The American law
What does it mean to obey the law? That depends on where you are.Different cultures have very different views of obeying the law.In some cultures, law-abiding citizens try to keep the letter of the law.That is, whatever the law says, they do.In other cultures, good citizens live by the spirit of the law.They see the law only as a general guideline.Often they obey the law only when someone official is looking.The situation in America fits into the first category.That doesn't mean all Americans keep the law.But American culture teaches people to respect the law--even to the smallest detail.One reason is about America's Christian.It’s heritage[文化遗产] has shaped how people view the law.For one thing, the Bible reveals God's unchanging laws which people must obey.It also teaches people to respect human authority as established by God.For example,driving habits illustrate American respect for the law.A driver will usually stop for a red light, even when there are no other cars around.People treat the lines marking streets and roads as definite[明确的] boundaries, not just decorations.Vehicles[机动车] yield[让出] to those with the right of way-particularly pedestrians[行人].Actually, though, drivers don't always keep traffic rules.For example, many drivers ignore freeway speed limits.But Americans generally drive with careful attention to the rules.Of course, not everyone in America abides by the law.Crime is a growing problem.However,skilled lawyers sometimes use minor issues to get their clients[委托人] set free.And prison inmates may live even better than many poor citizens.Anyway,no one believes a perfect legal system is possible.Yet every society has laws.Whether people follow the letter of the law or just the spirit of the law, they recognize the need for laws to keep order in society.Without them, the society would be chaotic[混乱].If every man were a law unto[向,对] himself, no man would be free.

美国法律文化漫谈--------以《费城的故事》为视角
安德鲁和乔是费城的两名年轻律师,他们工作努力,都有美好的前途。安德鲁是一名同性恋者,并且染上了艾滋病。他没有将这些告诉老板。就在他刚获提升不久,却因老板发现了秘密而以他丢失文件为由把他解雇了,安德鲁找到乔希望他接受这个案子。乔本来拒绝受理,但出于对安德鲁的同情以及对法律公平平等原则的追求下,最终答应出庭。
