这周思修课学习的是与法律有关的内容，在老师的安排下，我们观看庭审现场的视频，可以说给我们提供了一个机会去接触真正的司法实践。通过观看，我了解了一般的司法诉讼程序，也领略了法官，检察官，辩护律师的风采，增长了许多法律知识。

第一个庭审案例讲述的是：两个从事文化管理相关工作的职员，甲方在相关文化部门工作，拥有一定职权。乙方在广告公司工作，熟悉营销制作。甲在工作单位有参与决策权，当他看到邀请相关企业参加学术交流性的会议可以收取许多费用时，就心生贪念，想通过自己的虚假策划来骗取钱财。于是，他就找到了有策划经验的乙方，二人假借国家某些协会的名义发布邀请函，伪造印章，诈骗钱财。

这个案例的两人犯了伪造、变造、买卖国家机关公文、证件、印章罪。指非法制造、变造、买卖国家机关公文、证件、印章的行为。本罪在客观方面表现为伪造、变造、买卖国家机关公文、证件、印章的行为。所谓伪造，是指无权制作者制作假的公文、证件或印章，既包括根本不存在某一公文、证件或印章而非法制作出一种假的公文、证件和印章，又包括在存在某一公文、证件或印章的情况下而模仿其特征而复印、伪造另一假的公文、证件或印章。既包括非国家机关工作人员的伪造或制作，又包括国家机关工作人员未经批准而擅自制造。另外，模仿有权签发公文、证件的负责人的手迹签发公文、证件的，亦应以伪造论处。所谓变造，则是对真实的公文、证件或印章利用涂改、擦消、拼接等方法进行加工、改制，以改变其真实内容。所谓买卖，即对国家机关公文、证件或者印章实行有偿转让，包括购买和销售两种行为。至于买卖的公文、证件或印章，既可以是真实的，也可以是伪造或者变造的。根据相关法律条款，伪造、变造、买卖或者盗窃、抢夺、毁灭国家机关的公文、证件、印章的，处三年以下有期徒刑、拘役、管制或者剥夺政治权利；情节严重的，处三年以上十年以下有期徒刑。

第二个庭审案例：春节联欢晚会中剧本、音乐等作品侵犯他人著作权的问题，在现实生活中出现了较多案例，如李丽霞诉李刚、陈红、蔡国庆侵犯邻接权、录音制作合同纠纷案，李丽霞认为她作为那一年春晚作品《常来常往》伴奏录音制品的共有人，对该伴奏录音制品的编曲享有相应的著作权和邻接权，曲作者李刚未经同意，将该伴奏录音制品转让给他人使用并从中牟利，陈红、蔡国庆明知该歌曲伴奏录音制品存在权利瑕疵，但仍使用和播放，侵犯了她的著作权和邻接权。法院最终认定李丽霞所主张的编曲权即是著作权法中的录音制作者权，虽然李丽霞确曾为伴奏带的制作投入资金，但该出资并不是获得制作者权利的对价，而是合作参选、分担投资的方式，法院最后判决李刚退还李丽霞制作费4千元，驳回了李丽霞的其他诉讼请求。

这个案例与著作权有关。著作权也称版权，是指作者及其他权利人对文学、艺术和科学作品享有的人身权和财产权的总称。著作权要保障的是思想的表达形式，而不是保护思想本身，在保障私人之财产权利益的同时，须兼顾文明之累积与知识之传播，算法、数学方法、技术或机器的设计均不属著作权所要保障的对象。实质条件是指法律对作品的要求，大体有两种标准。一种标准是只要特定的思想或情感被赋予一定的文学艺术形式，这种形式无论是作品的全部还是其中的局部，也不问该作品是否已经采取了一定物质形式被固定下来，都可以依法被认为是受保护的作品。另一种标准是，除了具备作为作品的一般条件，即表现为某种文学艺术形式外，还要求这种形式通过物质载体被固定下来，才可以获得著作权法保护。按照这种标准，口述作品以及一些即兴创作的舞蹈、音乐、曲艺作品，就可能被排除在著作权法保护之外。我国著作权法采用第一种标准。口述作品等均可以成为著作权法的保护对象。著作人身权是指作者通过创作表现个人风格的作品而依法享有获得名誉、声望和维护作品完整性的权利。该权利由作者终身享有，不可转让、剥夺和限制。作者死后，一般由其继承人或者法定机构予以保护。根据中国《著作权法》的规定，著作人身权包括：发表权，即决定作品是否公布于众的权利；署名权，即表明作者身份，在作品上署名的权利；修改权，即修改或者授权他人修改作品的权利；保护作品完整权，即保护作品不受歪曲、篡改的权利。

