二、本案涉及的罪名及犯罪构成要件
诈骗罪 刑法第266条
以非法占有为目的,用虚构事实或者隐瞒真相的方法,骗取数额较大的公私财物的行为。
本罪的构成要件:
(1)主体
本罪主体是一般主体,凡达到法定刑事责任年龄、具有刑事责任能力的自然人均能构成本罪。YXX、ZXX为有刑事责任能力的自然人。
(2)客体
本罪侵犯的客体是公私财物所有权,YXX与ZXX骗取了我公司的财物。
(3)主观方面
本罪在主观方面表现为直接故意,并且具有非法占有公私财物的目的。
(4)客观方面
本罪客观上表现为使用欺诈方法骗取数额较大的公私财物。首先,行为人实施了欺诈行为,欺诈行为从形式上说包括两类,一是虚构事实,二是隐瞒真相;从实质上说是使被害人陷入错误认识的行为。欺诈行为的内容是,在具体状况下,使被害人产生错误认识,并作出行为人所希望的财产处分。欺诈行为的手段、方法没有限制,既可以是语言欺诈,也可以是动作欺诈;欺诈行为本身既可以是作为,也可以是不作为,即有告知某种事实的义务,但不履行这种义务,使对方陷入错误认识或者继续陷入错误认识,行为人利用这种认识错误取得财产的,也是欺诈行为。控告人认为,本案中YXX、ZXX通过伪造XX公司印章及委托授权书、对账单等材料到我公司骗取了人民币XXXX元的行为是典型的犯罪行为,叶海清、ZXX的行为已明显触犯了我过刑法第266条诈骗罪及第280条伪造公司印章罪。控告人认为,鉴于YXX、ZXX的行为是两个行为结合(伪造XX公司印章以达到伪造授权委托书、对账

XX 年5月,控告人徐某某通过同学叶某某介绍,得知被控告人能够安排参加就业面试,工作内容是机场地勤,但张某某称参加面试要交36000元,徐某某认为张某某是学校招生办的老师,应该不会欺骗学生。XX年5月,在位于北京市顺义区马坡附近的农业银行将36000元整打入了被控告人张某某的银行账户中。打款时,张某某随行,并写有收条一张,承诺如面试不过,则一周内退还所有费用。
在 XX年6月底至7月初时,徐某某参加了一次面试,但没有通过,张某某也没有退还任何费用。直至XX年底,张某某推荐徐某某参加另一次面试,工作内容竟然是办理会员卡,徐某某拒绝参加。XX年,张某某有另外介绍徐某某参加面试,虽然工作地点实在机场,但是工作内容仍然不属于地勤。

经过了解得知,张某某以同样的方式欺骗了控告人李某某。XX年9月中旬,控告人李某受到被控告人张某某的电话,声称可为其安排春秋航空公司乘务员的工作,但要求其支付1XX0元,并承诺如果办不成全额退款。鉴于张某某在招生办负责工作,出于对张某某的信任,XX年10月,李某将12万元汇入了张某某的账户。张某某利用签订协议的形式掩饰其非法目的的诈骗控告人李某的财产。在汇款后,张某某通知李某到春秋航空公司的招聘站上填写资料,之后就让李某等面试通知。李某在没有收到春秋航空公司的面试通知的 情况下,张某某就执意让李某参加面试。XX年12月中下旬,李某参加了春秋航空公司的面试,但是在最初的审核阶段就被刷下来了,根本没能参加面试。后李某要求张某某按照约定退还全款,遭到张某某的拒绝,并声称再为其介绍其他面试,肯定能安排工作,但此后李某没有接到任何面试通知。
在李某的再三催促下,捌万伍仟元。XX年6 月,李某再一次要求张某某返还费用,张某某声称9月底肯定能还,但是到9月底仍未归还。此间张某某的电话一度停机,导致李某与其失去联系,几经周折才通过学校联系到了张某某,但其仍然一拖再拖,只在XX年12月归还了1000元,至今仍有36000元未还。
被控告人张某某,利用其学校招生办老师的身份,利用控告人毕业在即、急于就业的迫切心理,骗取控告人的信任,谎称能够为其安排就业面试,向控告人索取巨额费用。但实际情况是,被控告人根本就没有能力为其安排所要求的工作。在控告人提出退还费用的要求时,被控告人百般抵赖,用各种理由进行推脱,大行无赖之事,电话停机,故意躲避控告人,可见其非法占有控告人钱财且拒不归还的事实。

