供餐协议书
甲方:
乙方:成都芊村道餐饮管理有限公司
甲﹑乙双方本着充分自愿、平等、公平、诚实信用之原则,根据《中华人民共和国合同法》及国家其它相关法律、法规、条例,经双方友好协商,就甲方向乙方订购快餐事宜达成如下协议:
一时间
1.1乙方向甲方提供快餐服务,为了保障乙方正常安排生产,具体每天的用餐人数甲方应在每天10点前通知乙方,如果临时取消订餐,甲方需提前一天通知乙方。乙方如因特殊原因不能完成供餐工作,也需提前一天通知甲方,并协助甲方重新安排供餐工作。
1.2甲方用餐时间为乙方每日需在甲方指定时间内将餐运达。
1.3协议期限:本协议有效期一年。协议期满后,乙方享有优先续签权。
二价款及支付方式
2.1快餐数量及单价:甲方订餐人数约为人,每份元,配菜标准为。
2.2甲方每次订餐不得少于______份,如少于此数,乙方有权适当增收运费。
2.3结算方式为,双方依据签单记录进行费用核对,核对无误后甲方应在三个工作日内将货款一次性付清给乙方,不得拖欠。
三甲方的责任和权利
3.1甲方负责派人验收签字及其它组织协调配合。
3.2如果发生食物中毒事故,甲方需立即通知乙方。经防疫部门检疫后,确实为乙方责任的,则由乙方承担。
3.3甲方应按时支付乙方货款,若甲方逾期三个工作日未结清货款,乙方则有权要求甲方结清未付款,并向甲方按照未付款每日5‰的标准收取违约金。
四乙方的责任和权利
4.1乙方应按照《食品卫生法规》,向甲方提供符合食品卫生标准的快餐产品。
4.2乙方应确保每日用餐符合双方协议规定的标准,保证时间、质量和数量。
4.3乙方有义务在成本允许的范围内提供美味可口的快餐,并根据客户的意见提高产品质量及服务水平。
4.4乙方应按《餐饮业食品卫生法》建立食品留样制度并保证留样时间,以便查验。
4.5如因市场物价上涨过高,造成乙方连续两个月亏损,乙方则有权向甲方提出增加快餐费用标准,甲方应尽快进行市场调查,并在五个工作日内给予答复,若情况属实,甲方应适当增加快餐费用。如甲方拒绝增加快餐费用,乙方则有权单方面终止本协议并不承担违约责任。
五协议终止
甲乙双方如因不可抗力因素需终止协议,应至少提前15天告之对方,经双方协商达成一致后,协议方可终止,否则视为违约。
六违约责任
6.1甲乙双方均应诚实守信、认真履约,如果一方违约,另一方可提前终止协议,并由违约方支付守约方RMB10000元(人民币大写壹万圆整)的违约金或承担因违约给对方造成的全部经济损失。
6.2在合作期间,因特殊原因不能开展订餐工作,如一方未提前一天告之对方取消订餐,则由违约方支付守约方当次餐费60%的违约金。
6.3因本协议所引起的争议,双方应本着友好协商的原则进行解决,协商结果另以协议的方式确立,或者签订本协议的补充协议以便在剩下的协议期内执行,补充协议与本协议具有同等法律效力。如协商不成或任何一方拒绝协商的,双方均同意向乙方所在地的人民法院诉讼解决。
6.4本协议一式两份,甲乙双方各执一份,经甲乙双方签字盖章后生效。

杉阳镇普棚村完小学生食堂营养餐猪肉供应
协 议 书
甲方:杉阳镇普棚村完小
乙方:(猪肉供货商):杉阳镇杉阳村七组 周启明
甲方因学生食堂需要,委托乙方负责为甲方食堂提供成品猪肉,双方本着诚信、负责的原则,经协商达成如下协议。
一、乙方责任、义务
1、乙方所售食堂猪肉,要确保质量、安全,不得掺病死猪肉,不得售给甲方营养、卫生不达标猪肉。
2、乙方所售猪肉必须为加工后的成品,每次必须保证质量(腿精肉)、数量(41.6市斤,其中含肥肉4市斤)。
3、肉类等相关副食品必须提供有效检测证明,要杜绝病死猪肉进入校园。
4、乙方要确保按时送货(每周一、二、四早9:30前),所送猪肉要对质量、卫生、安全负责。同时因质量问题包退、包换。并配合甲方做好采购单的相关内容的填写。
5、因乙方所送猪肉质量安全问题,造成相关部门的任何处罚,由乙方自己承担,甲方概不负责。
6、乙方所送食堂猪肉质量,须得到甲方认可。
二、甲方责任、义务
1、甲方委托乙方采购后,在此期间甲方不得私下采购,由此产生的后果由甲方负责。
2、食品原料送到后,甲方负责验收其数量、质量。
3、验收后因甲方保管不善,造成原料变质、过期等责任由甲方负责。
4、甲方定期(一般为按月结算)与乙方结算,结算方式以现金支付(每周三次,单价:15元/市斤,每次数量:41.6市斤)。
三、其它
此协议自2013年8月26日至自2014年7月20日终止。本协议一式两份,甲乙双方各执一份。