安德鲁的家人支持他走上法庭。开庭审理时,众多示威者聚集在法院门外,要求给同性恋者合法权益,不准歧视艾滋病人。但同时也有反对者大呼“肛交者没有人权”,拦截安德鲁质问。被告坚持不承认是因此原因解雇安德鲁的。安德鲁衰弱的身体已无法承受剧烈的抗艾滋病药物的静脉注射,他预感到自己快不行了。但他仍坚强地挺过了激烈的法庭答辩。
到了审判的日子,陪审团终于宣判原告安德鲁受到不公正解雇,被告应负责赔偿损失。安德鲁终于获胜了。乔奔赴医院将这一消息告诉了安德鲁和他的家人,但安德鲁却不能再支持
下去了,他正在慢慢死去。
《费城故事》讲述了一个艾滋病患者用法律维护自己权利利益的故事,它被称为“好莱坞面对艾滋病”的影片。它标志着好莱坞不再逃避社会现实,而正式向泛滥美国的艾滋病宣战了。影片号召人们关心帮助艾滋病人,同时赞扬了艾滋病人自强不息的奋斗精神,在社会引起广泛关注。
片中的故事及其结局并不复杂,但他却向世人提出了一个道德问题,对于艾滋病人应该象其它病患者一样给予爱护和帮助,这在哪里都是被认可的,但对与同性恋我们应该采取什么样的态度?在影片中,安德鲁和他的“恋人”并没有受到他家人的不平对待,但是社会的偏见依然存在,哪怕他最终胜得了这场官司,但并不等于他获得了社会的承认。影片正是在这样一种沉痛而又无奈的气氛中结束。它敢于大胆的向社会提出这一问题本身,就标志着这个社会正在前进。

——维护公平正义的法律人 费城故事由汤姆.汉克斯与丹泽尔.华盛顿共同主演,讲述了一位因为同性恋而患 上了艾滋病的律师遭遇歧视、不公正待遇,但是却在另一位律师的帮助下最终维护 了自身合法权益的故事。影片中,Andy 是一个非常优秀的律师,但是由于他因为同 性恋而患有艾滋病后,他的世界即发生了翻天覆地的变化。但是让人感动的是,他 的家人并没有嫌弃他,而是包容他,在整个社会都遗弃他的时候,为他撑起了一片 小小的却温暖的天空。Miller 本质上是一个善良的律师,虽然一开始他对同性恋的 态度也是不解、嘲笑,想与之保持距离,但是后来他渐渐的接受 Andy,并且成为 Andy,甚至是同性恋者的代言人,他要承担的并不是来自于官司本身输赢的压力,并且还有社会对于他这种行为的排斥和误解。但是他却坚持了下来,我想这不仅是 因为他本身善良的本性,最重要的是他作为一个法律人的责任感,始终坚持公平正 义。他在实践“法律的目的在于公正”。作为一个律师,应当为辩护人的合法权益据理力争,以法律为依据,以公正为 基础,以维护被害人的利益为根本。不能以自己的喜好和标准去评价当事人、为当 事人辩护。所以虽然 Miller 一开始对同性恋者的态度并不认同,但是后来他心中法 律人的自觉唤醒了他,他放弃自己的喜恶,以一个律师的角度去了解 Andy,体谅同 性恋者,真正的从他们的利益出发,为正义代言。法律的公正是没有国界的,在中国,根据《律师职业道德和执业纪律规范》第 四条、第五条的规定,律师应当忠于宪法和法律,坚持以事实为根据,以法律为准 绳,严格依法执业。律师应当忠于职守,坚持原则,维护国家法律与社会正义。律 师应当诚实守信,勤勉尽责,尽职尽责地维护委托人的合法利益。因此,律师的职 业操守既要维护法律的公平,公正,还要为辩护人作出最大的“维护”。但是现实生 活中,往往不尽如人意。每个法律人学生时代都对法律有着美好的期待和向往,社会的残酷,腐败的风 气却使这些公平正义的愿望被逐渐消磨殆尽,面对物欲横流的社会,即将走向社会 的我们应该怎样选择?我并没有想好,也没有准备好以一个法律人的身份走向这个 社会,我想,我能做的只有严格的要求自己,虽然没有能力帮助别人,但是我能做 到的是匡扶自己心中的正义,不去做违背公平正义的事。不管怎么说,法律职业的初衷是善的,只是需要一代又一代的人不断的去克服 恶劣的现实环境,建构一个框架,使其真正能够实现其最初的价值取向。律师
是一个高尚的职业,它值得我们的尊敬。

费城故事》观后感
《费城故事》讲述的是一个只因患了艾滋病又是同性恋者而被解雇的优秀律师在另一名律师的帮助下勇敢维护自己的权益的故事。其实,看这部影片之前,我已经不再像以前那样鄙视同性恋者、觉得他们恶心了,这还要感谢《西窗法雨》中“少数人权利”疑问给了我一颗理解、包容同性恋的心。而对于艾滋病患者,我向来表示同情和怜悯。影片中Andy的每一个抽搐痛苦的镜头都能引起我极大的爱怜。
这部影片还让我爱上了里面那些或宽容、或勇敢、或善良的人们。
爱上Andy的家人。或许同性恋者最看重的并不是社会的不认可和他人的鄙视,而是能够得到家里人的支持。而往往,这却是为亲人们所不齿的。可是Andy的家人,不管是他的父母还是他的兄弟姐妹都是那样无所顾忌地亲吻拥抱着他,关心支持着他,尽管Andy还患有具有传染性的艾滋病。记得他的哥哥说:“You’re my kid brother,that’s all that matter.”他的母亲说:“I didn’t raise my kids to sit in the back of the bus.”相信这些轻轻的话语给了Andy巨大的力量。而当然Andy的“爱情伴侣”Miguel则更是Andy心灵得以依偎的肩膀、得以停靠的港湾。舞会上的相依,眼神中的交流,病房里的亲昵无一不打动着我们,同时也似乎要坚定地阐述:同性恋同样也是一种感情的寄托!
