第五篇：法律调解知识

法律调解

一、法律调解原则

（一）坚持以人为本原则。

（二）坚持法律、政策、情理相结合的原则。

（三）坚持法律调解与法律宣传并重的原则。

（四）坚持法律援助和责任义务的原则。

二、法律调解程序

（一）立案受理。对现场接访，领导指派及时立案，落实首接负责制，一包到底。

（二）倾听诉求。全面掌握情况，确定矛盾起因、焦点、难点。

（三）调查取证。实地调查取证，制定初步调解方案。

（四）调解确认。召集双方当事人进行现场调解，调解成功的发放调解协议书。适宜进行司法确认的，指导当事人到人民法院申请确认。

（五）法律意见。调解暂难以达成协议的，依照法律、法规及相关政策出具法律意见书，引导当事人通过法律途径解决纠纷。对需诉讼解决的，由律师、基层法律服务工作者提供代理服务；符合法律援助条件的，按照法律援助规定予以办理。

（六）落实办理。调解成功的，及时落实协议，出具法律意见。调解无果的，报送有关责任单位教育稳控。