自XX年4月至XX年9月之间,“南公馆”以会员制的形式经营,通过虚假承诺提供南公馆高尔夫球场终身服务的方式,以明显低于市场价格的销售手法,从第一期定价每名个人会籍万元起始(对外号称每销售100名会籍即提价一次),然后按万元/名、万元/名、万元/名,分期提价对外销售会籍(期间也以
万元、万元的价格分两期对外销售家庭卡),在短期内诱使800多名会员签订《南公馆入会合约书》(见附件1),获得会籍销售款保守估计约亿元之间。
我(们)认为政府整顿高尔夫球场是正确的,但信昌公司通过违法销售高尔夫球场会员卡为自己敛财并想借机脱身,特别是明知球场要关门后,仍隐瞒、否认球场将被关闭的消息,对外销售会员卡。球场关闭后,对于控告人等已经支付的会员费用的退还及赔偿等事宜,被控告人均未告知,并且,至控告人提交本控告函之日止,被控告人也未给出明确的答复,有明显占有会员财产的故意,涉嫌合同诈骗。
据此,控告人认为,被控告人的行为属于《中华人民共和国刑法》第224条规定的合同诈骗罪的相关行为,理由如下:
1、被控告人在没有取得相关资质的情况下,运营的名为“南公馆”的高尔夫球俱乐部,并隐瞒该事实。自XX年至XX年间,以明显低于市场水平的价格吸引大量顾客,先后与800多名客户签订入会合同,收取高额入会费,承诺提供高尔夫球相关服务,后于XX年11月30日突然单方面宣告关闭。至本控告函提交之日止,对于控告人等已经支付的会员费用的退还及赔偿等事宜,被控告人即未明确告知,也未给出任何答复。上述事实可以证明,被控告人在客观方面存在虚假表示,及取得财物的行为;主观方面,被控告人明知其无经营高尔夫球场的资质,也知道其随时可能会关闭,依然以明显低于市场水平的价格吸引大量顾客,放任其工作人员大量招揽会员,与会
员签订前述声称营业期长达近40年的合同,收取高额钱财,符合刑法理论中的间接故意。因此可以认定被控告人存在通过虚假表示而非法占有财产的故意。
2、自XX年7月起,由于国家政策等因素,传闻高尔夫球相关项目已受到行政部门的限制,并面临整改甚至取缔的风险。数位控告人于此时就该等风险询问被控告人,问其是否具有履行或继续履行合同的能力,被控告人向上述控告保证其具有履约能力。基于此,数位其他受害人又与被控告人先后签订了数份“入会合同”,并支付了相应的入会费用。据控告人事后了解到,早在今年7月,国家早有文件下达至上海,有关部门也早与被控告人进行有关取缔的接洽。控告人认为,被控告人明知其运营的“南公馆”高尔夫球俱乐部即将关闭,依然通过合同承诺近40年的服务时限,大量销售会员资格,收取财物。并且,至本控告函提交之日止,对于控告人等已经支付的会员费用的退还及赔偿等事宜,被控告人既未明确告知,也未给出任何答复。上述事实可以证明,被控告人在客观方面存在虚假表示的行为,及取得财物的行为;主观方面,被控告人明知其无法继续运营,却依然通过签订合同的大量销售,加大受害人数和涉及钱款数额,符合刑法理论中的直接故意,因此,可以认定被控告人存在通过虚假表示而非法占有财物的故意。
3、被控告人作为单位,可以构成合同诈骗罪的犯罪主体。
4、被控告人的行为符合《刑法》第224条第(三)款中表述的:有下列行为之一,以非法占有为目的,在签订、履行合同过程中,骗取对方当事人财物,数额较大的,……
(三)没有实际履行能力,以先履行小额合同或者部分履行合同的方法,诱骗对方当事人继续签订和履行合同的;……
5、被控告人的行为符合XX年5月7日,最高检、公安部《关于公安机关管辖的刑事案件立案追诉标准的规定

任何学校,任何班级,似乎总有那么一个淘气的阶层,这些学生纪律差、学习差、性格顽皮、我行我素、给人一种没脸没皮的印象。曾几何时,一见到严重违纪的学生怒从心起,接下来便是大发脾气,严厉的训斥。表面上学生是老实了,驯服了,过不了几天可能又出新的祸乱,这种恶性循环使学生的心里产生了强烈的对抗情绪。控制情绪,循循善诱,以理服人,以情动人,是学生欢迎的老师,是一种平等的民主的情感教育,是良性批评的一种体现。
