六、甲方义务 Obligations of Party A 1.甲方须按时将房屋及附属设施（详见附件）交付乙方使用。
Party A will provide the premises and attached facilities(see the appendix of furniture list for detail)on schedule to Party B for using.2.房屋设施如因质量原因、自然损耗或灾害而受到损坏，甲方有修缮并承担相关费用的责任。
In case the premise and attached facilities are damaged by quality problems, natural damages or disasters, Party A will be responsible to repair and pay the relevant expenses.3.甲方应确保出租的房屋享有出租的权利，反之如乙方权益因此遭受损害，甲方应负赔偿责任。
Party A will guarantee the lease right of the premises.Otherwise, Party A will be responsible to compensate Party B's losses.七、乙方义务 Obligations of Party B 1.乙方应按合同的规定按时支付定金、租金及保证金。
Party B will pay the rental, the deposit and other expenses on time.2.乙方经甲方同意，可在房屋内添置设备。租赁期满后，乙方将添置的设备搬走，并保证不影响房屋的完好及正常使用。
Party B may decorate the premises and add new facilities with Party A's approval.When this contract expires, Party B may take away the added facilities which are removable without changing the good conditions of the premises for normal use.3.未经甲方同意，乙方不得将承租的房屋转租或分租，并爱护使用该房屋如因乙方过失或过错致使房屋及设施受损，乙方应承担赔偿责任。
Party B will not transfer the lease of the premises or sublet it without Party A's approval and should take good care of the premises.Otherwise, Party B will be responsible to compensate any damages of the premises and attached facilities caused by its fault and negligence.4.乙方应按本合同规定合法使用该房屋，不得擅自改变使用性质。乙方不得在该房屋内存放危险物品。否则，如该房屋及附属设施因此受损，乙方应承担全部责任。Party B will use the premises lawfully according to this contract without changing the nature of the premises and storing hazardous materials in it.Otherwise, Party B will be responsible for the damages caused by it 5.乙方应承担租赁期内的水、电、煤气、电讯、收视费、等一切因实际使用而产生的费用，并按单如期缴纳。
Party B will bear the cost of utilities such as communications, water, electricity, gas, management fee etc.on time during the lease term.八、合同终止及解除的规定 Termination and dissolution of the contract 1.乙方在租赁期满后如需退租或续租，应提前两个月通知甲方，由双方另行协商退租或续租事宜。在同等条件下乙方享有优先续租权。
Within two months before the contract expires, Party B will notify Party A if it intends to extend the leasehold.In this situation, two parties will discuss matters over the extension.2.租赁期满后，乙方应在当天将房屋交还甲方；任何滞留物，如未取得甲方谅解，均视为放弃，任凭甲方处置，乙方决无异议。
When the lease term expires, Party B will return the premises and attached facilities to Party A within days.Any belongings left in it without Party A's previous understanding will be deemed to be abandoned by Party B.In this situation, Party A has the right to dispose of it and Party A will raise no objection.3.本合同一经双方签字后立即生效；未经双方同意，不得任意终止，如有未尽事宜，甲、乙双方可另行协商。
This contract will be effective after being signed by both parties.Any party has no right to terminate this contract without another party's agreement.Anything not covered in this contract will be discussed separately by both parties
九、违约及处理 Breach of the contract 1.甲、乙双方任何一方在未征得对方谅解的情况下，不履行本合同规定条款，导致本合同中途中止，则视为该方违约，双方同意违约金为人民币___________元整，若违约金不足弥补无过错方之损失，则违约方还需就不足部分支付赔偿金。

一、出租人（以下简称甲方）

landlord’s obligations: 8.1 甲方须按时将出租房屋及其设施以良好的状态交付乙方使用。
party a shall deliver the leased property and the related facilities in good condition to party b on schedule.8.2 租赁期内甲方不得收回出出租房屋（除非本合同另有规定）
party a shall not take back the leased property durning the term of the tenancy.(unless otherwise stipulated in this agreement)8.3 在乙方遵守本合同的条款及交付租金的前提下，乙方有权于租赁期内拒绝
甲方或其他人骚扰而安静享用出租房屋。
provided that party b abides and performs the appendixes of the agreement and the payment for the tenancy, party b has the right to refuse the interruption from party a to enjoy the life satisfaction and peace.8.4 房屋基本设施和结构，甲方有修缮的责任并承担有关的费用，并对其做定
期修缮。party a is responsible for repairing and maintaining the basic facilities of the leased property and for bearing all costs thereto.8.5 甲方谨在此声明及保证甲方为出租房屋的合法拥有人并由合法地位出租此
房屋与乙方。
party a hereby represents and warrants that party a is the legal owner of the leased property and has the necessary legal capacity to lease the property to party b.8.6 如在租赁期内，租赁房屋发生所有权全部或部分转移、或其他影响乙方权
益的事情时，甲方应保证所有权人或者其他影响乙方权益的第三者，能继续遵守本合同所有条款，如乙方与本合同的权益人首次等所有权人或第三者所影响或损害，甲方须负责任补偿乙方的所有损失、损害、支出及费用。if durning the term of the tenancy, all or part of the leased property is transferred or party b’s right to use the leased property is attested, party a shall ensure that such transferee or third party having an effect on party b’s right to use the leased property will continue to abide by the terms of this agreement.party a shall also be liable to keep party b be fully indemnified against any costs,expenses,losses, and damages suffered by party b if any of party b’s interests herein are affected or prejudiced by a third party.九、承租人的责任： tenant’s obligatons: 9.1 乙方应按合同的规定，按时支付租金，保证金及其他各项应付费用。