当然，通过观看我也了解庭审的程序：首先，审判长询问被告人的基本情况，告知其有申请回避权、辩护权、最后陈述权等权利和如实陈述事实，遵守法庭纪律等义务。其次，进入法庭调查阶段，公诉人宣读起诉书，询问被告人是否认可。公诉人、辩护人、法官依次向被告人发问，对起诉书的内容逐项核实。再次，由公诉人出示证据，包括公安机关的抓获经过，证人证言，由被告人及律师逐一确认。被告人及律师出示证据，然后由公诉人确认证据。法庭辩论阶段，公诉人发表公诉意见，指出犯罪事实应当承担刑事处罚，说明被告人主客观都有犯罪事实，构成犯罪要件，罪名成立。被告人及律师发表辩论意见，开脱罪责，力争无罪或降低惩罚。最后，由被告人做最后的陈述，审判长宣布休庭，择日宣判审判结果。

经过这次观看，我学到了不管是法官还是当事人应当注意的问题。语言表达能力十分重要，要有严谨的逻辑，抓住关键点。同时我增长了相关法律知识，清楚了庭审的基本过程。我想这对增强个人的法律意识是大有益处的。

今天上思想道德修养与法律课基础课，老师带领我们观看了法官庭审过程的视频，这些视频给我印象很深刻，我第一次了解到法官是如何执法、评判的。

一打开视频呈现的场面就给人一种严肃而庄重的感觉。一上来是法官上场，然后就是法庭审判，首先法官让罪犯自我介绍，接着问了罪犯有关案件的具体过程，当罪犯回答问题模棱两可时法官会及时提醒，让他们说关键问题，当一切问题询问清楚，各项证据齐全，经过公诉人与法官的商讨，最后依据我国法律对罪犯进行定罪。这一切说起来轻巧，但实施起来却不容易。

法官的高效办案，科学合理进行询问，在法定期限内及时履行职责，不无故拖延时间、浪费资源，这种办事认真的态度值得我们学习。他们对工作一丝不苟，认认真真，清正廉洁，遵守各项廉政规定，没有利用法官职务和身份谋取不正当利益，他们一心为民，落实司法为民的各项规定和要求，做到了听民声、察民情、知民意，坚持能动司法，树立服务意识，做好诉讼指导，风险提示，法律释明等便民服务，避免了“冷硬横推”等不良作风。他们严守纪律，遵守各项纪律规定，不泄露个人隐私，他们敬业奉献，热爱人们司法事业，增强职业使命感和荣誉感，加强业务学习，提高司法能力，无私奉献，他们遵守司法礼仪，执行着装规定，言语文明，举止得体等等，他们身上这些优点都值得我们学习。

在我们今后无论是学习还是生活中，我们都应该像法官一样，对待自己份内的事认认真真，一丝不苟，并且也要学会奉献，不要斤斤计较，并且也要有职业节操，不能利用自己的职位做一些损害集体利益的事，一定要严于律己，秉公办事。

在庭审过程中，罪犯主动交代了自己犯罪行为，这件事情的起因是因为罪犯想要多赚一些钱使得自己的生活过的好一些，因此才动起了歪脑筋，他找到了一个同乡，说是有一个发财的好机会，那个人听了之后也心花怒放的，因此两个人决定获取不义之财。主犯利用自己的职位多次用低价采购商品，然后和同乡一起以高价卖出，以此来赚取差价来获得利润。两人一见钱来的如此容易，便一次又一次利用职位之便来获取更多钱财，不料，事情败漏了，两人相继被抓。

