谢谢主席。评委老师，对方辩友大家好。今天我们讨论的这个话题是“应不应该提倡山寨文化”。对此，我方认为不应提倡山寨文化。原因有四：

第一,从符号学角度讲，山寨文化处于黑和白之间的灰色地带，用以柔化规则，消解传统社会中的固有元素，形成某种表面上的裂变，企图弱化国家法律对原创文化的保护。

第二,从法律上讲，山寨文化是一种侵权行为。有人标榜“山寨”为草根创新，强调群众智慧。这里面有自娱自乐，模仿搞笑的成分，但根本上是剽窃、侵权。这种行为受益者是侵权者，而对于原创者，对于创新体制，对于一个国家和民族的长远发展有百害而无一利。

第三,从历史唯物主义角度讲，只有创新才是一个民族发展的不竭动力。中华民族五千年的文明史，本身就是一部波澜壮阔的创新发展史。党的十七大提出，要“提高自主创新能力，建设创新型国家，这是国家发展战略的核心，而不是搞山寨。

“山寨”一词源于广东话。是一种由民间IT力量发起的产业现象。其主要表现为仿造性、快速化、平民化。主要表现形式为通过小作坊起步，快速模仿成名品牌，涉及手机、数码产品、游戏机等不同领域。这种文化的另一方面则是善打擦边球，经常行走在行业政策的边缘，引起争议。

“山寨厂”指的是遍布广东的各种电子产品加工制造厂，这些厂商大多没有正规品牌。2008年，当山寨文化在手机领域摧城拔寨，在数码领域跃跃欲试，用各种各样无所不及的方式吸引着人们的眼球之时，已经没有多少人知道这股来势汹汹风光无限的民间势力曾经有过卑微低下甚至不值一提的惨淡出身。

2001年、2002年那段时间，如果内地人到深圳、广州去出差，就会发现一个很匪夷所思的现象：很多当地人拿的都是诸如“NOKLA”、“Samsang”这样的牌子手机，无论是正规商店还是街头小摊，摆得最多卖得最好的都是一些奇奇怪怪至少在内地闻所未闻的品牌手机。

这时的山寨文化还扎根于生产出这些奇怪品牌手机，遍布沿海的众多小型电子加工厂（或者说是小作坊）里面，没有人认为这些东西能成气候，更不会有人认为这些东西的背后存在一种更深层次的东西，将来会影响中国的IT行业。这一点和中国的武侠文化倒是 惊人的一致：成大器者往往是最不起眼的那个。

其实，跟山寨手机同时出现的还有山寨MP3，在华南地区一度涌现出300多个让国人看得眼花缭乱的MP3牌子.与山寨手机相比，这些山寨MP3更早走向全国，出现在大小电脑卖场的柜台上，与“创新”、“三星”这些名牌MP3摆在一起，形成一道颇有意思的风景线。

当然，山寨MP3最终还是没有如同手机这样成大气候。原因是多方面的，MP3本身的发展前景 不够明朗，很快就被音乐手机和其他数码产品所取代；山寨MP3的发展过于无序，这种无序反过来对MP3市场造成了重大伤害，这一点充分体现了山寨文化初期 发展的盲目性和非正统性;MP3市场容量不足以容纳如此多的品牌，最终陷入瘫痪——这一点跟手机市场正好相反。

山寨文化是以极低的成本模仿主流品牌产品的外观或功能，并加以创新，最终在外观、功能、价格等方面全面超越这个产品的一种现象。它的衍生物，将打破手机的束缚，而扩展到数码相机、鼠标、键盘等等方面，它的副产品同样可以在相关行业引发结构性震荡。这是师夷长技以制夷的炮火，这是学比赶超的来福枪，山寨文化在抄袭与超越的羊肠小道上一路狂奔，尤其是挣脱了牌照的束缚，握紧了低成本高回报的福祉之后，它摧枯拉朽的震撼力与病毒营销的感染力，彻底颠覆了传统的行业潜规则，建立了以山寨文化为基础的价值序列。而且，山寨文化深深地打上了草根创新、群众智慧的烙印，是当之无愧的中国式山寨。