四、无痕的批评
当学生有过错的时候,教师不要讽刺、挖苦和嘲笑,要多想办法,用“无痕”的批评,给以良性刺激。老师的一番话如同武林高手“踏水无痕”一样,在呵护和引导中显示出强大的威力,它不伤害学生的自尊,不丢学生的面子,更不会引来抵触情绪。苏霍姆林斯基说:“造成教育青少年的困难的最重要的原因,在于教育实践他们面前以赤裸裸的形式进行,而处于这个年龄期的人,就其本性来说是不愿意感到有人在教育他们的。”,“无痕的批评”正体现这一教育思想。在无痕的批评中,学生理解了什么是尊重,什么是平等,体现了独立人格的尊贵和老师的拳拳之心。批评无痕,润物无声。虽然无痕却有着惊人的力量,于无声处听惊雷,在心与心的愉悦中,学生醒悟了。在心与心的碰撞中学生的思想升华了,学生的灵魂净化了,学生的成绩提高了。事实说明,无痕的批评,可以加强师生之间的情感交流、保护学生的自尊,激发学生的进取心,有利于学生的健康发展,能收到最佳的教育效果。总之,一个有事业心的教师,在探讨课堂教学之余,浅谈班主任“批评的艺术”
每位班主任都希望他的学生纪律严明,学习进步,授课时有一种愉悦的学习气氛。但总有个别学生违纪情况,总能看到一些老师对学生的缺点过错采取讽刺、挖苦、体罚的批评方式。错误的批评方式不仅孕育学生的逆反和怨恨心理,也给学生的身心健康带来不利的影响。那么,班主任怎样批评学生,体现爱心,给学生以良性刺激呢?下面浅谈我的四点体会。批评的艺术与技巧——班主任工作方法之我见
俗话说:“良药苦口利于病,忠言逆耳利于行”。因此,教育不能没有批评,没有惩罚。但教师在批评的时候如果方法不当,不但达不到教育的目的,反而可能引起教师与学生之间产生隔阂。因此,批评不但是教育人的一种手段,也是一门艺术,更是一门科学。真正富有教育魅力的批评,不是伤害学生心灵的刑具,不是批评者广施威风,使被批评者无地自容,而是在于培养学生的尊严感,激发学生上进心,促使学生道德上的自勉。本文试以自己的带班经验,浅析批评教育的艺术和技巧。
一、批评要及时
对于学生实施惩罚的批评,应体现及时性原则,即发现学生犯了错误之后,及时进行批评惩罚,指出其错误所在及应该承担的责任。如发现学生有损坏公物现象,要及时指出其错误和危害,而不能等到时过境迁,再来批评惩罚他。
二、批评要情感投入 古人云:“感人心者,莫先乎于情。”教师只有像对待自己的孩子、朋友那样,满怀真诚、理解、尊重、信任和爱护,才能使学生亲近、信任教师,和盘托出心底的秘密,心悦诚服地接受教师的批评和指点。对那些惰性心理、依赖心理较强的学生,他们的行为往往未得到别人的肯定,犯错误后又易受老师的训斥。长此以往,他们总觉得不被理解而产生一种惰性和逆反心理,有时甚至与老师对抗。碰到这样的学生,老师在教育批评时应加强情感投入,并在平时对他们的学习、生活多关心,做好心灵疏通,晓之以理,动之以情。满含期待的批评,往往收到奇效。
三、批评要寓讲故事、打比方中
学生由于年龄尚小,对道理的理解往往不容易到位,他们有时还不能清晰地意识到自己错误的存在。老师对他们可采取旁敲侧击的方式,寓批评于讲故事、打比方或意味深长的动作、言语之中,促使学生深思、自责。著名教育家孙敬修见几个孩子在折树枝,便把耳朵凑过去,装出听什么的样子,孩子们好奇地问爷爷在听什么,他说是听小树苗哭泣。“小树苗也会哭吗?”“是呀!你们折了它,它当然要哭。它们说,它们长大好为大家作贡献呢,请你们不要损害它们。”孩子们听了,羞愧得脸也红了。后来,他们自动组织起护林小组。未发一句责备的话,却取得了一般批评所难以取得的效果。
四、批评要体现平等性 在批评学生时,教育者还经常犯的一个毛病就是对差生所犯的错误进行非常严厉的批评,往往是“罚重于过”;而对于好学生的错误往往采取“大事化小、小事化了”的态度,甚至是“视而不见”。很显然,这种不平等的态度会导致学生对于惩罚不以为然,批评也就收不到应有的效果,还会生产极大的负面效应。因此,教育者在运用批评这种手段时,要一视同仁,没有偏颇,要让每一个学生都做到遵守共同的“规则”,而不能凌驾于集体规则之上,只有如此,批评才能发挥其应有的效果与威力。
