2010年整个试卷的分值是600分，估计及格线按照惯例也是360分。由于2010年司考大纲的结构小幅调整，具体科目的分值则有一些变化：2010年各个学科的具体分布如下：卷一整体上保持稳定，个别学科有小幅的调整，最大的突出特点还是在开篇五题考察了“社会主义法治理念”，共考察5分。法理学依然强势，仍然是23分，宪法学和2009年持平，考察了23分，与法理学相当。法制史10分不变，司法制度和法律职业道德总体分值与往年持平，考察了10分。经济法由于《证券法》从卷一移到了卷三，故减少了五分，自2004年以来的40分降为35分。三国法部分，国际公法、国际私法和国际经济法在分值上保持不变，分别是12分、15分和17分，总共44分。卷三的科目每年都会有大的调整，2010年的突出特点是商法的回升，一共考查了56分，商法开始回暖。民法依然保持稳定，考察了90分。相比之下，民事诉讼法、仲裁法在2010年司法考试中的分值有所回落，考查了66分，相比去年分值有大幅度下降，已经接近历年司法考试中的低谷。卷四的分值分布依然和2010年保持一致，传说中司法文书依然没有出现，同时，加大了商法案例题继的考察。在论述题上，按惯例，卷四第一题综合考查政治时事题，考点依然是“社会主义法治理念”，20分。第二题依然是刑法案例，22分。第三题是刑诉法案例题，21分。第四题是民法案例，22分。第五题是民诉案例，20分。第六题考查商法案例，分数多达22分。最后一题是论述题，按照2008年是刑法、2009年是民法，到2010年回归到行政法的套路，分值25分。卷二中三个学科的分值多年保持不变，三科分值分别是：刑法58分、刑诉52分、行政法40分。2010年延续三个学科的“刑法——刑诉——行政法”排列方式。综上，理论法学的分值弹性很大，如果加上卷四的两道论述题的话，分值高达106分，完全是一个重量级学科。司法制度部分由于社会主义法治理念的加入，分值保持不变。刑法部分今年有所下调，但是依然是接近民法的超级大国地位。刑诉73分保持了传统地位，但是民诉有所下滑。民法部分的总分值高达90分，依然是超级大国。行政法部分，今年加上最后一天的论述题，虽然案例题不予考察，总分数保持了2009年的势头。商经法继续回升，到了91分，预计2011年会继续保持稳定。2010年试题从总体上看，应该说是“重者恒重”的。传统的重点突出学科，如民法、民诉、刑法、刑诉，其命题重点都非常突出，考查生僻知识点的题目很少出现。如理论法学部分，包括法理学、法制史、宪法学、司法制度和法律职业道德，整体上看内容琐碎，但就每一个学科而言，重点还是比较突出的，法|律教育网整理法理学和宪法学尤其如此。今年变化最大是商经部分。商法试题都是考查重要考点，没有偏题。经济法试题，就具体考点来看应该说也不算偏门，同时，2009年各个小法之间的分值分布合乎逻辑，对重点问题进行了集中的考查。但是，商法案例的横空出世，也为2011年分值分布带来了一丝讯息。新增考点和社会热点理所当然地属于司法考试的考查热点，今年表现地更为突出。“新增必考”，涉及新增法律法规和大纲中新增的理论考点，在2010年试题中得到了全面证明。从理论法学中唯一增加的“法律规则与语言”到法制史中唯一的“谋杀和故杀”，到让人大跌眼镜，号称本年司法考试最简单一题的司法制度中检察官的要求中把“严明”改为“文明”，这些理论考点的考查力度都很大。至于新增法规，如经济法的《城乡规划法》、《办理利用互联网、移动通讯终端、声讯台制作、复制、出版、贩卖、传播淫秽电子信息刑事案件具体应用法律若干问题的解释