山寨文化的弊端

起源：山寨一词原代表那些占山为王的地盘，有着不被官方管辖的意味。如今，这个词被用于那些数码产品的生产模式上。它是一种由民间发起的产业现象。其主要表现为仿造性、快速化、平民化。主要表现形式为通过小作坊起步，快速模仿成名品牌，涉及手机、数码产品、游戏机等不同领域。这种文化的另一方面则是善打擦边球，经常行走在行业政策的边缘，引起争议。“山寨”文化深深地打上了创新恶搞和非主流的烙印。从IT仿制品到“另类翻版”文化时下被网友们热议的最“雷”话题之一无疑是“山寨”。

几种山寨现象 1.山寨厂。“山寨厂”指的是遍布广东的各种电子产品加工制造厂，这些厂商大多没有正规品牌。2008年，当山寨文化在手机领域摧城拔寨，在数码领域跃跃欲试，用各种各样无所不及的方式吸引着人们的眼球之时，已经没有多少人知道这股来势汹汹风光无限的民间势力曾经有过卑微低下甚至不值一提的惨淡出身。2001年、2002年那段时间，如果内地人到深圳、广州去出差，就会发现一个很匪夷所思的现象：很多当地人拿的都是诸如“NOKLA”、“Samsang”这样的牌子手机，无论是正规商店还是街头小摊，摆得最多卖得最好的都是一些奇奇怪怪至少在内地闻所未闻的品牌手机。2.山寨一条街。山寨一条街掀起受众的山寨关注热潮。有报道称，在南京文安街有这样一处鳞次栉比的山寨店群，乍一看外观以为是一群国内外知名店铺，仔细一瞧才发现，屈臣氏、星巴克、必胜客、李宁、哈根达斯等已被“山寨”为曲同氏、巴克星、必胜糊、李明、哈根波斯。在网络搜索引擎上输入关键词“山寨机”，搜索到相关网页315万篇———排在首位的便是“山寨机网”，该网广告竟是“推介国产强机，交流山寨手机文化。”真是搞笑至极。3.山寨的野蛮生长从IT仿制品到“另类翻版”文化。近两年来，国人对美剧追看成风，其中较受欢迎的《丑女贝蒂》最终也被“山寨化”———湖南卫视自制的《丑女无敌》在收视率上一路狂飙。日前，湖南卫视总编室表示要将山寨剧进行到底，不仅要继续拍《丑女无敌》第二、三季，还要拍山寨版的《流星花园》。还有就是去年搞了台山寨春晚。4.山寨歌声。在KTV中自我陶醉一把 有一个教英语的节目到街头采访，问平时到哪里唱歌，问到的都是些时尚男女，无论学历高低、英语优劣，每个人都一定至少会说两个词“Holiday”和“PartyWorld”，无论他是否知其英文本意。演戏要训练，跳舞要练功，可唱歌谁还不会呀。就算把你唱到一地鸡皮疙瘩，耳朵上堵两斤棉花，至少让我在自己的“山寨歌声”中陶醉一把吧。

弊端以及评论：弊端：第一，山寨文化就是抄袭文化。他们没有自己的东西，一味的模仿是没有前途的，最终会变成奴仆，要不走向灭亡；第二，山寨文化打击了真正的创新。有人说一些高技术行业的垄断利润太高了，但是他们同样要承担开发的费用，而山寨产品挤压了他们的利润空间，降低了市场占有率和销售额，让这些厂商无法投入更多的资金开发新产品。从某种意义上来说，山寨文化打击了创新。总的来说，山寨文化有侵权嫌疑，与法律打察边球。

为什么会产生山寨文化呢？主要原因有二：不经质量检测，质量无法保证，售后服务很差，而当“山寨产品”大量流入市场，这是对消费者的一种伤害，这是其一；其二，“山寨产品”生产经营毫无规章可循，政府亦难以有效管理，且是对“品牌文化”的一大打击。其实归根结底是法律的不健全，以及人们对法律意识的淡泊。

全国政协委员倪萍表示应立法封杀“山寨现象”，倪萍说，“山寨”这个风刮得太猖獗了，网上到处都是，遍地泛滥，尤其很多未成年人都能上网，他们不知道哪个是真的哪个是假的。“山寨文化”假的多、复制的多、盗版的多。最可怕的是所谓的“山寨”都打着民间文化与草根的旗号，但干的完全不是一样的事情，很多都是盗版、造假。她表示，要从法律上和行政上采取手段，立法制止，同时从舆论上给予制止。