五、批评要带建议性
建议性的批评是指在批评时带有商量、讨论的口气,与学生交换意见的批评。一般的做法是老师以商量问题的态度,把批评的信息传递给学生,与学生交谈时,平心静气,创造一种宽松、愉快的气氛,使学生打消顾虑,与教师配合,达到圆满解决问题的目的。学生是幼稚的,常在主动工作和做好事的时候犯错误。对于这种由于想得不周到,顾此失彼的错误,决不能简单否定、讥笑。老师要热心提出一些建议性的意见,在他们面临失败的时候,帮助他们取得成功。或者老师带有强烈的感情色彩以惋惜来表示自己的批评态度。如“你什么都好,就这方面存在不足,实在可惜”,“你要是不犯这个错误,那该多好啊”。这种方式即达到了批评学生的目的,又体现了老师对学生的理解和爱心,寥寥数语,效果却很明显。
六、批评要做好铺垫
批评之前,要做好使学生愿意接受批评的铺垫工作。讲讲面对错误的正确做法;树立榜样,讲讲名人在错误面前是怎样做的;在班级里反复强调勇于接受批评是学生的美德;讲讲“闻过则悲”、“闻过则闹”的危害。从多方面提高学生对批评的承受能力,逐渐在班上形成自觉自愿接受批评的风气。
七、先表扬,后批评
著名教育家陈鹤琴说:“无论什么人,受激励而改过,是很容易的,受责骂而改过,是不大容易的,而小孩子尤其喜欢听好话,不喜欢听恶言。”因此,尤其对于那些自尊心受到严重挫伤,丧失上进心,破罐子破摔的学生,批评根本起不了作用,班主任用表扬代替批评,不失为一种良策。这样既保护了学生的自尊心,又使学生看到了前途和希望,还让学生感到班主任的公正。使用这种方法,要作深入细致的调查研究,从后进生身上找到闪光点,一分为二地分析问题,表扬时要恰如其分,不夸大其词,不轻描淡写。
八、批评要用暗示性语言
暗示性的批评是指教师用语言、神态、人格等为暗示手段的一种批评方式。教师语言内容多为点拨提醒之类的话,主要适用于心细、敏感、自尊心强、能知错就改的学生。只要老师稍稍给予指责信号,略作点拨,他们就会立即改正错误,如我班的学习委员小敏一向表现不错,但在一节数学课讨论时,却与好友高声谈笑,其行为影响了他人的学习。于是,我在他到办公室领取作业时顺便暗示他,作为班干部要树立自己的形象。做同学们的榜样。这样点到为止,就能收到良好的效果。
九、批评可以尝试用戴“罪”立“功”
学生总会犯这样那样的错误,许多错误往往是自控力差造成的,在认识上不存在什么障碍。对这样的错误,讲多少道理,也往往是徒费口舌,教师不妨“罚”他做一件好事来弥补自己的过失。这种方法可消除犯错误学生的心理负担,还可以增强他们的集体荣誉感,往往使学生乐意接受。应该指出,教师应有太阳一样光明磊落的胸怀,把自己的光和热送到每一个学生身上,不能厚此薄彼。对学生的缺点,不论是好学生或是后进生都不应偏袒,要一视同仁,公平相待。
十、批评要注意场合
学生犯了错误,如果教师不分场合,大肆批评,就会伤害学生的自尊心,也会使教育工作事与愿违。教师要尽量不要当众责备学生,让学生有台阶下,让学生感受到教师在尊重他的人格,事后再去教育学生定会收到事半功倍的效果。

批评不是处理学生迟到行为的唯一途径
我担任班主任工作已经有十五个年头了,可以说班主任工作的酸甜苦辣我都尝过,尽知其中的滋味。根据本人的工作体会,对班主任工作中批评的艺术,谈点粗浅的看法,批评是思想教育的一种重要手段,正确运用这一手段,可以帮助学生认识并改正错误。班主任所面对的是天真活泼但心理承受力“脆弱”的学生,要使批评达到一定的效果,就要同他们心理相融,感情相通,这就必须分析和研究被批评学生的心理状况和特点,掌握批评的艺术。
一、批评要注意场合。