在法官审判过程中，两人如实的交代了自己的犯罪过程，在最后的陈述中忏悔到：他们自己已经意识到自己的错误，他们会努力改正，希望法官给他们这个机会，争取给他们宽大处理。虽然罪犯已经认识到自己的罪行是多么的大，但这也于事无补，他们将要接受的是法律的审判，他们要为自己的罪行负责。虽然法官很同情他们，但是，国有国法，家有家规，只要你犯错，你就要为自己的过错承担应有的惩罚，因此，经过商议，法官按照国家宪法给他们定罪。

法官在审判过程里，一直严格遵守宪法纪律，将个人感情埋藏在心中，秉承着一颗忠于职守、秉公办事的心，对罪犯、对案件进行严格审理，不掺杂一点私人情感，最终做出了公正的审理，给罪犯，同时也是给受害人，更是给社会大众还原一个真实的真相，让大家了解事情的原委。

通过视频让我见识到法官的重要性。法官是评判一个片案件的关键人，如果法官不能做出正确的决定，会给使得受害人得到不公平的待遇，因此，法官一定要秉公办事，收起自己的同情心，严格按照司法程序给大家一个交代。

法律是公正的，是严明的，同时也是不可侵犯的。我们的任何社会行为都受着法律的约束，试想一下，如果没有法律，那么这个世界是怎样的一锅粥？抢劫，杀人，绑架，防火……不过是家常便饭而已。

我们作为一名大学生，应该努力学习，遵纪守法，做一个讲道德，守法律的好公民，将来成为一个对国家、对社会有帮助的人。

在看了《法外情》 《一级恐惧》 《一级重罪》 《沉默的羔羊》···等几部精彩的电影之后，我收获的不仅仅是视觉和情感上的冲击、以及对人性和理性的思考，还了解到一些法律上的知识，通过中国与美国的法律电影认识到它们法律制度的区别。

在这几部电影中，最令人感动的莫过于《法外情》了，影片情节曲折感人，部分片段有令人泫然而泣的效果。主要讲述老妓刘惠兰因自卫杀死了出身名门的嫖客曾某，仅在伦敦大学法学院刚毕业的刘志鹏出于正义愿为她出庭作证。在种种的压力下，凭着他的不屈不挠，与著名的主控官展开一番舌战唇枪，几经艰苦，终于得到胜利，使被告得以无罪释放。这部影片提出当时低下阶层对社会贫贱富贵的控诉及法与情之间的矛盾，让观众产生极大震撼与共鸣。它讲述的这个故事让人们认识到原来在理性的法律制度下，还是有着真情存在的。都说“法不容情”，可是若是心怀真情和正义，便终将会赢得胜利！法律只是一种保护权益的手段，它最终还是为了人们的权益而存在，为了正义而存在。总之，坚持正义必胜！

《一级恐惧》是一部美国电影，电影讲述芝加哥发生了一桩震惊全城的恐怖血案。德高望重的老主教罗森被人谋杀，身上共被刺了78刀。警察在现场抓到了满手鲜血的少年艾伦。著名律师马丁·威尔决定经办此案。他在拘留所看到了面色苍白，稚气未脱的艾伦，通过交谈他认为艾伦是无辜的，并决定免费为他辩护。其中，有这样一句台词，威尔对艾伦说：“我来说，你不必说。你要做的就是看起来很无辜的坐在那。”为什么要表现的很无辜呢？因为要获取陪审团的支持，陪审团对一个案件的判决非常重要。在美国，审判中都会有陪审团出现。在英美法系中，陪审团制度是十分重要的一项制度，它对案件的判决起着十分重要的作用。因为陪审团来自社会各个阶层，一个案件的判决能够说服陪审团，意味着能够符合社会广大阶层的正义观和价值观。在我国，显然是没有陪审团这一制度的，这也是中国和美国司法制度的最大不同之处。

这部影片剧情很精彩，让我们对人性有了更深层的认识与反思，影片最后威尔胜利了，成功为艾伦脱罪，他去向艾伦告别，大家都以为高潮已过全局终，正义战胜邪恶。在受压迫的弱者得以沉冤昭雪时，人性的秘密却再一次被泄露出来——严重的不公经历是会对心理造成扭曲的，再纯洁的灵魂也不会幸免遇难。或许的确存在过罗伊与艾伦同时并存的时候，也许是在主教刚收留他，也许是很小的时候，被变态父亲凌辱时，两种面孔同时占据着他的身体。但最终，为了改变现状，结束这令灵魂颤栗耻辱的一