一直以来，关于山寨现象的讨论就没有停歇过，在各种各样的声音中，山寨经历了从最开始为人所诟病的“劣质”、“侵权”到现在所推崇所谓“趣味”、“创新”的华丽转身。山寨的无所不在成就了其无所不包的特性，仿制剽窃谓之山寨；恶搞娱乐谓之山寨；粗糙丑陋谓之山寨；锐意创新亦谓之山寨„„山寨俨然成为了一种放之四海皆准的文化标榜。翻开报纸、打开网页，各类标题也直想贴上“山寨“的标签引人注目。从“山寨产品”到“山寨文化”。“山寨”一旦贴上“文化”的标签，就似乎变得“亲切”、“可爱”起来。而在“文化”的外衣下，在我们为其匪夷所思的创意而拍掌叫好，甚至目瞪口呆时，也不能忽视到那些潜伏在人们猎奇与盲从心理下的庸俗与浅薄。在我们坐享山寨“盛宴”时，也不妨保持一份冷静与思考。

很多人认为山寨文化是一种创新，那么请问何为真正的创新？创新是要加入自己的东西，而不是一味的借用他人的，抄袭他人的，或是将他人的整合起来。外表创新而内部的技术根本无创新，实为技术的降级。韩国的车子90%是合资，但是最终外国技术只占20%，而不是像中国的山寨手机将他人的技术直接拿过来拼凑一下。有些人买一些所谓的高档手机（山寨机）也是为了要满足自己的虚荣心。过年了各个电视台搞个文艺节目是他们的自由，但何必要去模仿春晚呢？春晚是我们国家庆祝春节的一个特色，你去模仿一下不免让人笑话，感觉像是拿转头砸自己的脚趾头。中华民族的文化应该是精英文化，中华民族的素质不只是这些草根文化，应该是一种提炼！

首先在此提出山寨文化的定义：山寨文化是依靠模仿，抄袭，恶搞等手段发展壮大，反权威，反主流且带有狂欢性，解构性，反智性以及后现代表现得亚文化。其弊端远远大于利，以下我从三个方面论述：

【1】山寨文化对文化本身的影响，山寨文化与其说是文化的发展的结果，不如说是一种僞创新。它是仿照造假的延续，是集体缺乏真正创造力而又不愿承认的托词。近年来中国国内出现大量山寨文化现象，从山寨手机，笔记本到山寨食品，药物再到山寨歌曲舞蹈层出不穷，像SQNY的手机，康帅福方便面，山寨春晚这样的仿冒品不仅讽刺了正版，有华众取宠之嫌，更侵害了正版的品牌文化。它仅仅只对品牌的外观进行克隆，其内容实质不做考究，差强人意了。其自身没有发展创新的同时让真正对问题探究和创新的人和企业失去信心，使文化不能良性可持续发展，文化创新停滞不前。

【2】山寨文化对社会经济的危害。当山寨文化商品化滚滚而来时，正常的经济秩序被相继打破。首先其商品的价格大大低于同类商品市场价，导致企业间大打价格战，出现更多商业贿赂，伪劣产品，商业垄断。不但出现市场自发性滞后性等弊端，也危害了广大购买者的经济利益。其次当山寨商品挤掉品牌商品的市场份额时，市场经济的出现山寨化，也就在经济危机尚未过去的现在影响场经济紧急的恢复和发展。

【3】山寨文化对社会精神的消极作用。政协委员倪萍在今年年初的政协开幕会会场外就一响亮的嗓门说道：“我坚决反对*山寨文化*。现在年轻一代被所谓的山寨文化影响的很厉害，认为这是草根文化的代表，但什么是真什么是假，什么是真善美什么是丑恶，我们应该给青年人更健康的教育。“

当某一新事物被冠以文化一词之后，其身价像牛市一样立马翻几番。2008年是中国山寨年，山寨广受人追捧。先是山寨手机粉墨登场，继而山寨电脑、山寨服装、山寨春晚、山寨官员、山寨电影、山寨天安门、山寨大学……形形色色的山寨之风像金融危机一样在中国的市场上刮得人心不安。近日，王冉在博客《山寨文化泛滥是一件丢人的事》中说：“山寨文化的泛滥与其说是对草根创新精神的标榜和昭彰，不如说是对中国知识产权意识严重缺位的裸露与讽刺。”但是马上就有“山寨帮”反对：“觉得王冉太过矫情，不知道到底要替谁说话。山寨文化怎么就泛滥了？如何就丢人了？”