批评是教师手中的常规武器,每个教师都要经常使用。然而,由于对它的本质认识不同,使用方法不同,其效果也不大相同。那一种见到学生有了问题,老师的气就呼的上来,劈头盖脸的猛克一顿的发泄式的批评,是根本要不得的。要达到批评的效果,我们不妨把批评化作暖流,注意批评的场合。一般情况下我都不在公共场合指出学生这样或者那样的不是。因为,当众揭学生的短处,会使学生无地自容,抬不起头,产生逆反心理,不接受教育。我班的小江,不但是足球场上的猛将,而且头脑灵活,但是贪玩,常常欠交作业,各科考试均在60分以下。“水不激不跃,人不激不奋”怎样才能激起其奋发,改变缺点呢?我一改以往唠唠叨叨的说教方式,把批评小江贪玩,不完成作业,选择在放学的路上,而且声音小得只有我们俩才听到,目的是怕小江在同学中难堪,怕在各位老师面前不好意思。同时用亲切入心入脑的话语:第一句就是“你的脑袋并不笨,怎么这几次考试不及格呢?是不是只顾踢球?”首先肯定积极因素,让他有战胜困难的信心,接着是“太可惜,如果这样下去,将来怎样毕业?”用无限惋惜的深深情意,打消了与被批评者之间的对立情绪,最后用“你的球技这么精彩,我不相信你的学习会比别人差,我等着批改你的作业呢?”当他交作业、学习、考试成绩由不合格到合格时,我马上在教导处和他谈话,让老师们都听到小江的进步,使小江在众人面前尝试成功后的幸福,扩大进步的影响。这样,通过地点的变化,老师对学生的期望值,使被批评者心甘情愿地接受,自然而然地按老师的希望去做。
二、批评要把握分寸。
在教育批评中,要力求点到即止,把握分寸。学生出现问题是
难免的,只要不是原则性问题,并有清醒的认识和改过的决心与行动的,在处理上要宽容,要为他的过失找理由:是与年龄特征有关呢?还是出于好奇、好动?或出于兴趣?或出于无意?我曾经遇到这样的一件事:在一次新课的教学中,我的课已经进行了十分钟,而且讲得正浓,同学们也听得津津有味,突然,一声高叫“OK!”在课室的一角有一个身影拍案而起,同学们随即把头转过去,原来是班长郭仕彬。我随即走过去,示意他下课来找我,又继续讲课了。放学后,班长向我交待了这件事的经过:明天要参加省一年一度的“育苗杯”复赛,为了多做几道题,他不但没有听课,而且为了一道题冥思苦想,终于想到答案,因抑制不住高兴的心情而犯了大错。说完后班长低下了头,我没有批评他,而是肯定了他的学习干劲和钻研精神。我的话还没有说完,他却自责地说:“老师,我不该在你上课的时候做其它题目,更不该忘乎所以,高声叫喊的。”这种既让学生易于接受的,对老师的原谅产生一种负疚感,从而不断鞭策自己的没有批评却胜于批评的批评,不是比那种“电闪雷鸣”式的批评教育效果不是更好吗?
三、批评要柔刚相济。
学生中大部分是遵守纪律的,但是有极个别非常捣蛋,常常在
课堂上捣乱。面对这类的学生,我认为可用以下方法:第一“镇”以严肃批评“镇”住他们,此时如果对他们的态度稍软,会导致他们得寸进尺,认为老师软弱可欺,会影响教学的效果的。第二步是“理”,以理服人。上课时对学生犯错,下课后再到办公室接受批评,往往在心理上产生一种逆反心理,如果此时再严厉批评,会使这种逆反心理加重。因此,应和颜悦色地指出问题的实质,说明道理,让其知道老师为什么这么严,从心理上认识到自己的不对,老师的批评是对的,刚(镇)与柔(理)并用,往往会被调皮者接受的。
四、批评要幽默风趣。
在班主任工作中,恰如其分地运用幽默风趣的批评方式,能在班级营造宽松和谐的心理氛围,从而收到事半功倍的教育效果,如:学生早读迟到,可以这样问:“今天早上你们那里的太阳比我们这儿的升得晚吗?”学生字迹潦草,则说:“××同学的作业简直是“宛若龙蛇地上舞,天下先生谁认得。因此,在不挫伤学生自尊心的前提下,幽默风趣的批评比粗暴的训斥更胜一筹。
“批评的艺术”还在适时、适度、适情、适势,在批评学生时,班主任须记住:你是在教育学生,而不是在发泄私愤,你在叫喊前,要先忍耐几秒,你是一位教师,这样会帮助你压抑一下当时就要发出的脾气,转而心平气和地跟你的学生对话。
批评有法,但无定法,它涉及到方法、态度、动机等许多问题,以及批评背后的责任心、事业心等,批评是一门高深的学问,它要求我们教育者不断学习、琢磨、探讨。