切，懦弱的艾伦最终完全消失了，没有等来任何及时救赎的纯洁良知泯灭了，取而代之的，是愤怒，残忍，暴力的罗伊，他更残酷更强大，所以更适应这个世界。就像影片最后罗伊向威尔喊的那样，“你会感激我的，你总会变得心狠手辣。”片尾威尔定定地站在那里，没人知道他在想什么。是否仍然相信人性本善呢，是否依旧如往日为他感兴趣的杀人犯辩护，探究为何善良的人也会杀人。他是否仍然对自己的信仰坚信不疑，还是仅仅将之归结到自己洞察人性的能力不足呢。一切无从知晓，如同最后那首嘹亮澎湃的葡萄牙小曲一样，鬼魅一样的曲调，久久地盘旋在观众心中，亮丽而妖异如同夜幕下大海中折射着月光的美丽鱼鳞，剔透晶莹地隐现在暗潮汹涌的浪涛之间。法律虽然无法代表人性，但我们却可以在这个过程中探索人性，思考和反思自身。

提到《一级重罪》，不得不提到案中的军事法庭，军事法庭与一般的法庭有所不同，因为可能会涉及到国家机密，不能公开审理，其中的一些制度、规则、称呼都有一些不同。查理说：“如果军歌可以算作音乐，那么军法可以算作司法”“军法体制以否决为基础，挑战体制？NO，照体制内的游戏规则，挑战必输无疑”，由此可见一斑。这部影片主要讲述的是旧金山女律师克莱尔与成功商人汤姆一直过着令人羡慕的婚姻生活。然而这种平静瞬息之间就被打破了，就在两人在街巷中散步时，却有不知何处来的大批军警忽然把两人围住，把汤姆强行带走。几经查问，克莱尔终于被告知，丈夫曾是秘密军人，而军方现正指控他在巴西的萨尔瓦多犯下了“屠杀罪”！涉及国家机密，丈夫的案件不能公开审理。军事法庭又是军队高层说了算，录音带不被采证，医疗保险单不被采证，甚至克莱尔有可能被剥夺辩护资格。于是克莱尔找到了陆战队律师查理一同来调查这场诡异的官司。

看这部电影的时候感触很大，为了国家的利益，为了上级的命令，海军陆战队的官兵被国家洗脑，一件件罪恶滔天、任意杀伐的事出自他们的手下，事情败露后总得有人顶雷，这个人要么是死去的人，要么是其中一名部下。

最后在克莱尔的努力下，国防部撤诉了，原因是涉及到了国家机密，可是这中间又有多少不为人知的事情呢？真相面前没有真爱，克莱尔费了九牛二虎之力查了个翻天覆地，把丈夫变成无罪释放，到头来却是一场连环欺骗？丈夫追杀战友，后来追杀丈夫的人也来了，到底谁有罪，谁是罪恶的源头？ 临死的丈夫说：“我不希望这样做，对不起”，是谁逼他这样做，是谁让他离开爱的轨道越来越远，是谁将他视为秘密的一环，让他把环前环后清除，再清除他？到底还有多少掩饰的罪行比我们的想象还要大？到底还有多少无辜的生命，将倒在他们黑色堂皇的枪口下？这恐怕又要引发

我们新的反思了。

最具有悬念最惊悚的影片当属这部《沉默的羔羊》，影片中的克拉丽丝是联邦调查局的见习特工。她所在的城市发生了一系列的命案，凶手是一名专剥女性的皮的变态杀人犯“野牛比尔”，迄今为止，受害的女性已达5人。克拉丽丝的任务是去一所戒备森严的监狱访问精神病专家汉尼拔博士，同他进行面对面的交谈，以此获取罪犯的心理行为资料来帮助破案。汉尼拔被关在地牢里，他是一位智商极高、思维敏捷但高度变态的中年男子，并且是个食人狂魔，他要求克拉丽丝说出个人经历供自己分析以换取他的协助。他是一位造诣很深的精神病专家，然而具有讽刺意味的是，他自己就是一名精神病人，更确切他说是一名心理变态者，“明知自己在犯罪却毫不在乎的精神变态者，纯粹同社会作对”。影片通过探索人物心理疾患，试图探寻当代美国社会恐怖的根源，这使得影片的主题得以深化。在影片中，那种精神上的对抗、那种“天使和魔鬼”的鲜明对比、那种建立在较缓慢节奏上的内在哲理性给人的印象是深刻的，广泛地引起了公众对社会犯罪、恐怖以及邪恶势力的憎恶和谴责。

