近年来,随着法治的深入人心,民众权利意识高涨,越来越多的人知道了权利与自由是个好东西。但是权利意识的提升并不代表法治意识的提升,法治的真谛在于权利义务相统一。权利与义务、自由与责任分别是一枚硬币的两面,人在享受权利的同时要履行义务,在行使自由的同时要承担责任。法治社会既是个人权利得到充分保护的社会,同时也是个人必须承担相应责任与义务的社会。
就老虎伤人这个事件来讲,动物园的责任来自于动物园的过错,过错是动物园承担责任的前提。动物园在这个事件中到底有没有过错,还需要有关部门的调查结论,这里不能先入为主,但死者家属认为“动物园就不应该让无票者进入”这种说法显然站不住脚。仅从常理上推断,没有一个公园会主动放逃票者进入园区,尤其是民营动物园,更不会忽视门票管理。而公园的管理是为大多数正常游客设计的,不可能专门为那些挖空心思的逃票者设计防逃票措施,公园只要尽到了正常的管理义务就可以了。
当然,可能还有人会说,民法上不是还有一条叫无过错责任吗?的确,民法上确实有这样一种“严格责任”的规定,但是只要我们稍微了解一下就会知道,所谓无过错责任不是在所有问题上都适用的，我国民法和侵权责任法在动物园管理上都有规定，不适用无过错责任。而且更重要的是,无过错责任的适用还有一个前提,那就是受害者或者说是被侵权人,也没有过错,否则依然不能适用。
曾经出现过见义勇为者追小偷,小偷被车撞伤,却判决见义勇为者承担赔偿责任的案例。这种案例多了,不仅搅乱了人们的正常判断,也导致社会对司法失去了信心。所以这些年来司法全力纠偏,强调司法审判的法律效果和社会效果相统一。朴素的正义观告诉我们,违法甚至犯罪的行为不应该也不可能得到合法的赔偿。逃票进入动物园的行为是犯错,不是犯罪,其社会危害性也小得多,但是在逻辑上两者是相通的,即错误的开始不能导出正确的结果,法律保护的是正当合法的权利,而不是违法行为。
