赖生存的土地，没有城镇居民的社会保障在漫长的生活岁月里怎么办。

把开发商的利益和后期的现价标准向失地农民的生活保障方可稍微倾斜一点使我们以后生计更多一点点保障不行吗？

我们的这块土地平整耕作层深，土质肥沃，排灌条件好，亩产收益是西大岗、上王岗的2倍，又没有河滩地的洪水危害是高品质农田，我们人均地少（人均1亩）如果2亩那么情况则变了，还是实事既明显又合法合理的要求，希望政府给予解决。

河南省区片综合地价通知，我们不知道，但乡领导给我们解释我们是4万，最高的是20万/亩。

根据（国土资源部关于开展征地统一年产值标准和征地区片综合地价工作的通知。

妥善处理征地补偿标准的合法性、合理性、法定标准与农民的补偿要求切实维护征地农民的合法权益，保证原有生活水平不下降长远生计有保障要防止制订和公布统一年产值的标准和区片综合地价为由压低补偿标准，附件2中，修正因素主要考虑土地区位，人均耕地数量，土地供求关系，当地经济发展水平和城镇居民最低生活保障等因素。

3、对征地案例的比较修正应考虑区域因素，个别因素，时间因素。

另据2012年12月24日提请十一届全国人大常委会三十次会议审议土地管理法修正草案，草案删除了现行法47条中，按照被征地原用途补偿，土地补偿安置补助费的总和不得超过前三年平均年产质30倍的内容，已增加了社会保障补偿根据土地承包期以前为30年和今后长远有效这一实事，结合我们的实际，要求乡政府将补偿标准增至9万，和社会保障补助。

行政复议申请书

被申请人：河南省郑州市公安局交通警察支队第二大队，住所地：郑州市花园路与三全路交叉口向西400米路北。申请请求：

撤销郑州市公安局交通警察支队公安交通管理简易程序处罚决定书（编号410102-1102251846）

事实与理由：

申请人因不服上述处罚决定书之内容，特申请复议，理由如下：

1、处罚事实不存在。根据处罚书所记载，申请人系违反《道路交通安全法实施条例》第44条第2款的规定，该条款的内容是“在道路同方向划有2条以上机动车道的，变更车道的机动车不得影响相关车道内行驶的机动车的正常行驶”。而在事发时，申请人变更车道时，对本车道和被变更车道车辆均未有影响，所以处罚事实不存在。

2、处罚金额过高。根据《道路交通安全法》第90条的规定，罚款200元属于最高幅度的处罚，就申请人的行为来说，即使有违章行为，也属于及其轻微的违章行为，不应当

处罚200元。

3、处罚程序错误。首先，被申请人是属于交警支队的内设科室，不具备行政处罚主体资格，《行政处罚法》第十七条规定:“法律、法规授权的具有管理公共事务职能的组织可以在法定授权范围内实施行政处罚”，《中华人民共和国道路安全法》第五条规定:“县级以上地方各级人民政府公安机关交通管理部门负责本行政区域内的道路交通安全管理工作”，国务院《中华人民共和国道路安全法实施条例》第一百零九条规定：“对道路交通安全违法行为人处以罚款或者暂扣驾驶证处罚的，由违法行为发生地的县级以上人民政府公安机关交通管理部门或者相当于同级的公安机关交通管理部门作出决定”。因此，应当是法定的公安机关交通管理部门，具有对道路交通安全违法行为人进行罚款处罚的行政执法主体资格。而被申请人第二大队作为支队内设的科级单位，不具有行政执法主体资格，没有法律、法规授权实施行政处罚的权力。其次，根据《行政处罚法》第33条的规定“第违法事实确凿并有法定依据，对公民处以五十元以下、对法人或者其他组织处以一千元以下罚款或者警告的行政处罚的，可以当场作出行政处罚决定。当事人应当依照本法第四十六条、第四十七条、第四十八条的规定履行行政处罚决定”。也就是说，按照简易程序处理的违法行为，最多罚款不能超过50元，而被申请人被处罚200元违反法律规定。

第三，根据《行政处罚法》第39条第1款第5项的规定，“行政机关依照本法第三十八条的规定给予行政处罚，应当制作行政处罚决定书。行政处罚决定书应当载明下列事项：

（五）不服行政处罚决定，申请行政复议或者提起行政诉讼的途径和期限”。应当在处罚决定书中注明若不服该处罚决定可在郑州市哪个法院提起行政诉讼，但处罚决定书中该项为空白，这也违反了法律规定。

综上所述，该处罚决定书依据事实不存在，处罚金额过高，处罚程序错误，应当予以撤销，申请人特提起复议，请予支持复议请求。
