剧本改编权合同书样本

甲方：（版权费支付方）________________

乙方：______________________________

根据《中华人民共和国著作权法》和其他相关法律规定，甲、乙双方充分协商，达成如下协议：

一、甲方委托乙方根据小说《》改编_______集电视连续剧（电影）《》。

二、乙方同意将以上剧本全权交付甲方使用，剧本使用权及制作权归甲方所有。

三、甲方应履行的义务如下：

1、甲方保证在未来电视剧制成品及宣传品上署明：

原作编剧：__________终稿编剧：__________

未经乙方书面同意，甲方不得随意变更以上署名格式。

2、甲方负责支付乙方稿酬人民币元（税后），乙方的所得税由甲方代扣代缴。付款方式如下：

（1）本合同签字之日起五个工作日内，甲方向乙方支付人民币元整；

（2）乙方向甲方提交1-30集剧本初稿并交付甲方后十个工作日之内，甲方向乙方支付人民币元整；

（3）乙方完成1-30集修改完成稿，经甲方认定通过后，在开机前甲方将剩余稿酬元人民币一次性支付给乙方。

（4）电视剧拍摄制作完毕后，甲方允诺另向乙方支付原稿酬的10%，即元（税后）人民币作为奖金，在首播前一次性付给。

3、甲方保证拥有该原创剧本《》的电视剧本改编权，否则由此引起的侵权责任由甲方承担

四、乙方应履行的义务：

1、乙方保证按照甲方要求进行一次或多次修改，直到甲方满意为止。

2、乙方保证不将本电视剧中人物，情节，故事等主要元素向第三方提供（以获得报酬为准），并不以此另行创作剧本，否则法律责任自负。

五、其他事宜：

1、凡本协议中与中华人民共和国著作权法、版权法相抵触之处，以《著作权法》、《版权法》为准；凡《著作权法》、《版权法》未涵盖之处，以本协议为准；本协议的变更及其他未尽事宜，由双方另行协商解决；任何一方若有违约行为，按《合同法》有关条例执行。

六、本协议有效期为两年。

七、本协议一式四份，双方各执两份，自双方签字或盖章之日起生效。