看完这几部电影，真的获益匪浅，钦佩那些电影主角的勇气，智慧，坚持和正义；感慨军事法庭的特殊化；赞叹陪审团制度的人性化。总之，学到了很多。如今，随着时代的进步，无论政治，经济，文化，还是法律都逐渐呈现一体化，各国的联系也越来越紧密。我相信我国对外来事物“取其精华，去其糟粕”的方针终将进一步完善我们的各方面体制，依法治国在不久的将来肯定会得到最大化的贯彻和实施。让我们共同期待明天完善的法治社会！

When i first watch this movie,i find one great problem which is the real name to this movie.I get two name for movie.One is The devil wear the pARADA,the other name is the queen wear the pARADA.these names have so many same place,but they have only one place diffierent whether is devil or queen.In my sight ,this perspective out a problem which relate to the values.Some people think the person who like Miranda priestly version of a workaholic is the devil which can't be understand by normal citizen who have not ambitions and ideal.Those people don't have to work enthsiasm.In these eyes,enjoy life is the kingly way.No more easliy than the freedom of anythingof value.Maybe this is the true meaning of American.But by my side,i think this situation is not only in America but in whole world!NOTHING SEEK WITHOUT MOTIVE!

The Olympic Games, which originated in ancient Greece, is the most distinguished sporting event in the world.Once every four years, the utmost athletes from all around are lured to gather together and spare no efforts to compete against each other and try to win a medal for the country that they represent.Frankly speaking, that was virtually all I knew about the world-famous Olympic Games before I had read a book entitled The Olympics published by Foreign Language Teaching and Research press.However, I found even more philosophy beyond just winning medals from reading the book, which was beyond my imagination and considerably inspiring.Someone once said, “Were everybody on earth involved in some kind of sport, our world would be free of war for long.” Starting from three thousand years ago, the ancient Olympic Games has long been an event not only for competition but also for peace.In ancient times, no war was allowed between the cities during the Games, which was rather surprising to me since I could hardly imagine warriors actally putting down their weapons and give a break for peace.The precious tradition of peace continued: I would never fail to recall the scene of the opening ceremonies when North and South Korean athletes entering the stadium with their hands held together.The two neighboring countries that used to be enemies are no longer enemies during the Games.Instead they became friends.Speaking of the XX Athens Olympics, perhaps most people would have the same opinion that the most noable part of the opening ceremony arrived when Iraqi and Afghan representatives showed up.These two unfortunate nations, the people of which have undergone innumerable wars, are coming back again to take their own responsibility in world sports after recent invasions by America.The fearless people of Iraq and Afghanistan are once more sharing the spirit of the Games with people from the rest of the world.There is another story in this book that makes me deep in thoughts.There is no doubt that the most unusual Olympic Games ever in history is the 1936 Olympics held in Germany, which was then ruled by the Nazi party.Led by Adolf Hitler, the Nazi believed that the so-called Aryan people were superior to all others in all aspects.They looked down upon Jews and blacks, the latter of which was a major constitution of the United States Olympic team.Despite the barrier that faced him, the African American Jesse Owens, who was a most outstanding runner and jumper, did all that he could and finally won gold medals for his country and went home a hero.This reveals another fact that no power on earth is able to hinder the sacred Olympic Games.For all participants, no matter what their gender, race, nationalities and backgrounds are, equality is distributed among every one who observes the Game’s rules.At the XX Athens Olympics, our Chinese team did extraordinarily well.We ranked second on the medal lists for the first time in history.In my opinion, however, we should not only concentrate on the figure of medals;instead the strength and perseverance of those who failed to get any medals ought to be highly cherished.Whether ever success or failure, whether ever cheer or tear, whether ever medal or not, the never-gave-up spirits of athletes are always motivating us.I believe in the year 2008, the world will focus all their attention to Beijing, China, where the glory of the Games will continue to thrive forever!