party b shall treat the leased property with care.because of party b’s 9.4 乙方应按本合同的规定合法使用租赁房屋，不得擅自改变其性质，不应存
放中华人民共和国法律下所禁止的危险物品，如因此发生损害，乙方应承担全部责任。party b shall use the leased property legally as agreed in this agreement and may not change such use on its own.party b shall not store any dangerous items, which are prohibited by the laws in the people’s republic of china in the leased property and shall be fully responsible for any damages or a result thereof.9.5 租赁期即将结束之日，经乙方同意，甲方可以带其他客户看房。

3、乙方应爱护房屋及其设备，如因使用不当而导致损坏，乙方应负责赔偿。
4、除房内已有的装饰和设施之外，乙方如要增加设备或其他装修须征得甲方同意。租赁期满，乙方 向甲方交还房产时，必须恢复其原状（正常磨损除外）。
5、在未经甲方书面同意下，乙方不得擅自设立、安装或移动设施及设备，不能擅自设立隔断，不得 擅自对房屋的结构改动或增加。

用房屋进行违反法律及不道德的行为。
7、房屋除供乙方居住之外，未经甲方书面同意，房屋不可作办公或协议未曾说明之用。the leased property is only for residential use.party b shall not use the leased property as office or some other purposes without the written agreement of party b.8、租赁期内，乙方需提前退租，应提前30日通知甲方，并按月租金的支付甲方违约金。during the term of contract, if party b terminates the tenancy agreement, party b shall inform party 第八条： 房屋不能居住时 when the property is unfit for use or occupation：
房屋由于火灾、恶劣天气、战争或其它甲方不可抗拒因素, 而不是因为乙方直接或间接的疏忽及故意行为造成房屋毁坏而不能被正常使用及居住时，乙方从该日起停止支付租金，直至房屋可再被使用及居住时为止。
第九条： 其它 others：

6.1 Party A shall ensure that the construction structure and the equipment and facility of the Premises conform to the safety conditions concerning construction, fire prevention and others, and the Premises has not any danger to the personal safety.Party B shall ensure that the relevant laws and regulations of national or Beijing government shall be observed during use of the Premises.6.1甲方应保证房屋的建筑结构和设备设施符合建筑、消防等方面的安全条件，不得危及人身安全；乙方应保证在使用过程中遵守国家、北京市的相关法律法规规定。•

6.2.2 If the Premises and its contents, equipment and facilities are damaged due to Party B’s improper keeping or unreasonable usage, Party B shall be responsible for repair and maintenance and shall be liable for compensation.6.2.2因乙方保管不当或不合理使用，致使房屋及其附属物品、设备设施发生损坏或故障的，乙方应负责维修或承担赔偿责任。
1.Rights and Obligations of Party A 2.甲方权利及义务
7.1 Party A hereby guarantees that Party A is the legal owner and has the right to lawfully lease the Premises.Otherwise, Party A shall bear the legal liability arising therefrom in full.7.1 甲方保证是项目合法的拥有者，其有权合法出租该单元，否则产生的法律责任均由甲方承担。7.2 Party A hereby guarantees that the Premises is housing that has been developed, constructed and completed legally.The Premises has not been sold on the signature date of this Contract, and it does not exist other legal impediments which may affect the performance of this Contract.7.2 甲方保证该单元是合法开发建设完成的房屋，本合同签订时该单元尚未对外销售，也不存在影响本合同履行的其它法律障碍。
7.3Party A hereby guarantees that Party B shall have the right to occupy and enjoy the Premises peacefully throughout the Term without any interruption by Party A or its agents, provided that Party B has paid the rent and other fees hereunder and complies with the terms and conditions to be performed by Party B under this Contract.7.3 甲方保证在租期内，乙方将有权平静地占有和享用该单元，不会受到甲方或甲方代理人的干扰，但前提是乙方支付了本合同规定的租金和其它费用，并遵守和履行了本合同规定的应由乙方遵守和履行的条款。7.4 Party A has the right to terminate this Contract unilaterally upon occurrence of any of the following to Party B: 7.4 乙方出现下列任何情况时, 甲方有权单方解除本合同。

