如何向违约离职员工索要培训费
企业在对员工出资培训后,通常会给员工设定一个服务期,有些员工在服务期未满时便提前违约离职,但又不愿支付培训费或违约金,对此很多企业都感到非常棘手。
1.法律规定违约离职员工应当支付违约金
我国《劳动合同法》规定:“用人单位为劳动者提供专项培训费用,对其进行专业技术培训的,可以与该劳动者订立协议,约定服务期。劳动者违反服务期约定的,应当按照约定向用人单位支付违约金。违约金的数额不得超过用人单位提供的培训费用。用人单位要求劳动者支付的违约金不得超过服务期尚未履行部分所应分摊的培训费用。”
一般来说,企业会给一些优秀员工提供培训以提高他们的技能,使其更好地为企业做贡献。在企业这一目标实现的同时,员工也提高了个人的技能和水平及自身的市场价值。很多企业的骨干员工经过培训后会更优秀,可能很快就被竞争对手以高薪挖走,对此企业通常会要求员工支付巨额的培训费用,但员工往往不愿意支付,这就产生了纠纷。
案例
——企业能拿回巨额培训费吗?——
某企业的一位员工在国外接受了一年的公费培训,回国后工作不到3个月就被一家竞争对手挖走了。对此,企业认为该员工应支付企业用在他身上的培训费用共计20万元,否则就不能离职,而员工表示自己没钱支付,便强行离开了。
企业不甘心损失20万元的培训费,于是向劳动争议仲裁委员会提起仲裁。开庭后,仲裁员先进行调解,对企业说:“这个情况我们已经调查清楚了,这位员工确实违约了,但他又确实赔不起20万元。不如我们给他做做工作,看看他能拿出多少钱来,就拿出多少来支付
给你们,你们看行不行?”对此,企业表示不同意。这时,仲裁员又说:“如果你觉得亏,不进行调解,那就直接做裁决,让他赔偿20万元。但企业基本上也拿不到,因为他坚持说没钱,就只能去法院申请强制执行。但这个员工一是没结婚,跟父母住在一起,很难界定他有什么个人财产;二是他没有个人存款,即使有,企业没有他的账号,法院也无法执行。”
听完仲裁员的解释,企业负责人也犯了愁,到底怎样才能拿回巨额的培训费呢?
在这一案例中,仲裁员的这种解决方式会对企业造成很大的负面影响:一方面,企业无法获得足够的赔偿,经济上蒙受了损失;另一方面,企业的其他员工看到只要支付很少的赔偿金就可以离职,很可能会效仿,况且企业以后还会大量培训员工。
2.企业向违约离职员工索要违约金的有效方式
事实上,在向违约离职员工索要违约金时,企业可以采取一系列行之有效的方法进行处理:
第一步,企业可以起诉违约离职员工,要求其支付违约金,同时不接受减少违约金的调解,而是要求仲裁庭做出员工必须如数赔偿培训费的裁决。
第二步,拿到裁决后,企业可以把裁决书的内容在内部做通告,并附上一个通知,说明本公司的员工××违约以后不支付违约金,公司提起了仲裁并且胜诉了,结果是员工必须如数支付违约金。这样,能够让企业的其他员工感受到企业鲜明的态度和决心。
第三步,如果员工拒不支付且无法强制执行,企业可以在申请强制执行的同时,请法院做出“中止执行”的裁定,即员工目前没有财产可供执行,一旦企业发现他拥有财产,就可以到法院申请恢复执行。换言之,这笔违约金会成为该员工终身背负的一笔债务。
第四步,企业可以与员工约谈,说明企业已经掌握了他在新单位
工作的情况和薪酬待遇,目前可以不要求对方一次性支付,而是签署一份分期还款协议,以这种方式支付培训费。
第五步,如果员工拒绝签署分期还款协议,企业可以将员工新就职的单位提供给法院,从法律上讲,法院可以向新单位发出协助执行通知书,责成新单位协助执行,内容大约是“该员工目前欠原单位违约金多少元,现要求你单位协助执行,每月从该员工的工资中扣除多少元交给法院,由法院转交给原单位”等。
经过上述步骤,员工在分析利弊得失后,通常会同意签署分期还款协议。最后企业不但能拿回全部培训费,更让其他员工看到企业有足够的法律手段追回培训费,震慑其他员工,打消其他员工跳槽的念头。由此可见,企业对于员工违约离职行为必须进行坚决而有效的处理,拿回培训费只是其中一个直接目的,更深层的目的是遏制其他员工的违约行为,让员工安心履行完服务期。