山寨加上后缀文化之后，“山寨帮”就有了说话的底气，颇有点像Q一样，“和尚摸得，我就摸不得吗”，一时间，理也直了气也壮了。只是我想问问，怎么不见“山寨帮”去追捧含三聚氰胺的三鹿婴幼儿奶粉呢？山寨药怎么不买呢？山寨鸡蛋怎么不吃呢？山寨针怎么不打呢？因为用了这些“新事物”之后，你不死也会得肾结石。但，穿山寨服装就不会死人了，价格还便宜，山寨手机也用不死人，而且比真的更花哨。“山寨帮”为何反对山寨官员呢？因为山寨官员拿着纳税人的钱在国外游山玩水；“山寨帮”为何不买山寨汽车呢？因为拼装的汽车不安全；“山寨帮”为何不用山寨人民币呢？因为它难花出去。“山寨帮”对山寨文化的追捧在于其对自己是否有利，有利的就成为时尚风标，成为文化，也就变得深奥高尚起来。

山寨文化是一种什么文化呢？其实就是盗版文化、侵权文化，也就是强盗文化。它盗取他人的知识产权，经过组装、拼凑、换版、贴牌，蔫然正版模样充饰着市场，成为消费者的新宠，而一旦被冠以文化之后，盗版之风、侵权之风就更加堂而皇之了，就如同座山雕一跃坐进了紫金城，成为主流文化。山寨文化是劣币驱赶良币，市场经济的自由也就像被贴牌一样，变得一文不值了。

你到深圳电子市场看看，山寨手机就像萝卜白菜一样卖，为什么这么便宜，因为它不要缴纳国家17%的增值税、销售税，不用花大价钱研发产品，因为它是盗取他人的知识产权，把别人产品改头换面地组装拼凑一番。山寨手机掀起强大市场冲击波，国内品牌手机大企业几乎全部出现亏损。据央视报道，2007年，山寨手机产量至少有1.5亿部，几乎与国内市场手机总销量相当，对国产手机品牌给予致命一击。民族正规品牌产品在劫难逃。如今，除了华为、中兴、TCL等以国外市场为主的厂商外，国内品牌手机大企业几乎全部都出现亏损，其中波导亏损5亿多元，夏新更是亏损6亿多元，有些企业甚至退出了市场。

也许有人会说，美国人不也搞了山寨纽约时报吗？但是，山寨版纽约时报一是免费发行，二是制作者申明是仿冒的，并向公众道歉。美国“山寨帮”搞的山寨纽约时报，其实是一疯狂的恶作剧，它是公民表达意见的方式，就如同烧美国国旗一样行使公民言论自由权，其讽刺幽默跃然纸上。但中国的山寨文化没有一点幽默讽刺，只有鸡鸣狗盗，只有唯利是图。

山寨文化的泛滥，使中国人的道德底线再一次降低，在“山寨帮”集体狂欢之中，是市场秩序的混乱与沦丧，是国家合法税收被商贩抢劫了。山寨一旦文化之后，自然混淆了国人的价值判断的目光，好与坏、真与假、美与丑之间的界线就变得模糊了。中国没有知识产权保护的传统，你的就是我的，行“拿来主义”。微软在全世界黑屏，但只有中国人反应最强烈。阴谋论，垄断暴利论，侵权论，无聊论，“有计划的网络犯罪”论，律师起诉论，林林总总，国人盗版了微软为何如此理直气壮呢？难道不是山寨文化、山寨心理在作鬼吗？微软黑屏在香港成不了新闻，这是因为，在香港，使用盗版软件的公司是要负刑事责任的。山寨文化一旦成为时尚，被冠冕堂皇地成为国人效仿追逐的对象之后，助长的是国人的懒惰和无知，损害的将是中国人的创造力和竞争力。中国至今为止为何没有出现一个软件业巨头？主要原因不是微软的垄断（微软垄断的只是Windows和Office两种产品而已），阻碍中国软件业发展的，恰恰是盗版。因为盗版，没人敢做大规模的研发投入。

假冒的就是假冒的，盗版的就是盗版的，不是你经过文化打扮了，就时髦了，就能光明正大地、合法地招摇过市。山寨不要再文化了，它实在是丢中国人的脸！