8.1 Party B is entitled to occupy and use the Premises reasonably and legally during the Term provided that it strictly complies with the terms and conditions of this Contract.8.1 如果乙方严格遵守本合同的各项条款, 则乙方有权在租赁期内合理、合法占用和使用该单元。8.2 Party B shall pay rent and the expenses of electricity, water, gas, telephone, ID long distance call incurred at the Premises and the service fee of other specific facilities provided for Party B on time(other than the written agreement between the parties).8.3 乙方须按时缴付租金以及该单元的电费、水费、煤气费、电话费、IP主叫长话费，以及供乙方使用的其他专门设施的服务费，（甲、乙双方另有书面约定除外）。
8.4 Party B shall keep the internal part of the Premises in clean and good condition and shall prevent damage, pollution and fire, etc.It shall have the duty to supervise his visitors and friends to protect the property of Party A or the public facility of this compound.If there is any damage caused to Party A, other owners or lessees of this compound or the public facility of compound due to Party B’s reason, Party B shall compensate for the losses arising therefrom.8.4 乙方应负责该单元内部的整洁完好，防止破坏、污染、火灾等事故，并有责任监督来访的客人及朋友爱护甲方的物品，以及小区的公共设施。如由于乙方的原因，给甲方其他业主和租户或该小区的公共设施造成损害时，乙方必须赔偿损失。1.Termination of Contract 2.合同的终止
9.1 Upon occurrence of any of the event prescribed under Article 8.4, Party A is entitled to unilaterally terminate this Contract without the need to issue any notice requesting for rectification of the breach.9.1 第8.4条所规定的任何情形发生时，甲方有权单方直接终止本合同而无需发出纠正通知。
9.2 The parties may terminate this Contract early by reaching a written agreement through consultation.9.2 甲、乙双方经协商，可达成书面协议提前终止本合同。
9.3 If either party cannot perform this Contract due to the occurrence of any force majeure events(such as earthquake, storm, hail and fire)which cannot be predicted or the occurrence and consequence of which cannot be avoided, the party who experience the force majeure event will be exempted from liability for failure to perform relevant obligations of this Contract(save for payment obligations).9.3 因发生地震、暴雨、冰雹、火灾等其他不能预见的，其发生和后果不能防止或避免的不可抗力致使任何一方不能履行本合同时，遭受不可抗力的一方可免除未能履行本合同项下相关义务的责任（付款义务除外）。
1.Penalty for Breach 2.违约责任
10.1 Any party who breaches this Contract shall compensate for any economic loss caused to the other party due to the breach.If the economic loss is due to default of both parties, both parties shall bear respective liability for breach in accordance with the circumstance.10.1任何一方有违反本合同的行为，应就违约行为给对方造成的经济损失进行赔偿。如果属于双方的过失，应根据情况，由双方分别承担违约责任。

4.The LESSOR hereby acknowledges receipt of the sum of USD.19,800/-(US dollars Nineteen Thousand and eight Hundred Only)per month.5.It is hereby agreed between the parties that the LESSEE shall pay the aforesaid monthly rent
USD.3,300/-(US dollars Three Thousand and Three hundred Only)as the monthly rental advance by 20th of each calendar month for which if is due after completion of advance rent period ending on 15th July 2004.6.That the LESSOR hereby acknowledges receipt of the sum of Rs.60,000/-(Rupees Sixty Thousand Only)from the LESSEE as FIXED EDPOSIT SECURITY which shall be refunded to the LESSEE on giving back the vacant possession of the DEMISED PREMISES after deduction of damages/shortages outstanding bills for Electricity, Water, Gas and Telephone charges etc, against the DEMISED PREMISES.THE LESSEE HERBY CONVENANTS WITH LESSOR AS FOLLOWING:
1.To pay to the LESSOR the rent hereby reserved in the manner before mentioned.2.That the LESSEE shall not at any time during the terms, without the consent in writing of the LESSOR, pull down, damages or make any structure alterations to the DEMISED PREMESES provided always, the LESSEE shall have go write install any fixtures and fittings excluding air-conditioners in the DEMISED PREMESES, to detach and repossess the same stheir original state at his cost(reasonable wear and tear excepted)on the expiry of this lease or any renewal hereof.3.To use the DEMISES PREMISES for residential purpose and would not be used for a commercial purpose the DEMISES PREMISE would not be used occupied by Mr.****
And family.4.Not to sublet the whole or any part of the premises.5.To pay regularly the bills for Electricity, Gas, Water and Telephone charges in respect of the DEMISED PREMISES.A copy of all the paid utility bill be forwarded to the LESSOR every three month regularly.In case of disconnection of any facility due to non-payment, LESSEE will be responsible to get them restored
and pay the same.All dues must be cleared before the expiry of the LEASE.6.The LESSEE shall keep and maintain the said premises in good and tenantable conditions during the tenure of the lease.THE LESSOR HEREBY CONVENANTS WITH THE LESSEE AS FOLLOWING:-
1.To pay all existing and future rate, taxes assessments and other charges of a public nature whether impose by the Municipality, Government or any other authority in respect of DEMISED PREMISES.2.Not to erect or set up a building or structure on the DEMISES PREMISES nor to add to any existing building or structure during the period of lease or any renewal without the written consent of the LESSEE.IT IS HEREBY DECLEAR AND MUTURALLY AGREED BETWEEN THE LESSOR AND LESSEE ANS FOLLWING:=
1.The LESSEE and the LESSOR shall have the right and option to terminate this Lease at any time only after the expiry of the lease period i.e., 24 months, provided they give ONE(1)month notice in advance to either of the parties.2.The meter reading of various utilities are as given below:-