爱上勇敢的Andy。首先感动于演员汉克斯把身为同性恋者和艾滋病患者的情感、痛苦和坚强如此自然平淡地诠释出来。对比同是同性恋影片的《蓝宇》,《费城故事》不会太出格,太露骨,而是能让大部分观众接受并更能促使观众抛弃偏见产生共鸣。而Andy也正如律师Miller所说;“他是一个真正的战士”。不顾世俗的眼光,不顾社会的舆论压力,勇敢地成为社会上第一个维护自己的利益,身份地位以及声誉的同性恋者和艾滋病患者。片头曲有一句是这样唱的:“我继续走在街道上,直到我的腿不能再动为止”。Andy正是这样坚定地为自己争取权益,尽管坎坷还是要继续,直到他进入天堂……可是即使他已经走远,但是他所代表的精神依然会为人们特别是同性恋者和艾滋病患者所传颂。
影片中,我还爱上善良的律师Miller。影片前部分所呈现的那个Miller不理解甚至嘲笑同性恋者,害怕并且只想与艾滋病患者划清距离——这也正代表着当时极大多数人的心里和偏见。可是善良的他渐渐地由原来的逃避,到与Andy在图书馆的面对面,再到法庭上的并排坐,最后到病房的亲切问候,并为Andy小心翼翼地摘下氧气罩——这或许是出于律师应有的正义感和责任感吧。而当他开始为Andy打官司时,就像是成为了同性恋者、艾滋病患者的代言人,他所要承担的并不是简简单单的能否把官司打赢的压力,还有社会上对他的讽刺(特别是因为同性性行为而染上艾滋病更被人们认为是对同性恋的惩罚)和误解——误以为他也是个同性恋者。从法庭外面那么多反对Miller胜诉的示威者也可看出Miller代理这件案子是件吃力不讨好的事情。从始终如一地帮助着Andy的Miller身上,我看到了一个法律人应有的品质:始终坚持正义,为弱者讨公道!
确实,最是钦佩Miller的职业道德和责任感,他真正的实践了“法律的目的在于公正”。
可是写到这里,不禁觉得:或许每个法律人曾经学生时代都有着维护只能正义为人民申诉的强力情感和愿望吧,可一旦踏入社会,都无一能幸免于那残酷的现实。生活的压力,恶劣的风气,贪婪的欲望悄无声息地把青少年时的梦一点点地消磨殆尽!又记起高三时在西南政法大学的一个师兄来我们班开展交流会时,他说因为他觉得我们国家的法律制度太混乱太腐败了,所以最大的愿望就是以后能够完善中国的法律制度,推动中国法律风气往良好方面发展。先不说师兄是否能完成这个梦想,只愿师兄能以此鞭策自己一生。而我,也希望自己能永远保持着现在还有的对腐败的鄙视对贪官的憎恨,日后留心灵一片净土。另外,从影片中,我们也看到律师Miller打赢这场官司是多么的不易,需要通过并没有明确规定保护艾滋病患者利益的法律条文来阐述他们利益的合法性,还需要善于措辞勾起陪审团的共鸣。且不说法学是无止境的,就当前来说,法学这门专业是需要专心学习和研究的,希望自己能够努力认真的学习。
回归这部电影的主题。
正如《西窗法雨》所说:如果一个人的所作所为不会影响他人的自由,那么他便应当享有这个行为的权利,而且,当大多数人的利益不足以成为否认个人行为的充分理由时,个人就具有了这个权利。总而言之,大多数人的喜恶似乎不能作为个人权利的唯一立法依据。我们可以不承认不认可“同性恋”,但是这不能成为他们应当消失应当受惩罚的理由,他们的“恋”跟我们的一样,需要的是一个感情可停靠的港湾。我们不喜欢,但不能否认它的存在以及它确实是某些人的需求。而艾滋病患者同样也拥有我们正常人有的“人权”,影片中也说道:“1973年的联邦康复法案禁止歧视伤残人士,只要他们能担任工作。虽然法令没有提到对艾滋病的歧视,但是随后的法案规定,艾滋病也属伤残受法律保护,不仅仅因为病者身体上的限制,还因为受到社会人士的歧视,更精确地说,这种社会性的死亡……这种死亡超过了身体上的病痛。”
片头曲的那句歌词“夜幕已降临,我感到生命正离我缓缓而去,请你用纯洁的吻来接受我吧!”或许是同性恋者、艾滋病患者心底的呼唤吧!希望我们每一个人都能用正常的眼光来看待同性恋者,用关爱的心态来温暖艾滋病患者。
